HomeMy WebLinkAboutR90-042 Richard Cooper Special Permit • • Commissioner u / Tt3c-cor1/ moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 90- �C Z RESOLUTION GRANTING A SPECIAL PERMIT FOR TEMPORARY HOUSING FOR RICHARD COOPER, CHAMBERS RANCH SUBDIVISION, FILE NO T -12 -90 WHEREAS, the Board of County Commissioners of the County of Eagle, State of Colorado (hereinafter the "Board "), is authorized to grant temporary housing permits, pursuant to Chapter II, Section 2.07.09 of the Eagle County Land Use Regulations; and WHEREAS, Richard Cooper (hereinafter the "Applicant "), applied to the Eagle County Department of Community Development for a temporary housing permit on February 15, 1990, within the Planned Unit Development Zone District; and WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County Department of Community Development, comments of public officials and agencies, the recommendation of the Eagle County Planning Commission, and comments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado, finds as follows: 1. That ro er publication and public notice was provided as P P P P P required by the law for the hearing before the Planning Commission and the Board of County Commissioners. 2. That the proposed use of the temporary housing permit conforms to the requirements of Section 2.07.09 of the Eagle County Land Use Regulations. 3. That the proposed land use will be compatible with existing uses in the area. 4. That for the above - stated and other reasons, the proposed zoning is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Eagle County. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: 4 • THAT, the Board hereby approves a special permit for temporary housing for Richard Cooper, provided the following conditions are met: 1. The temporary housing permit shall expire six (6) months from the date of this Resolution. 2. Not more than one temporary housing unit shall be located on the construction site and inhabitants on that site shall be owners of the lot or construction employees. 3. Certificates of Occupancy for the construction project shall be withheld until the temporary housing unit is removed and the site is restored to the satisfaction of the Eagle County Building, Health and Planning Officials. THAT, should Applicant not comply with any or all of the conditions, the temporary housing permit shall be revoked. THAT, the Board finds, determines, and declares that this Resolution is necessary for the public health, safety and welfare of the residents of the County of Eagle, State of Colorado.
