Commissioner Updates Commissioner Chandler-Henry gave a shout out to everyone who volunteered for the Birds of Prey last week. It was exciting to have the whole world here in Eagle County. She also gave a shout out to all the snow plow drivers navigating the roads and keeping everyone safe. Commissioner Scherr reminded folks that today was"Colorado Give's Day."There was a collaboration of non-profit organizations in the valley that people could give to. Chairman McQueeney stated that The Downstairs Girl written by Stacey Lee was selected for One Book One Valley which was an effort to bring people together. County Manager Updates Jeff Schroll recognized the Eagle County Road and Bridge crew and CDOT snow plow drivers for their work on the roads. He added that if there were any questions from the public with regards to the 2023 budget,he encouraged them to reach out to himself or anyone in the Finance Department. Consent Agenda 1. Resolution 2022-096 Approving Planning File LR-9274-2022 -Temporary Freedom Park Ice Rink David McWilliams, Community Development 1 12/06/2022 3. Resolution 2022-097 Approving a two-year extension of the special use permit for a boarding house for Warner Professional Building#2 Janet Aluise, Community Development 4. Oct 2022 Payment Report Jill Klosterman, Finance Commissioner Chandler-Henry moved to approve the Consent Agenda for December 06, 2022 as presented. Commissioner Scherr seconded the motion. The vote was declared unanimous. Business Item(s) 1. Resolution 2022-098 to Opt Out of Participating in the Family and Medical Insurance Program Hollis Dempsey,Human Resources Executive Summary: Colorado voters passed a Family Medical Leave Insurance Program which will provide employees job protected leave and 12 weeks of paid leave for a variety of circumstances. Benefits begin in 2024. Local governments may decline participation in the program and are required to hold a vote by the BoCC to determine participation or declination. Results of a vote and opt in/out will be provided to the state. Hollis Dempsey, Eagle County Human Resource Director,explained that the insurance program was administered by the state, and local governments had the opportunity to opt out of the program. After evaluating the program, staff agreed to decline participation in the program this year. Staff was open to evaluating the program in the future. Currently the county has a robust benefit program. Employees could contact the state for additional information on the program. Commissioner Scherr moved to approve the resolution opting out of participating in the Family and Medical Insurance Program. Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous. 2. Resolution 2022-099 Concerning Appointments to the Eagle Valley Transportation Authority Board Tanya Allen,ECO Transit Executive Summary: The BoCC is being asked to approve this resolution appointing its representatives to the newly formed Eagle Valley Transportation Authority's Board of Directors. Eagle County voters approved the creation of the Eagle Valley Transportation Authority at the November 8, 2022 election. According to the Intergovernmental Agreement establishing the Authority,Eagle County must appoint one Director and one Alternate to its voting seat on the new Board. Both appointees must be elected officials. The first meeting of the new RTA Board is expected to take place on December 16. Tanya Allen, Regional Transportation Director stated that the board included members from each jurisdiction. The resolution appointed Commissioner McQueeney as the county's primary representative and Commissioner Chandler-Henry as the alternate. There was a second item as well which was the signatures on the intergovernmental agreement establishing the board(Item 3.) 2 12/06/2022 Commissioner Chandler-Henry moved to approve the Resolution Concerning Appointments to the Eagle Valley Transportation Authority Board. Commissioner Scherr seconded the motion. The vote was unanimous. 3. Execution of Eagle Valley Transportation Authority Intergovernmental Agreement Tanya Allen, ECO Transit Executive Summary: Voters in 7 of 8 jurisdictions contemplating the formation of the Eagle Valley Transportation Authority approved the formation of the new Authority at the November 8,2022 election. Each jurisdiction approved its signature on the IGA prior to referring it to the ballot. We are now circulating a copy for execution by all jurisdictions that voted in via Docusign. Copies of each jurisdiction's approval resolution are attached. Commissioner Scherr moved to authorize the execution of Eagle Valley Transportation Authority Intergovernmental Agreement. Commissioner Chandler-Henry seconded the motion. The vote was unanimous. 4. Resolution 2022-100 Adoption of the 2023 Budget Jill Klosterman,Finance Executive Summary: Public meeting for the 2023 budget presentation is scheduled for November 29, 2022. Public notice will be completed on November 24, 2022 and again on December 1, 2022. Appropriations will be made in the December 6,2022 public meeting. Anna Earl,Finance Manager,presented the resolution. The resolution lists the total expenditures for each fund,totalling$203.7 million dollars and total revenues of$181 million dollars. Chairman McQueeney stated that the board met last week to review the proposed budget. There was an opportunity for the public to weigh in. She believed the budget reflected the county's priorities. Commissioner Scherr believed it was impressive to watch the process and see the final product. He believed the budget was very transparent. Commissioner Chandler-Henry added her thanks. Commissioner Chandler-Henry moved to approve the resolution adopting the 2023 Budget. Commissioner Scherr seconded the motion. The vote was declared unanimous. 5. Resolution 2022-101 to Certify Eagle County Government's 2023 Mill Levy Jill Klosterman,Finance Executive Summary: This resolution adopts Eagle County Government's 2023 Mill Levies. Anna Earl stated that 8.499 mills were being proposed for fiscal year 2023. Commissioner Scherr moved to approve the resolution certifying the Eagle County Government's 2021 Mill Levy. Commissioner Chandler-Henry seconded the motion. The vote was unanimous. 3 12/06/2022 Commissioner Chandler-Henry moved to adjourn as the Eagle County Board of County Commissioners and reconvene as the Eagle County Housing and Development Authority. Commissioner Scherr seconded the motion. The vote was unanimous. Eagle County Housing and Development Authority 1. Approval of the 2023 Eagle County Housing and Development Authority Budget Jill Klosteterman,Finance Executive Summary: Approval of the 2023 Eagle County Housing and Development Authority Budget. • In the county's annual comprehensive financial report, Eagle County Housing and Development Authority is consolidated with The Valley Home Store and Lake Creek Village,collectively referred to as ECHDA. We expect it to include Seniors on Broadway in 2023 due to the transfer of partnership interests to ECHDA which is scheduled to occur prior to 12/31/2022 This chart shows only the authority activity. The Valley Home Store is shown separately in this budget book. Lake Creek Village Apartments is no longer shown in this book as the property was sold in 2022 and a budget will no longer be prepared for that entity. • Charges for services include property management fees earned by managing housing properties for the property owners. • Miscellaneous revenue includes interest earned on loans made to other entities as well as bank and down payment assistance loans. Interest income has increased due to the investment of the proceeds from the sale of Lake Creek Village Apartments. • The interfund transfer in 2022 represents the proceeds from the sale of Lake Creek Village Apartments. • The implementation of the Bold Housing Moves are budgeted in ECHDA beginning in 2023. Commissioner Scherr moved to approve the 2023 Eagle County Housing and Development Authority Budget. Commissioner Chandler-Henry seconded the motion. The vote was unanimous. Commissioner Chandler-Henry moved to adjourn as the Eagle County Housing and Development Authority and reconvene as the Eagle County Airport Terminal Board. Commissioner Scherr seconded the motion. The vote was unanimous. Eagle County Airport Terminal (ECAT) Board 1. Approval of the 2023 Eagle County Air Terminal Corporation Budget Jill Klosterman, Finance Executive Summary: Approval of the 2023 Eagle County Air Terminal Corporation Budget Anna Earl presented the budget. Total expenditures were budgeted at$5.3 in 2023. Jeff Shroll moved to approve the 2023 Eagle County Air Terminal Corporation Budget. Commissioner Chandler-Henry seconded the motion. The vote was unanimous. 4 12/06/2022 Commissioner Scherr moved to adjourn as the Eagle County Airport Terminal Board and reconvene as the Eagle County Board of County Commissioners.
