HomeMy WebLinkAboutR90-128 1991 fiscal budget and mill levy - public library fund} Commissioner (($°j}�cSpyJ moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 90 - Aal-J/ 1991 FISCAL BUDGET & MILL LEVY - PUBLIC LIBRARY FUND WHEREAS, on the 14th day of November, 1990, the Eagle County Library Board of Trustees submitted a budget and certified to the Board of County Commissioners the sums necessary to maintain and operate the library during the 1991 fiscal year, pursuant Section 24 -90 -109 C.R.S.; and WHEREAS, a public meeting to consider the proposed 1991 budget for the Eagle County Library was held on August 17, 1990, and September 21, 1990, before the Board of Trustees for Eagle County Library; and on November 14, 1990, before the Board of County Commissioners; and WHEREAS, pursuant to public notice duly published in accor- dance with Section 29 -1 -108, C.R.S., as amended, the proposed 1991 budget for the Eagle County Library has continuously been open for public inspection from August 17, 1990; and interested taxpayers were and have continuously been given the opportunity to file or register any objections to the subject proposed 1991 budget; and WHEREAS, the Board of Trustees has made provisions within the 1991 budget for the revenues in an amount equal to or greater than the total proposed expenditures set forth within the subject 1991 budget; and WHEREAS, Section 29 -1 -111, C.R.S., requires the enactment of a resolution making appropriations for fiscal year 1991 in accordance with the adopted 1991 budget for the Eagle County Library; and WHEREAS, all legal requirements have been fully complied with and performed in the premises: and WHEREAS, the annual budget of the Eagle County Library for fiscal year 1991 requires the generation of property tax revenue for the Public Library Fund for use by the Eagle County Library. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the total amount of $346,636.00 is the amount of the proposed revenues and expenditures for the County of Eagle Library, State of Colorado, fiscal year 1991. THAT the Board hereby adopts as the budget of the Eagle County Library, State of Colorado, for the 1991 fiscal year as certified to it by the Board of Library Trustees, that certain 1991 proposed budget considered and approved, with any amendments so noted, by the Board of Trustees on November 14, 1990, in the total aforesaid amount of $346,636.00 for the specific purposes, functions, restrictions and amounts identified during the various public budget meetings /hearings referred to hereinabove, and the various working documents associated therewith. THAT, the Board hereby adopts the appropriations certified to it by the Board of Trustees for the Public Library Fund the following amounts for the specific purposes, functions, restric- tions and amounts identified in the adopted 1991 budget for the Eagle County Library and associated working documents, and during the various public budget meetings /hearing referred to hereinabove; and THAT, a property tax levy of Nine Hundred Thirty -Four Thousandths mills (0.934 mills) for the Public Library Fund for operation of the Eagle County Library is approved; and THAT, pursuant to Section 29 -1 -116, C.R.S., Amy Niswanger, the Eagle County Librarian, is hereby requested and directed to immediately transmit a copy of this Resolution to the officer or employee of the County of Eagle whose duty it is to draw warrants or orders for the payment of money. THAT, pursuant to Section 29 -1 -116, C.R.S., the Librarian is hereby further requested and directed original or certified copy of this Resolution with the Local Governments in the Department of Local Affairs. -2- Eagle County to file an Division of THAT, the adopted 1991 budget and the 1991 appropriations made as set forth in this Resolution are to be read as one comprehensive and integrated document. In no event shall Eagle County Library expend or contract to expend any money; or incur any liability; or enter into any contract which, by its terms, involves the expen- diture of money for any purpose for which provision is made in this Resolution, associated working documents and the related public budget meetings /hearings, which is in excess of the amounts appropriated in this Resolution and /or purpose; nor which involves the expenditure of money inconsistent with the purposes, functions, restrictions, clarifications and /or specified monetary amounts as detailed and set forth within this Resolution, associated working documents and the related public budget meetings /hearings; nor which involves the expenditure of money for any purpose which is not identified within the aforementioned; unless prior to such expenditure, the Board of Trustees duly approves such expenditure in accordance with applicable law. THAT, the Board hereby declares to be the legislative intent that the several provisions of this Resolution shall be severable, in accordance with the provisions set forth below: If any provision of this Resolution is declared to be invalid by a decision of any court of competent jurisdiction, it is hereby declared to be the legislative intent that: a. The effect of such decision shall be limited to that provision or provisions which are expressly stated in the decision to be invalid; and b. Such decision shall not affect, impair, or nullify this Resolution as a whole or any other part thereof, but the rest of this Resolution shall continue in full force and effect. THAT, this Resolution is necessary for the public health, safety and welfare of the County of Eagle, State of Colorado. -3- MOVED, READ AND ADOPTED by the Board of County Commissioners of the County of Eagle, State of Colorado, at its regular meeting held the l �— day of December, 1990.
