BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 90- //'7
CONCERNING THE RELEASE OF COLLATERAL FOR
CHAMBERS RANCH PARCELS II SUBDIVISION
WHEREAS, on or about June 15, 1987, the Board of County
Commissioners of the County of Eagle, State of Colorado ( "the
Board ") did enter into a Subdivision And Off -Site Improvements
Agreement ( "Agreement ") with Loren G. Chambers ( "Subdivider "); and R.
�� WHEREAS, to guarantee the satisfactory completion of certain °%-4
GNP public improvements required under the Agreement, the Subdivider r
provided collateral in the amount of $15,110.00, by escrowing said
amount with Stewart Title of Eagle County, in Vail, Colorado; and
WHEREAS, by Resolutions No. 88 -37 and No. 88 -57, the Board did
authorize reductions in the collateral to the present amount of
$1,510.00; and
WHEREAS, the Subdivider has represented that the improvements
under the Agreement have satisfactorily survived the two -year
warranty period required by Paragraph 4.4 of the Agreement, and has
requested that the collateral be released in its entirety; and
WHEREAS, the County Engineering Department have corroborated
Subdivider's representations that the work has been satisfactorily
completed.
THEREFORE, Based upon the recommendation of the County
Engineering Department, the Board finds that the work required
under the Agreement is satisfactory, and that a release of
collateral is appropriate.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE
COUNTY OF EAGLE, STATE OF COLORADO:
That, the off -site and subdivision improvements for Chambers
Parcels II Subdivision are satisfactorily complete.
That, the collateral remaining in escrow is hereby released.
That, a copy of this resolution shall be delivered to Stewart
Title of Eagle County.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County of Eagle, State of Colorado, at its regular meeting
held the day of November, 1990.
