HomeMy WebLinkAboutR90-055 vacation of road through Malpais Mobile Home ParkCommissioner cc, moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE -OF COLORADO RESOLUTION NO. 90- Z-�5' REGARDING THE MALPAIS MOBILE HOME PARK, THE VACATION OF A ROAD THERE THROUGH, AND THE COMPLETION OF CERTAIN SUBDIVISION IMPROVEMENTS WHEREAS, on or about May 24, 1979, Eagle County issued a Special Use Permit pursuant the Eagle County Land Use Regulations, allowing the operation of Malpais Mobile Home Park in that part of unincorporated Eagle County known as Dotsero and on that parcel more specifically described in Exhibit A, attached hereto and by this reference incorporated herein; and WHEREAS, as a condition of the approval of the Special Use Permit, the Board of County Commissioners (the Board) required certain improvements and restrictions as a condition of said approval. Said conditions are as memorialized in the Improvements Agreement recorded in the Office of the Eagle County Clerk and Recorder at Book 286, Page 978.; and WHEREAS, on or about July 2, 1979, the Board at its regular meeting considered a request to the vacation of that certain county road easement and release of that certain reservation of space for the stockpiling of cinders, both as described in the Office of the Eagle County Clerk and Recorder at Book 165, Page 503; and WHEREAS, the Board required requested documentation acknowledging that Eagle Valley Telephone Company had no interest in the easement; and WHEREAS, the quitclaim deed dated July 17, 1979 and recorded in the office of the Eagle County Clerk and Recorder at Book 289, Page 197 satisfied said request; and WHEREAS, the Board issued a quitclaim deed dated July 2, 1979 and recorded in the Office of the Eagle County Clerk and Recorder at Book 289, Page 619 effectively vacating said road easement and releasing said reservation; and WHEREAS, no record can be found of any interest the County now has or formerly had in that certain strip of land labeled "Abandoned Highway" on the boundary survey recorded in the office of the Eagle County Clerk and Recorder at Book 287, Page 618. NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: 3 1. That the certain road easement and that certain reservation of space for the stock pile of cinders, as described in the Special Warranty Deed described in the Office of the Eagle County Clerk'and Recorder at Book 165, Page 503, has been vacated and released. 2. That the required improvements required under the special use permit for Malpais Mobile Home Park were installed. Those conditions that driveways be maintained in a rut free and dust -free condition, that dogs are prohibited in the Park, and that minimum state standards for water quality be met, are still in affect. 3. That Eagle County claims no right, title or interest in that strip of land labeled "Abandoned Highway" on the boundary survey recorded in the office of the Eagle County Clerk and Recorder at Book 287, Page 618. MOVED, READ AND ADOPTED by the Board of County Commissioners of the County of Eagle, State of Colorado, at its regular meeting held the 14th day of May, 1990.
