RESOLUTION
OF THE
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 90- 34
APPROVAL OF SPECIAL USE PERMIT AMENDMENT- Rocky Mountain Airways
FILE NO: - ZS- 42 -89 -A
WHEREAS, Rocky Mountain Airways (dba Continental Express)
did file an application with the Eagle County Department of
Community Development on or about November 15, 1989, within the
Resource Zone District; and
WHEREAS, based on the evidence, testimony, exhibits,
study of the Master Plan for the unincorporated areas of Eagle
County, comments of the Eagle County Department of Community
Development, comments of public officials and agencies, the
recommendation of the Eagle County Planning Commission, and
comments from all interested parties, the Board of County
Commissioners of the County of Eagle, State of Colorado, finds as
follows:
1. That the proposed use is compatible with existing
uses in the area.
2. That the proposed use would not negatively affect
the character of the neighborhood.
3. That the area has adequate access .
4. That the property has adequate water and sanitation
services.
5. That the physical arrangement of the proposed use is
appropriate.
6. That the proposed use is compatible with the Eagle
County Master Plan.
7. That an Environmental Impact Report is not required.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of the County of Eagle, State of Colorado:
That the application of Rocky Mountain Airways (dba
Continental Express), File No. ZS- 42 -89 -A, for approval of an
amendment to the special use permit of an Airport within the
Resource Zone District in the following described unincorporated

area of Eagle County be approved:
A parcel of land located within the County of Eagle, State
of Colorado lying within Section 7, Tp. 5 S., R. 81 West,
and Section 12, Tp. 5 S., R. 82 W. of the 6th P.M., more
specifically described as follows
Beginning at the Southeast corner of Lot 22, of Benchmark
at Beaver Creek Subdivision, Eagle County, Colorado;
thence N. 18 degrees 59'40" E. along the East line of Lot
22 a distance of 996.00 feet to the North right -of -way
line of Beaver Creek Blvd.; thence S. 54 degrees 22'45" E.
a distance of 1435.00 feet; thence S. 24 degrees 29'20" W
a distance of 300.00 feet; thence S. 65 degrees 30'40" E.
a distance of 4223.00 feet; thence S. 24 degrees 29'20" W.
a distance of 380 feet more or less to the North
right -of -way line of the Denver and Rio Grande Western
Railroad; thence Westerly along the North right -of -way
line of the Denver and Rio Grande Western Railroad to the
Point of Beginning.
THAT, the following conditions shall be placed upon this
approval and that violation of any condition shall be the basis
for revocation of the permit:
1. The permit shall be extended until July 17, 1990.
If operations have not commenced by that date, the
special use permit shall become null and void and no
operations shall be conducted hereunder.
2. All conditions of the special use permit shall
remain in full force and effect.
THAT, the Board of County Commissioners directs the
Department of Community Development to provide a copy of this
Resolution to the applicant.
THAT, the Board of County Commissioners finds,
determines and declares that this Resolution is necessary for the
public health, safety and welfare of the citizens of the County
of Eagle, State of Colorado.
