COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 89° 2
APPROVAL OF SPECIAL USE PERMIT - Tennessee Pass Mountain Resort Company
FILE NO. - ZS- 275 -88
WHEREAS, Tennessee Pass Mountain Resort Company, represented by
David Faulkenberg, did file an application with the Eagle County Department
of Community Development on or about November 4, 1988, within the
Resource Zone District; and
WHEREAS, based on the evidence, testimony, exhibits, study of the
Master Plan for the unincorporated areas of Eagle County, comments of the
Eagle County Department of Community Development, comments of public
officials and agencies, the recommendation of the Eagle County Planning
Commission, and comments from all interested parties, the Board of County
Commissioners of the County of Eagle, State of Colorado, finds as follows:
1. That proper publication and public notice was provided as
required by law for the hearing before the Planning Commission
and the Board of County Commissioners.
2. That the proposed special use conforms to the requirements of
Section 2.09 of the Eagle County Land Use Regulations.
3. That the proposed land use will be compatible with existing
uses in the area.
4. That for the above - stated reasons, the proposed zoning is in the
best interest of the health, safety, morals, convenience, order,
prosperity and welfare of the citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners
of the County of Eagle, State of Colorado:
That the application of Tennessee Pass Mountain Resort Company,
File No. ZS- 275 -88, for approval of a special use of.a resort within the
Resource Zone District in the following described unincorporated area of
Eagle County be approved:
See attached legal description
THAT the following conditions shall be placed upon this approval
and that violation of any condition shall be the basis for revocation
of the permit:
1. Commercial use is approved for winter use only;
2. The sleeping capacity is limited to 16 people;
3. Not approved for commercial snow - mobile tours or use.

THAT the Board of County Commissioners directs the Department of
Community Development to provide a copy of this Resolution to the applicant.
MOVED, READ, AND ADOPTED by the Board of County Commissioners of the
County of Eagle, State of Colorado, at its meeting held the

LEGAL DESCRIPTION
That portion of the Will County and Sucker Lode Mining Claims,
USMS #16722, described by metes and bounds as follows:
Beginning at Corner #2 of the Last Chance Lode Mining Claim,
USMS #9963; thence on a line bearing East 125 feet through a
Point on the line between Corner #1 and Corner #4 of Will County
Lode Mining Claim, being 420 feet from Will County Corner #1;
thence 305 feet East to a point on the line between Corners
#2 and #3 of Will County, being 425 feet from Will County
Corner #2; thence North 5 degrees West 425 feet to Corner #2
Of Will County; thence South 86 degrees West 250 feet to
intersect the line between Corners #2 and #3 of Golconda,
USMS, #9963, thence South 18 degrees West 150 feet to Corner
#3 of the Golconda; thence South 82 degrees West 75 feet
to intersect the line between Last Chance Corners #2 and #3,
being 40 feet from Corner #3; thence South 14 degrees West
260 feet to Corner #2 of the Last Chance, the point of
beginning, containing 3.7 acres more or less.
All of the above lands being situated in the Mitchell Mining
District,
