HomeMy WebLinkAboutR90-064 Creating Bellyache Ridge LID No. 90-1U� o� J W � U- ¢ 0a� 0 C U a N U ] U �0 mLl m nw J LU u� ;n m� f � CL r•� 2 Li. wLl r Commissioner moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 90--Z,2� CREATING THE BELLYACHE RIDGE LOCAL IMPROVEMENTS DISTRICT NO. 90-1, WITHIN THE COUNTY; ORDERING THE CONSTRUCTION AND INSTALLATION THEREIN OF CERTAIN STREET IMPROVEMENTS; PROVIDING FOR THE ISSUANCE OF BONDS IN PAYMENT FOR SAID IMPROVEMENTS; AND PROVIDING FOR OTHER DETAILS IN CONNECTION WITH THE DISTRICT. � W1 WHEREAS, the Board of County Commissioners of Eagle County, Colorado, pursuant to Section 30-20 -601, et sec., C.R.S., as amended, and all other laws of the State of Colorado, hereby finds and determines that there exists a necessity for the creation of a local improvements district within Eagle County (to be designated as the Bellyache Ridge Local Improvements District No. 90-1) and the construction and installation therein of certain improvements; and WHEREAS, notice of a public hearing concerning the creation of the District and the construction and the installation of the improvements therein has been given by publication in one issue of the Eaale Valley Enterprise, a newspaper of general circulation in the County, not less than thirty, (30) days prior to the date of hearing; and in addition, notice was delivered or mailed by first- -class mail to each property owner to be assessed for the cost of improvements and included within the proposed district not less than ten (10) days prior to the hearing; and WHEREAS, at the time and place set forth in the notice, the Board of County Commissioners met in open session for the purpose of hearing any objections or protests that might be made against the proposed district or the improvements to be constructed or installed; and WHEREAS, the Board of County Commissioners considered all protests, and objections to the creation of the District; and WHEREAS, all objections and complaints having been duly heard and considered, the Board of County Commissioners has determined that such objections should be denied; and WHEREAS, the Board has determined that each parcel in the improvements district will benefit equally from the improvements to be installed and therefore each parcel shall be assessed equal costs, as more specifically described in Resolution 90 -56. BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF EAGLE COUNTY, STATE OF COLORADO: Section 1. Denial of Protests and Objections. The protests and objections to the creation of the District are hereby denied. to 0 0 N 0 CL r�7 Li m m 0 m i ri u� rah GS r� _3 f Section 2. Creation of the District. A local improvements district for the construction and installation of certain street improvements, together with any necessary incidental work as hereinafter described, is hereby created and established in accordance with Section 30 -20- 601, et seq., C.R.S., as amended, all other laws of the State of Colorado there unto enabling, and shall be known and designated as the "Bellyache Ridge Local Improvements District No. 90-01" (the "District "). All proceedings heretofore taken and adopted in connection with the District are hereby ratified, approved and confirmed. The proposal to create said District was properly initiated by the Board of County Commissioners by an order adopted as part of Resolution 90 -53 dated May 7, 1990, and by Resolution 90 -56 dated May 14, 1990. Section 3. Approval of Engineering Plans. The engineer's reports together with all of the details, specifications, estimates, maps, and - schedules thereto attached or appended, are hereby approved and adopted. Section 4. Boundary of District. The extent of the District to be assessed for the cost of the improvements and the area to be included within the boundary of the District shall be as follows: a. Lots within the Bellyache Ridge Subdivision Filing #1 and Filing #2 as described on plats filed in the Eagle County Clerk and Recorder's Office at Book 226, Page 959; Book 231, Page 882; Book 325, Page 414; Book 281, Page 228; Book 341, Page 502; Book 419, Page 141; Book 528, Page 720, and Book 383, Page 063. Said parcels described in this subsection (a) to be referred to hereinafter as the "Bellyache Ridge lots ". b. Lots within the Bellyache II Subdivision as described on plats filed in the Eagle County Clerk and Recorder's Office at Book 371, Page 940. Said parcels described in this subsection (b) to be referred to hereinafter as the "Bellyache II parcels ". c. Those certain tracts of land described in Exhibit A in the document recorded in the Eagle County Clerk and Recorder's Office at Book 509, Page 999, as Tracts 1, 2, 3, 4, 7, 8, 17, 20, 21, and 22, and Parcels A, B, and C. Also, that certain parcel described in Exhibit 2, attached hereto and by this reference made a part hereof, as Parcel D. Said parcels described in this subsection (c) to be referred to hereinafter as the "Hall parcels ". d. Those certain tracts of land described in the document recorded in the Eagle County Clerk and Recorder's Office as follows: at Book 520, Page 586 as Tract 9; at Book 520, Page 587 as Tract 10; at Book 520, Page 588 as Tract 11; at Book 520, Page 589 as Tract 12; at Book 520, Page 590 as Tract 13; at Book 520, Page 591 as Tract 14; at Book 520, Page 592 as Tract 15; and at Book 520, Page 593 as Tract 16. Said parcels described in this subsection (d) to be referred to hereinafter as the "Wyatt parcels ". e. That certain parcel described in Exhibit 1, attached hereto and by this reference incorporated herein. Said parcel described in this subsection (e) to be referred to hereinafter as the "Jouflas parcel ". -2- U- 0 ru a r•� v m m r T3 M E i M q 4 Section 5. Description of the Improvements. Improvements proposed include the following: Survey, design, shape subgrade, place additional gravel, widen cattle guard and place prime and double chip seal pavement surface on Bellyache Ridge Road ( #35) from 1 -70 to and through the Bellyache Ridge Subdivision Filings 1 and 2, on Big Dipper Road ( #BY35A) and Little Dipper Road ( #BY35B), a distance approximately 6.2 miles. The pavement consists of an asphalt prime coat, an application of liquid asphalt, and 3/4 inch stone chips and a second application of liquid asphalt and 3/8 inch stone chips for a total thickness of 1 inch. Section 6. Improvements Authorized. The construction and installations of the improvements in and for the District, as shown by the plans, specifications, and maps thereof, prepared by the Engineer and approved by the Board of County Commissioners of Eagle County, now on file in the office of the County Clerk, is hereby authorized and ordered, the materials to be used in the construction of said improvements to be in accordance with such maps, plans and specifications. Section 7. Cost of Improvements. The probable cost of the improvements is estimated to be Two Hundred Twenty Five Thousand Dollars ($225,000). The costs of the improvements shall be assessed on an equal basis against the property in the district as follows: a. Bellyache Ridge parcels: 1 share per approved residential unit which may be constructed on any lot at the time the improvements are authorized. b. Bellyache II parcels, Wyatt parcels, Hall parcels: 1 share per legally described parcel, tract, or lot. c. Jouflas parcel: 6 shares per the parcel. The amount to be assessed per share is estimated to be One Thousand Seven Hundred Forty —Four Dollars and Nineteen Cents ($1,744.19), excluding financing charges and interest. Property owners are specifically referred to the schedule of proposed assessments on file in the office of the County Clerk from which the approximate amount to be assessed against any particular lot or parcel of property may be determined, and attached hereto and incorporated herein as Exhibit 3. Section 8. Payment of Assessments. The assessment to be levied for the improvements shall be due and payable without demand within thirty (30) days after the effective date of the resolution assessing the whole cost of said improvements against the real property. If any property owner shall fail to pay the whole cost of such assessment against his property within thirty (30) days, then the assessment against the property shall be payable in not more than ten (10) annual installments of principal with interest on the unpaid installments at such rate as shall later be determined by the Board of County Commissioners and set forth in the assessing resolution, but not to exceed fourteen percent (1410). The first of said installments of assessment shall be due and payable at such time as will be indicated in the assessing resolution, and the remainder of the annual installments of assessment and payments of interest shall be due and payable successively on the same days in each year thereafter until all are paid in full. —3— 9 428112 B -531 r-'-- 954`- �71G,/19»0 16:31 PG 4 or ... } Section 9. Local Improvements Bonds. By virtue of and pursuant to the laws of the State of Colorado, local improvements notes of the County shall be issued for the purpose of paying for the local improvements described in this Resolution, in an amount not to exceed the cost and expenses of said improvements, including engineering, legal and incidental expenses, and capitalized interest, as provided by law. The notes shall be issued based upon estimates approved by the Board of County Commissioners, and as authorized by a Resolution to be passed by the Board at a later date. The maximum net effect interest rate of the local improvements notes for the Bellyache Ridge Local Improvements District No. 90 -01 shall not exceed 14% per annum. The notes and the interest thereon shall be payable only out of special assessments to be levied against the real property included within the District and specially benefitted by the improvements'to be constructed and installed, and shall not be general chligations of the County. S: -ction 10. Determination of Special Benefits The Board of County Commissioners hereby finds and determines that the improvements proposed to be constructed and installed will confer special benefits upon the property within the District in amounts not less than the amounts of the assessments. Section 11. Repealer. All Resolutions, or parts thereof, in conflict herewith are hereby repealed. Section 12. Recording. This resolution, immediately upon its passage, shall be recorded in the Book of Resolutions of the County kept for that purpose. Section 13. Safety Clause. The Board of County Commissioners takes the actions herein described as they are necessary for the health, safety, and welfare for the citizens of Eagle County.
