RESOLUTION NO. 90-3 3
VACATION OF PUBLIC RIGHTS -OF -WAY
EAGLE MEADOW
COUNTY OF EAGLE, STATE OF COLORADO
WHEREAS, pursuant to § 43 -2 -301, et sec., C.R.S., and § 2.22 of the Eagle County
Land Use Regulations, 1982, as amended, the Board of County Commissioners of the
County of Eagle, State of Colorado (hereinafter the 'Board "), has the power and authority
to vacate any public right -of -way or easement located entirely within the County of Eagle,
State of Colorado; and
WHEREAS, certain rights -of -way in the New York Mountain Project, (a portion of the
old Tenderwild Subdivision and /or the 7 Series), now known as Eagle Meadow, including
portions of West Lake Creek Drive, North View Lane, and Meadow Drive are bounded by
private property; and
WHEREAS, the County desires to abandon portions of the current rights -of -way
known as West Lake Creek Drive, North View Lane, and Meadow Drive as said rights-
_ of -way are no longer necessary due to the reconfiguration of the parcel; and

WHEREAS, notice of the public hearings before the Eagle County Planning
Commission and the Board to consider the proposed vacation of the subject public rights -
of -way was duly published in the Eagle Valley Enterprise, and all affected governmental
agencies, adjacent property owners and public and private utilities were notified of the
proposed vacation; and
WHEREAS, the Board grants the vacation of a portion of public rights -of -way on
West Lake Creek Drive, North View Land, and Meadow Drive, to those parties identified
on Exhibits "A" through "E ", attached hereto and made a part hereof by this reference.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMIS-
SIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board finds that the subject rights -of -way are located entirely within the
County of Eagle and are not within the limits of any city or town, and, further, that said
rights -of -way are no longer necessary as part of the County road system.

THAT, upon the recording of this Resolution and the attached Exhibits, the Board
hereby divests, relinquishes and vacates any and all rights it may have in the public rights -
of —way described in the attached Exhibits "A" through "E ".
THAT, aforesaid vacation of the rights —of —way described in Exhibits "A" through "E"
shall not be construed as affecting in any way whatsoever any and all existing recorded
easements necessary for utilities or other public services, or the remainder of said rights -
of —way not specifically vacated.
THAT, the Board finds, determines and declares that this Resolution is necessary
for the public health, safety and welfare of the citizens of the County of Eagle, State of
Colorado.
MOVED, READ AND ADOPTED by the Board of County Commissioners of the County
of Eagle, State of Colorado, at its regular meeting held the day of
September, 1990.

THIS SUPPLEMENTAL QUIT CLAIM DEED, made this day of
September, 1990, by and between the County of Eagle, State of Colorado referred to as the
"Grantor ", and Harry M. Muffly, James A. Henderson, James B. Dumm, Robert B. Melzer,
James R. Patterson, Esther R. Rettberg, Carolyn S. Stark; and Carrie S. Ellis and Alice T.
Muffly as Personal Representative of the Estate of the Harry Muffly, also known as Harry M.
