This being a scheduled Public Hearing,the following items were presented to the Board of County
Commissioners for their consideration:
Constituent Input
Chairman McQueeney opened and closed constituent input, as there was none.
Commissioner Updates
Commissioner Scherr expressed optimism for the upcoming year.
Commissioner Chandler wished everyone a happy New Year. She believed that 2023 would be a great
opportunity to do some great things.

Jeff Shroll thanked the many county teams that managed all the snow over the holidays to keep everyone
safe.

8. Resolution 2023-003 Adopting a Schedule of Airline Rates and Charges for the Eagle County Regional

Bryan Treu,Eagle County Attorney, spoke about Item#8. He pointed out that the airport was
self-sustaining. There was not a single tax dollar used to support the airport. Rates and charges would be set by a
resolution. The airlines would operate with a permit.
Commissioner Scherr moved to approve the Consent Agenda for January 3,2023 as presented.
Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous.

1. Resolution 2023-004 Concerning an Appointment to the Eagle Valley Library District Board of Trustees

Executive Summary: Rebecca Larson will be re-appointed to the Eagle Valley Library District Board of Trustees
for another 5 year term.
Commissioner Chandler-Henry moved to approve the resolution concerning an appointment to the Eagle
Valley Library District Board of Trustees.
Commissioner Scherr seconded the motion. The vote was declared unanimous.
Business Item - Eagle County Room
1. 1st Hearing-Fire Restriction Ordinance

Executive Summary: This ordinance is repealing Eagle County Ordinance No. 19-01 and Authorizing the Eagle
County Sheriff to declare fire restrictions within Unincorporated Eagle County. This will be the first reading of the
Ordinance. Public Notice of hearing was advertised in the Vail Daily on December 15 and December 22, 2022.

Matt Peterson,Assistant Eagle County Attorney, explained that the proposed ordinance must be introduced
and first read at the meeting of the board. The ordinance was considered to be introduced if the title of the proposed
ordinance was read and the entire text of the ordinance was submitted in writing to the board prior to adoptions.
The new ordinance makes very little changes to the existing ordinance but does revise the language for violation of
the ordinance from a class 2 petty offense to a civil infraction,removes restitution, and adds language specifying
anyone in violation of the ordinance may be subject to criminal and civil liability aside from the ordinance. The
fines would remain the same. Public notice was provided and no comments had been made. If the board wished to
continue with the adoption of the ordinance as currently proposed, a secondary reading and adoption would be
published no later than 10 days prior to January 31, 2023 and notice would include the full text of the proposed
ordinance. Adoption required a majority vote by the board.
Commissioner Scherr move to proceed to a second reading of the proposed Ordinance Repealing and
Replacing Eagle County Ordinance No. 19-01 Regarding the Authority of the Eagle County Sheriff to Declare Fire
Restrictions Within Unincorporated Eagle County on January 31,2023 and direct the County Attorney's Office to
provide notice of the second reading and the full text of the proposed ordinance to the public no later than 10 days
before the next hearing
Commissioner Chandler-Henry seconded the motion. The vote was unanimous.
