BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 90-
INITIATING THE CREATION OF THE
BELLYACHE RIDGE LOCAL IMPROVEMENTS DISTRICT
WHEREAS, the Bellyache Ridge Homeowners Association has proposed that certain
improvements be made to County Roads No. 35, BY35A and BY35B, commonly referred to
as the Bellyache Ridge Road, Big Dipper Road and Little Dipper Road respectively; and
WHEREAS, the Board of County Commissioners (the Board) hereby determines that
it is necessary to create a local improvement district and to construct certain street
improvements therein, within an unincorporated area within Eagle County, all as hereinafter
described in this resolution; and
WHEREAS, Pursuant §30 -20 -601 et seg. C.R.S., the Board desires to initiate the
creation of such a local improvements district by resolution; and
WHEREAS, pursuant §30- 20- 603(2)(b) notice of the Board's public hearing to consider
initiating the creation of a local improvements district in order to construct said improvements
to County Roads No. 35, BY35A and BY35B, was mailed in a timely fashion to all property
owners served by said road; and
WHEREAS, the Board of County Commissioners shall consider all protests and
objections that may be made in connection with proposed improvements, before ordering the
construction thereof; and
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
1. That the Board hereby initiates the creation of a local improvements district to
be known as the Bellyache Ridge Local Improvements District for the construction and
installation of improvements to County Roads No. 35, BY35A and BY35B.
2. That the County Attorney is directed to prepare a preliminary order for the
creation of the local improvement district, consistent with the directions given at the Board's
hearing held this 7th day of May, 1990.
3. That this Resolution, immediately upon its passage, shall be recorded in the
Book of Resolutions of the County kept for that purpose and shall be authenticated by the
signatures of the Board of County Commissioners and the County Clerk and Recorder.
4. That the Board shall consider the adoption of said preliminary order on May
14, 1990 at 1:30 P.M.
MOVED, READ AND ADOPTED by the Board of County Commissioners of
the County of Eagle, State of Colorado, at its regular meeting held the 7th day of May,
1990.
