COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 90-_/Q
IN RE THE MATTER OF THE REQUEST FOR APPROVAL OF THE
PLANNED UNIT DEVELOPMENT SKETCH PLAN FOR
CORDILLERA, FILE NO. PD 293 -90S
WHEREAS, on or about May 1, 1990, the County of Eagle, State of
Colorado, accepted for filing an application submitted by Kensington
Land Investment Partners (hereinafter "Applicant ") for approval of the
Planned Unit Development Sketch Plan for Cordillera, in and above the
Squaw Creek Valley southwest of Edwards, Colorado (File No. PD -293-
90S); and
WHEREAS, the Applicant requested the approval of a Planned Unit
Development (PUD) Sketch Plan which would allow for the development
as follows:
There are four parcels included in this Sketch Plan
proposal. The Western Parcel is planned for two eighteen -
hole golf courses, a clubhouse, and 422 dwelling units.
The Southern Parcel, which contains two parcels, is
proposed for 74 single- family lots. These lots range in
size from one -half acre to ten acres. A Village Center,
with clustered small lot single - family homes, townhomes,
parks and walkways, centered on a European - village -style
plaza, is proposed on the Northern Parcel.

WHEREAS, at its public hearings held June 20 and July 18, 1990,
the Eagle and Colorado Valley Planning Commission, based upon its
findings, recommended approval of the proposed PUD Sketch Plan, with
certain conditions; and
WHEREAS, at its regular hearings of September 4, September 18,
September 24, and October 15, 1990, the Eagle County Board of
Commissioners (hereinafter "Board "), considered the PUD Sketch Plan,
associated plans, and the statements and concerns of the Applicant,

the Eagle County Community Development and Engineering staff, and
other interested persons.
BASED ON THE EVIDENCE BEFORE IT, and with the modifications
imposed by the conditions hereinafter described, THE BOARD FINDS AS
FOLLOWS:
1. The proposed Sketch Plan is in conformance with the Master
Plan; to the extent applicable, with the Edwards Sub -area Master Plan;
and with policies, guidelines, zoning and other applicable regula-
tions. Furthermore, the resulting development will not be inconsis-
tent with the Master Plan objectives. Specifically with regard to the
Master Plan, the Board further finds the development of this project
as proposed:
a. to have a full range of public services available.
b. to have a significant economic determinant to Squaw
Creek, the Edwards area, and to the County generally.
C. to have minimized any negative effects on the social
and natural environment.
d. to be capable of being phased in order to address
current and anticipated market conditions.
2. The land included in the proposed Sketch Plan is suitable ^d
for subdivision.

3. Comments and recommendations from the agencies listed in
Eagle County Land Use Regulations, Section 2.17.02(1), have been
considered.
4. The evidence shows that access which is capable of servic-
ing the development from the state highway system to the parcel of
land proposed for subdivision can be built by the Applicant.
5. The area around the development can be planned to be in
substantial harmony with the proposed PUD.
6. No adjacent and nearby communities will be detrimentally
affected by the proposed PUD.
7. The PUD can be completed within a reasonable period of
time, to be determined prior to final approval of the PUD.
8. The proposed commercial development within the proposed
PUD is justified.

9. The streets, as proposed, are adequate to support the
anticipated traffic, and the development will not overload the streets
outside the planned area.
10. Proposed utility and drainage facilities, upon their
conformance to the conditions set forth herein, are adequate for
population densities and the type of development proposed.
11. The employee housing plan is acceptable.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMIS-
SIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the application for approval of the Planned Unit Develop-
ment Sketch Plan for Cordillera be and is hereby granted, subject to
compliance with the following conditions:
1. An acceptable plan for phasing construction of infra -
structural and residential and commercial improvements shall be
established in order to further minimize impacts, and to address and
follow current and anticipated market conditions. A public golf
course contained within the project shall be operational prior to the
sale of individual lots.
2. At a minimum, one golf course within the project shall be
restricted to public access in perpetuity.
3. All development within the PUD shall be contained within
the Squaw Creek Valley. Specifically, the following will not be
approved:
a. ridge -top development.
b. development in the Lake Creek Valley.
C. development visible to the I -70 and Lake Creek
corridor.
4. With regard to utilities in the development:
a. All utilities shall be underground.
b. A centralized water and sewer system is required;
there shall be no septic systems.
C. Well water, if used at all, shall be limited to
domestic use.

d. All golf course watering shall be limited to historic
irrigation water, water from the Eagle River, or properly
processed affluent.
e. All utilities installed must be available to other
properties within Squaw Creek at a fair market tap fee or hook-
up charge.
f. A plan must be in place to address any adverse impacts
on water rights of neighboring parcels caused by this develop-
ment, to the extent a remedy is not otherwise available in water
court.
5. Water augmentation sources shall be in place prior to
construction of commercial (including, but not limited to, golf
courses) and residential improvements.
6. With regard to roads:
a. Off -site roads accessing the project must be completed
prior to further development of the project.
b. Roads within the project shall be completed as
proposed and subsequently approved in the phasing plan. These
roads must be approved, agreed to, and completed prior to
construction or ground breaking in each respective phase.

e. All rights -of -way shall be obtained prior to the
commencement of construction.

f. Access to Highway 6 shall be designed as required by
the State Highway access code and the Highway Department.
L' 7. All commercial and higher density development shall be
confined to the "tennis court" area of the previously approved
Cordillera, or to the golf course clubhouse area.
8. Careful consideration should be given, prior to preliminary
M plan, to the reduction of lot sizes, or increasing the number of
}j townhomes units and reducing single - family units, in order to provide
CL increased clustering. Limits shall be developed and implemented on
lawn size in order to mitigate water requirements and wildlife
14- impacts.

9. A plan for strict and monitored animal /pet control shall
be developed consistent with recommendations made to mitigate wildlife
impacts.
10. A plan for nordic skiing trails around the golf course
parameters shall be included.
11. Consistent with the Master Plan requirements, a plan for
new available housing to meet the needs of a range of employees, which
includes recreational and day -care facilities, shall be addressed.
12. A homeowners' association shall be established to monitor
the augmentation plan.
13. An architectural control committee shall be established to
strictly control types of construction, design, and quality.
14. The PUD guide shall prohibit woodburning fireplaces, except
in central lobby areas of commercial areas only.
15. A plan for continued monitoring and sensitivity to wildlife
mitigation, habitat and calving areas shall be established.
16. Access to the national forest shall be limited to eques-
trian or foot and /or bicycle traffic only. No motorized access shall
be provided.
17. The Beatty Tract shall be included within the PUD.
18. The Applicant shall be required to properly and timely
obtain a 1041 Permit.
19. Consideration shall be given to the necessity of emergency
secondary access to the Western Parcel.
20. A fire protection plan shall be established and reviewed
at the preliminary plan stage.
THAT, the Sketch Plan submitted under this application and hereby
approved, does not constitute a "site specific development plan" as
that phrase is defined and used in C.R.S. § 24 -68 -101, et seq. Sketch
Plan approval is expressly conditioned on the County's authority to
impose further restrictions or limitations on the PUD which are
necessitated by impacts which are not yet recognized or which are more
severe than realized under the review given at the hearings on the
Sketch Plan.

THE BOARD further finds, determines and declares that this
Resolution is necessary for the health, safety and welfare of the
inhabitants of the County of Eagle, State of Colorado.
MOVED, READ AND ADOPTED by the Board of County Commissioners of
the County of Eagle, State of Colorado, at its regular meeting held
