BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 90 -�
CONCERNING ENTERPRISE ZONE TAX INCENTIVES
FOR EAGLE GYPSUM PRODUCTS
WHEREAS, the incorporated township of Gypsum (Eagle County),
Colorado, is included in the Northwest Rural Enterprise Zone in
accordance with the Urban and Rural Enterprise Zone Act, Section
39 -30 -101, C.R.S., et se q. (hereinafter the "Act "); and
WHEREAS, Eagle Gypsum Products has established a new business
facility in the Northwest Rural Enterprise Zone for the manufacture
of wall board products and has requested that the Board of County
Commissioners of Eagle County, Colorado (hereinafter referred to
as the "Board "), grant a tax incentive relative to the taxable
property of Eagle Gypsum Products known as tax schedule number
0006436 (hereinafter "the property ") located in Gypsum (Eagle
County), Colorado, pursuant to Section 39 -30- 107.5, C.R.S.; and
WHEREAS, the Board finds that among the purposes of the Act
is the encouragement, development and expansion of opportunities
for employment in the private sector in this state; to provide
incentives for private enterprise to expand and for new businesses
to locate in economically needy areas; to provide more job
opportunities for residents of such area; and, to establish tax
incentives and other assistance in order to encourage private
enterprises to expand and locate in this state; and
WHEREAS, the Board finds that the Eagle Gypsum Products
manufacturing facilities located in Gypsum, Colorado, will be of
benefit to the citizens of Eagle County by providing new employment
opportunities, alleviating conditions of underemployment that now
exist in that portion of the County located in the enterprise zone,
and will add greater diversification to the Eagle County economy;
and
WHEREAS, the Board finds that the general welfare of the
residents of Eagle County will be promoted by granting a tax
incentive as hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:

THAT in 1991, the Board shall make an incentive payment to
Eagle Gypsum Products, Gypsum (Eagle County), Colorado, equal to
the difference between One Hundred Percent (100%) of the taxes paid
on the property for tax year 1990 and the tax liability for the
property for the base year.
THAT, the incentive payment granted hereby shall be limited
to and only include reimbursement of that portion of the property
taxes imposed and collected by the County exclusive of the taxes
levied by other governmental or quasi - governmental agencies and
municipalities.
THAT, the base year shall be the year preceding the year in
which the enterprise zone was established. The tax amount for that
year is $216.51.
THAT, upon timely and complete payment of all 1990 property
taxes payable in 1991 by Eagle Gypsum Products, the County
Commissioners shall, within 30 days after Eagle Gypsum Products has
submitted proof of full payment of said taxes, provide incentive
payment unto Eagle Gypsum Products in the aforesaid percentage of
benefit, excluding interest and penalties paid, if any.
THAT, the Board hereby finds, determines and declares that
this Resolution is necessary for the public health, safety and
welfare of the residents of the County of Eagle, State of Colorado.
MOVED, READ, AND ADOPTED by the Board of County Commissioners
of the County of Eagle, State of Colorado, at its regular meeting
held the day of September, 1990.
