My client, Evan DeMuth, currently resides in what I believe is a legally non -conforming building. His family purchased the property and the existing structure in 1963, and they have used it as a residence since then. Evan is now in a position to make some substantial improvements to the property, and he would like to make sure that he follows the proper processes. Our current proposal is to add to the existing building, per the attached schematic drawings, in order to bring the building up to Code. Part of this proposal is to add an Individual Sewage Disposal System on the property. Evan is currently working with the Arrowhead Metro District in order to purchase a water tap from them. Ideally, all of these items would be achieved at the same time, and we would be applying for all of the required permits simultaneously. Hopefully, at your joint meeting, you can determine if this is the proper procedure, and if there are other issues we should be considering. Evan was informed of these issues by Gerry and Tom during a July 29 meeting. I have talked and met with Evan several times to discuss installation of a dry well system for this site. Depending on the perc rate, it should be possible to install two dry wells and still meet setbacks. It would be almost impossible to install a trench system at this location. I have explained all the steps necessary for perc test, sizing, installation, etc.... Up to this point, I have not discussed any "creative interpretation" of the code with Evan that might be necessary to get this "dwelling" on an ISDS (although I know nobody around here would officially do this type on thing). Therefore, you (?) are now responsible for helping Mr. DeMuth obtain a suitable septic system. The Environmental Health Division discontinued percolation tests on November 15, 1994 and final inspections on December 2, 1994 due to climatic conditions. ISDS permits are active for 120 days after the date of issue if no Building Permit has been issued for the same property. If a Building Permit has been issued for the same property the ISDS will expire at the same time as the building permit. If you still plan to apply for a Building Permit this year or in the early months of 1995 you will need to have a percolation test conducted before your Building Permit will be released. You will have to contact a Registered Professional Engineering(RPE) firm to conduct your percolation test. If you have had your permit issued and have not had your final inspection completed, but plan on constructing the system in the next few weeks, please give our office a call and we will evaluate your permit on a case by case situation.
