AUTHORIZING THIRD PARTIAL RELEASE OF COLLATERAL FOR 10 ACRE
PLANNED UNIT DEVELOPMENT
FILE NO. PDP-9129
WHEREAS, pursuant to C.R.S. § 30-28-137, the Board of County Commissioners of the County
of Eagle, State of Colorado ("County") entered into a Subdivision Improvements Agreement dated
July 27, 2021 (the "SIA") with 10 Acre Holdings, LLC, a Colorado limited liability company
("Subdivider") for the 10 Acre Planned Unit Development ("10 Acre PUD"); and
WHEREAS, Subdivider provided collateral in the form of cash in the amount of $506,888.75,
which represented 100% of the estimated cost of the Subdivision Improvements ($432,966.00)
and 125% of the estimated cost of the Landscape Improvements associated with the 10 Acre PUD
($73,892.75); and
WHEREAS, pursuant to Eagle County Consent No. 2021-02 the County authorized a first partial
release of collateral in the amount of $154,298.25, thereby reducing the collateral held by the
County to $352,590.50; and
WHEREAS, pursuant to Eagle County Consent No. 2022-03 the County authorized a second
partial release of collateral in the amount of $292,366.65, thereby reducing the collateral held by
the County to $60,223.85; and
WHEREAS, Subdivider has represented to the County that certain Subdivision Improvements
required under the SIA have been completed and the Subdivider has applied for a third partial
release of collateral; and
WHEREAS, based upon the written recommendations of the County Engineer set forth in
Exhibit A attached hereto and incorporated herein, and the recommendation of the County
Attorney, THE COUNTY FINDS that certain Subdivision Improvements associated with the 10
Acre PUD appear to be completed as of February 15, 2023 and a third partial reduction in the
collateral is warranted; and
WHEREAS, pursuant to Resolution 95-25, the Chair of the Board of County Commissioners, or
in their absence, the Chairman Pro Tern, has the authority to approve partial released once the
release has been recommended for approval by the County Attorney; and
WHEREAS, based upon the recommendation of the County Engineer attached, hereto as Exhibit
A_, and the recommendation of the County Attorney, THE COUNTY FINDS that a third partial
release is warranted.
NOW, THEREFORE, BE IT AUTHORIZED BY THE COUNTY OF EAGLE, STATE OF
COLORADO:

THAT, based on the recommendation of the County Engineer and the County Attorney, the Chair
of the Board authorizes this third partial release of collateral in the amount of $256.50, thereby
reducing the required collateral to $59,967.35, which represents the estimated cost of remaining
Subdivision Improvements and Landscape Improvements for the 10 Acre PUD; and
THAT, the date of completion of the Subdivision Improvements of the 10 Acre PUD is February
15, 2023, as established by the Eagle County Engineering Department, and this partial release of
collateral does commence the warranty period for said Subdivision Improvements, which period
shall begin on February 15, 2023 and end on February 15, 2025; and
THAT, said Subdivision Improvement collateral in the amount of $43,299.60 shall be retained by
the County until the two-year warranty period set forth in the SIA has expired; and
THAT, the Landscape Improvements have not been completed and the warranty period for said
Landscape Improvements does not commence with this partial collateral release; and
THAT, this partial release of collateral does not represent the County's acceptance of the work
purportedly completed by the Subdivider; and
THAT, this partial release of collateral shall not in any way abrogate the rights of the County in
enforcing the Subdivider's performance of its outstanding obligations under the SIA; and
THAT, this partial release is contingent upon the Subdivider retaining the remaining cash
collateral, and acceptable form to the County Attorney.

Authorization of the Third Partial Collateral Release
A written request for reduction of the collateral for the construction of portions of the improvements
under the agreement was received from Brian Rose on February 15, 2023.
The original amount from the signed Subdivision and Off -Site Improvements Agreement was:
Public Improvements = $432,996.00
Landscaping = $73,892.75
Total Collateral Amount = $506,888.75
The first partial collateral release was approved on October 7, 2021 in the amount of $154,298.25.
Total Collateral Amount = $506,888.75
First Partial Collateral Release = $154,298.25
Remaining Collateral Amount = $352,590.50
The second partial collateral release was approved on October 7, 2021 in the amount of
$2921366.65.
Total Collateral Amount = $506,888.75
First Partial Collateral Release = $154,298.25
Second Partial Collateral Release = $292,366.65
Remaining Collateral Amount = $60,223.85
The Eagle County Engineering Department confirmed the amount of work completed on February
15, 2023. Construction items were checked for completion as listed on the Costs for Subdivision
and Landscaping Improvements. The item requested for reduction were found to be constructed
and completed in a satisfactory manner. The Eagle County Engineering Department recommends
a reduction of the collateral in the amount of $256.50 from the $60,223.85. This will leave a
balance of $59,967.35 collateral remaining.
This reduction starts a two (2) year correction period for Subdivision Improvements but does not
start the correction period for Landscaping Improvements.

Hi Julie,
Happy snowy Wednesday. So I wanted to appraise you on the power pole situation.
So Comcast finally was able to underground their fiber optic on 10 Acre PUD successfully on 2/8 (they botched the
schedule for the January date so it didn't happen then). Holy Cross removed their three poles thereafter. Most notably, the
roadway in the cul-de-sac bulb area no longer has a pole in the middle - attached are some pictures to demonstrate this.
Per our email below and meeting on site (Tuesday 10/11/2023), 1 believe this is my last to-do item prior to getting the
warranty period started, so I'd like the warranty period started (i.e. approval of the site improvements), please.

In accepting this permit the undersigned property owner and/or contractor has applied for an
excavation permit pursuant to Chapter 11.03 of the Town of Basalt Municipal Code and Sec.222.3,
2612.3 and 2626 of the Town of Basalt Public Works Manual. In consideration of the issuance of
such a permit, each of the undersigned hereby warrant and guarantee all materials, labor and
workmanship utilized in the backfilling, compacting, repairing, and resurfacing of area where cuts
and excavation are made, to be free from any failing for a period of two (2) years from the date of
repair and resurfacing. In the event that falling occurs within the said time period, including
subsidence or damage to the asphalt, the undersigned shall promptly repair or replace defective
work or materials, at the undersigned's sole expense, In a manner satisfactory to the Town. All
work and materials provided under the warranty shall be further warranted for a period of (2) years
from date of acceptance by the Town.

This permit is being issued in accordance with ECLUR Section 1-140.C.3 which stales -Approvals and permits for building construction,
grading, and infrastructure development shall only be issued as part of or after final plat approval. Provided that the applicant is actively
pursuing the resolution of all issues associated with Final Plat. grading permits may be issued by the County Engineer following Preliminary
Plan approval if all regulations regarding collateralization of restoration bonding requirements, as well as all grading and erosion control
standards, as outlined in Section 4-660 and 4-665 are met.'
This permit authorizes work that would otherwise be included in a Subdivision Improvements Agreement (SIA) which would be approved at the
time of Final Plat. By signing this permit the Owner acknowledges that the Final Plat associated with this work has not been approved and
construction of these improvements is at the Owners risk. In the event the Final Plat is not approved. Owner shall restore the disturbed area to
its original condition or other condition authorized by the County Engineer.
