BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 90—
RESOLUTION REGARDING WILDERNESS LEGISLATION
WHEREAS, in 1980, Congress designated eighteen wilderness study or further planning areas in
Colorado's Rocky Mountains so that the Forest Service could complete studies on which areas qualify
as wilderness; and
WHEREAS, those studies were completed in 1983 and 1984; and
WHEREAS, these study areas are best used as wilderness areas in order to preserve these
remaining examples of Colorado's wild lands; and
WHEREAS, wilderness designation for these areas has been stale —mated since 1983 over the
question of water rights; and
WHEREAS, these wilderness study areas are located high in the Rocky Mountains, upstream from
water projects for farms, industries and cities; and
WHEREAS, the protection of important streams in these high elevation wilderness study areas will
not injure the water projects that are downstream of these wilderness areas; and
WHEREAS, establishing nonconsumptive instream flows in these high elevation wilderness areas
will help ensure that clean water supplies are available for downstream water projects for farms,
industries and cities; and
WHEREAS, the Congress is not considering designation of any low elevation Bureau of Land
Management areas in Colorado as wilderness; and
WHEREAS, the County is opposed to any proposal which limits further the authority of local
government to regulate water projects pursuant to the County planning and building code authority;
the Colorado land use act; and County authority to regulate areas and activities of state interest; and
WHEREAS, the County desires to encourage Senator Armstrong and Senator Wirth to resolve the
issues and move forward with this important legislation to Colorado.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT we support the designation of additional lands in Colorado under the following principles,
which provide a fair balance between water resource development for economic development and
environmental protection:
1. The Congress should do nothing which impairs the ability of state and local government to
regulate areas and activities of state and local interest within their respective jurisdictions.

THAT we support the designation of additional lands in Colorado under the following principles,
which provide a fair balance between water resource development for economic development and
environmental protection:
1. The Congress should do nothing which impairs the ability of state and local government to
regulate areas and activities of state and local interest within their respective jurisdictions.
2. The Congress should adopt wilderness legislation that separately addresses wilderness in
headwater areas;
3. The Congress should ensure that this legislation will not affect past wilderness designations
or any lawsuits that have been filed to interpret those past designations;
4. For these new wilderness areas, the Congress should expressly reserve water rights to
protect the wilderness areas. The wilderness legislation should direct the Forest Service to quantify
said reserve water rights in state water courts, allowing the Forest Service to obtain a junior priority
date;
5. The Congressional wilderness legislation should protect Colorado's water rights under
interstate compacts;
6. The wilderness legislation should also address the question of wilderness water rights in
the existing North Platte Wilderness area, and should craft a solution that does not preempt
Colorado water law or impair Colorado's rights under Supreme Court decrees; and
BE IT FURTHER RESOLVED:
That a copy of this resolution shall be sent to members of the Colorado Congressional delegation.
