On December 3, 1987, in Case No. 87CW185, the Water Referee for Water Division No. 5 awarded to Pelican Spring Nos. 1 and 2, conditional water rights of 0.013 c.f.s. each, to be used for domestic and commercial purposes, with Appropriation dates of July 9, 1987. The Claimant was directed to file an Application for Finding of Reasonable Diligence in the development of these conditional water rights in December of 1991 to maintain said conditional water rights in full force and effect. This Ruling of Referee was confirmed and made a Decree of the Court on December 319 1987. 7. On November 21, 1991, the Applicant filed in Water Court for Water Division No. 5 an Application to Make Absolute a Conditional Water Rights in which it is requested that the 0.013 c.f.s. previously awarded conditionally to each of Pelican Spring Nos. 1 and 2 in Case No. 87CW185 be made absolute and unconditional by reason of completion of the appropriations. In support of this request, Applicant states that he has piped the spring water to a 300 gallon storage tank and utilized the water for said decreed purposes. 8. Box 409 Eagle, CO 81631 Attn: Mr. Jim Kunkel Gentlemen: As requested, a representative of Chen & Associates, Inc. met with you at the subject site on July 23, 1987 to evaluate the soils exposed in two hand dui pits at the subject site for foun- dation design of the building. Our findings: Proposed Construction: The ski but will be located east of Fulford along the 10th Mountain Trail. The building will be two stories of wood frame construction with ground floors constructed over crawl space. The building will be founded on continuous spread footings stepping down the hillside and placed about 5 feet below the existing ground surface. We understand prelimi- nary design of the structure indicates relatively light founda- tion loadings on the order of 1200 psf. We assume the building will be located in the area of the hand dug pits. If foundation loadings, building location or conditions are significantly different than those described, we should be con- tacted to reevaluate the recommendations presented in this report. Site Conditions: The site is located in the East Brush Creek drainage east of Fulford in Section 23, Range 82 1/2 West, Township 6 South, near Polar Star Lake, in Eagle County, Colo- rado. Elevation of the site is about 10,000 feet. The terrain is a westerly sloping hillside with a moderate grade, estimated about, 25%. Total elevation difference across the building is on the order of 12 feet. The site is vegetated with grass and weeds and is near the edge of tk.ick evergreen forest. No bedrock out- crops were observed at the site. We understand several springs are located in the area. Johnson Kunkel Associates August 7, 1987 Page 3 Wetting of the bearing foils could cause some settlement or heave of the foundations. To reduce the risk of wetting of the bearing soils and crawl space grade, good surface drainage should be provided. The final surface grading adjacent foundation walls should have a positive slope away from the walls for a distance of at least 10 feet. This may require a swale at the uphill side. Limitations: This report has been prepared in accordance with generally accepted soil and foundation engineering practices in this area for use by the client for design purposes. The con- clusions and recommendations submitted in this report are based upon the data obtained from the hand dug pits excavated at the locations discussed in the report,and the proposed type of con- struction. The nature and extent of subsurface variations across the site or below the depths observed in the pits may not become evident until excavation is performed. Drilling or backhoe pit investigation would be required to evaluate the soils within the loaded depth of foundation influence. If during construction, fill, soil, rock or water conditions appear to be different from those described herein, this office should be advised at once so reevaluation of the recommendations may be made.
