HomeMy WebLinkAboutR89-027 1041 application for KensingtonY Commissioner L4Z4 i moved adoption of the folding Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 89 - ,,; 7'7 FINDINGS OF FACT AND RECOMMENDATIONS IN RE THE 1041 APPLICATION OF KENSINGTON LAND INVESTMENT PARTNERS WHEREAS, the Eagle County Board of County Commissioners (the "Board "), in its capacity as the Eagle County Permit Authority, has conducted public hearings on August 25, 1987, after publication and notice was required by law, to consider - an application submitted by Kensington Land Investment Partners ( "Applicant ") concerning: H.B. 1041 Permits A. Major Extension of an existing water collection system and sewage treatment system; and B. Efficient utilization of municipal and industrial water project. (the above applications hereinafter being collectively referred to as the "Application "); and WHEREAS, the Planning Commission has unanimously recommended approval of the permit on August 19, 1987; and WHEREAS, the Board has considered all the evidence, exhibits and arguments presented; and WHEREAS, no other person applied for party status or presented evidence in opposition to the Applicant. THEREFORE, based on the evidence presented at the hearings, the Board, in its capacity as the Eagle County Permit Authority, makes the following findings with regard to the Application in accordance with the requirements and criteria set forth at the "Guidelines and Regulations for Areas and Activities of State Interest of the County of Eagle, State of Colorado," which are environmental regulations and land use regulations adopted pursuant to authority of Section 24- 65.1 -101, C.R.S. The "Guidelines and Regulations for Areas and Activities of State Interest of the County of Eagle, State of Colorado," are codified in Chapter 6 of the Eagle County Land Use Regulations, there being no separate environmental code. H.B. 1041 PERMITS A. Section 6.03 e County Land Use Recrulations. The Board finds as follows relative to Section 6.03, that the project complies with all applicable criteria of Section 6.03.15 and the project's benefits outweigh the detriments. There are no significant water quality impacts. There are no wetlands affected by the project. B. H.B. 1041 Permits - Conditions. Based upon the evidence presented at the hearing, the Board of County Commissioners approves the application as submitted, with the following conditions kmposed with the project as proposed by the Applicants: 1. All water lines must be 6 inches in diameter. 2. Site approval from the Water Quality Control Division is required for the central septic systems.
