HomeMy WebLinkAboutR90-110 spec ial use permit for Flatiron StructuresRESOLUTION OF THE COUNTY OF EAGLE,, STATE OF COLORADO RESOLUTION NO. 90 -- //6 APPROVAL OF SPECIAL USE PERMIT - Flatiron Structures FILE NO: ZS- 126 -89 -A4 WHEREAS, Eagle County did file an application with the Eagle County Department of Community Development on or about January 15, 1990 for an amendment to an existing Special Use Permit within the Resource Zone District; and WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County Department of Community Development, comments of public officials and agencies, the recommendation of the Eagle County Planning Commission, and comments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado, finds as follows: 1. That proper publication was provided as required by law for the hearing before the Planning Commission and the Board of County Commissioners. 2. The proposed Special Use Permit Amendment is compatible with the existing uses in the area. 3. The proposed Special Use Permit will not detrimentally effect the character of the neighborhood. 4. The Applicant has demonstrated the adequacy of the access to and from the proposed area. 5. The Applicant has demonstrated the adequacy of the water and sanitation service. 6. The physical arrangement of the use proposed is appropriate for the site. 7. The proposed Special Use Permit is consistent with Eagle County Master Plan. 8. An Environmental Impact Report is not applicable. 9. For the above stated and other reasons, the proposed Special Use Permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Eagle County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Eagle, State of Colorado: THAT the application of Flatiron Structures, File No: ZS -126- 89-A4, for approval of a special use permit amendment to increase the maximum allowable building heights of the recently approved storage and fabrication buildings from 16' to 281 and from 18' to 28' respectively within the Resource Zone District in the following described unincorporated area of Eagle County be approved: See attached Exhibit A for Legal Description. THAT the Board of County Commissioners directs the Department of Community Development to provide a copy of this resolution to the applicant.
