HomeMy WebLinkAboutR89-013 findings re Glassier propertys Commissioner �f+Te s moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS C5 ai COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 89- /,3 FINDINGS CONCERNING GLASSIER PROPERTY WHEREAS, on January 17, 1989, the Board of County Commissioners of the County of Eagle, State of Colorado (hereinafter the "Board ") conducted a hearing concerning a possible a zoning violation on property located at 1082 Valley Road, 0 0 Carbondale, Colorado, owned by Fred J. and Jo Ann Glassier; and Q 9 WHEREAS, since 1960 to present, heavy equipment has been stored at various locations on the property; and WHEREAS, various businesses have been operated on the property w 9 since 1960; and rr WHEREAS, the Zoning and Subdivision Regulations for Eagle County were adopted and incorporated into -the Eagle County Land Use Regulations by the Eagle County Board of County Commissioners on April 6, 1964 and October 19, 1974, respectively; and U- 0 WHEREAS, on January 15, 1980, a building permit was issued to a business operated by Fred Glassier known as Glassier /Terliamis, (D Inc., to construct a metal shop building; and CL WHEREAS, at the present time a rocking crushing business is a: being operated off of the property and has been operating on the M LU property since 1986 in conjunction with the contractor's storage � u yard; and LD y WHEREAS, the Board must determine if a non- conforming pre- m z o existing use, that being a contractor's storage yard, existed on 1� U the property before the Zoning Regulations were adopted by Eagle G w County; and 11 v0 W Based on the evidence before it, t` m cn u THE BOARD FINDS AS FOLLOWS: u J J H 1. The gravel operation on the property does not conform to the pre- existing use. (9 3. All gravel crushing operations on the property must cease C to operate by May 31, 1989. 4. Any rock stored on the property., as of January 17, 1989, may be crushed into gravel. No additional rock may be brought on to the property to be crushed. The Board finds, determines, and declares that this Resolution is necessary for the health, safety, and welfare of the inhabitants of the County of Eagle, State of Colorado.
