NOTICE IS HEREBY GIVEN by the Bachelor Gulch Metropolitan District, Eagle County, Colorado, that at the close of business on the sixty-third day before the election, there were not more candidates for director than offices to be filled, including candidates filing affidavits of intent to be write-in candidates; therefore, the election to be held on May 3, 2022 is hereby canceled pursuant to section 1-13.5-513(6) C.R.S. The following candidates are hereby declared elected: Russell J. Coburn three (3) year term until May 2025 Michael S. Leeds three (3) year term until May 2025 Vacancy one (1) year term until May 2023 By: Debbie Braucht, Designated Election Official Contact Person for the District: Debbie Braucht Telephone Number of the District: (970) 926-6060 Address of the District: 28 2nd St, Unit 213 District Facsimile Number: (970) 926-6040 District Email: debbie@mwcpaa.com BOARD OF DIRECTORS OF BACHELOR GULCH METROPOLITAN DISTRICT REGARDING A REGULAR ELECTION ON MAY 3, 2022  WHEREAS, Bachelor Gulch Metropolitan District (the “District”) was organized pursuant to Section 32-1-101 et seq., C.R.S. of the Special District Act (the “Act”); and WHEREAS, the District is located entirely within Eagle County, Colorado (the “County”); and WHEREAS, as provided in Section 1-13.5-111(1), C.R.S., the District desires to hold a regular election on May 3, 2022, for the purpose of electing the District’s Board of Directors (the “Election”); and WHEREAS, the District desires to set forth the procedures for conducting the Election in accordance with the provisions of the Act, the Colorado Local Government Election Code, Section 1-13.5-101 et seq., C.R.S. (the “Code”), and all provisions of the Uniform Election Code of 1992 not in conflict with the Code except as otherwise provided in Section 1-13.5-106(2), C.R.S., WHEREAS, pursuant to Section 32-1-804(1), C.R.S., the Board of Directors (the “Board”) shall govern the conduct of the Election and render all interpretations and make all decisions as to controversies or other matters arising in conducting the Election; and WHEREAS, pursuant to Section 32-1-804(2), C.R.S., all powers granted by the Board by Part 8, Article 1 of Title 32, for the conduct of regular or special elections may be exercised in the absence of the Board by the secretary or by an assistant secretary appointed by the Board, and the person named by the Board who is responsible for the conducting of the election shall be the designated election official; and WHEREAS, pursuant to Section 1-13.5-108(1), C.R.S., the designated election official named by the Board shall render all interpretations and shall make all initial decision as to controversies or other matters arising in operation of the Code; and WHEREAS, pursuant to Sections 1-1-111(2), C.R.S. and 32-1-804(2), the Board is authorized to designate an election official to exercise authority of the Board in conducting the Election. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BACHELOR GULCH METROPOLITAN DISTRICT AS FOLLOWS: 1. Pursuant to Section 32-1-804(2), C.R.S., the Board hereby appoints Debbie Braucht of Marchetti & Weaver, LLC, (“District Manager”), or such other representative of Marchetti & Weaver as may be directed by the Board at a public meeting in the event that the District Manager is unable to fulfill her duties under this Resolution, as Assistant Secretary to the District for purpose of the Election, and who shall be the Designated Election Official for the Election. The Designated Election Official shall act as the primary contact with the Eagle County Clerk and Recorder’s officer and shall be primarily responsible for ensuring the proper conduct of the Election including, but not limited to, appointing election judges as necessary, appointing
