BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 90- 01 7
IN RE THE MA I ER OF THE ESTABLISHMENT OF PLANNING COMMISSIONS
FOR THE COUNTY OF EAGLE, STATE OF COLORADO
WHEREAS, the Board of County Commissioners of the County of Eagle, State of
Colorado (hereinafter the "Board"), is authorized, pursuant to State enabling legislation
including but not limited to §§ 30 -28 -101, et seq., C.R.S., to establish a planning commission
to carry out such planning and zoning functions as are authorized by applicable statutes and
regulations; and
WHEREAS, the Board desires to establish separate Planning Commissions to serve
certain geographic areas of the County; and
WHEREAS, the Board desires to create the Eagle and Colorado Valley Planning
Commission to consider and make recommendations on those certain matters as may come
before it; and
WHEREAS, the Board desires to create the Roaring Fork Valley Planning Commission
to consider and make recommendations on those certain matters as may come before it; and
WHEREAS, the Board, having reviewed all of the evidence, testimony, statements and
exhibits submitted, hereby determines that the creation of the planning commissions described
herein is necessary and proper for the protection of the public health, safety, welfare, morals,
and best interests of the citizens and residents of the County of Eagle, State of Colorado.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Roaring Fork Valley Planning Commission shall be and hereby is created
to perform all the duties and functions required of a planning commission under the Eagle
County Land Use Regulations or state law, and other such matters as may be required or
assigned to it from time to time. Said commission shall perform such duties and functions
for that part of the County of Eagle which lies within the boundaries of the Roaring Fork
School District, No. Re -1, as said boundaries are described within Exhibit A, attached hereto
and incorporated herein by this reference.

THAT, the Eagle and Colorado Valley Planning Commission shall be and hereby is
created to perform all the duties and functions required of a planning commission under the
Eagle County Land Use Regulations or state law, and other such matters as may be required
or assigned to it from time to time. Said commission shall perform such duties and functions
for all parts of the County of Eagle which are not assigned to the Roaring Fork Valley
Planning Commission.
THAT, all applications submitted to the County for review and consideration under
the Eagle County Land Use Regulations after March 1, 1990, shall be referred to the
appropriate planning commission as herein assigned.
THAT, all applications submitted to the County for review and consideration under
the Eagle County Land Use Regulations on or before March 1, 1990, shall be considered by
the Eagle and Colorado Valley Planning Commission.
THAT, the Roaring Fork Valley Planning Commission shall hold regular public
meetings on the first and third Thursdays of each month.
THAT, the Eagle and Colorado Valley Planning Commission shall hold regular public
meetings on the first and third Wednesdays of each month.
THAT, said planning commissions may convene at such other times as may be directed
by the Board of County Commissioners. Furthermore, said planning commissions may adjourn
and reconvene as each may deem appropriate.
THAT, should any section, clause, provision, sentence or word of this Resolution be
declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the
validity of this Resolution as a whole, or any parts thereof, other than the part so declared to
be invalid.
THAT the provisions of this Resolution are necessary for the health, safety and welfare
of the citizens and residents of the County of Eagle, State of Colorado.

All that portion of Eagle County within the Frying Pan River
and Roaring Fork River water sheds including the Town of Basalt,
Colorado, and described as follows:
Commencing at the South quarter corner (S Section 34, .
TWP 6 S., R. 87 W. of the 6th P. M. ; thence Easterly
along the Township lines extending to the Southeast
ner of Section 31, '1WP 6 S., R. 84 W. of the 6th P. 14.;
thence Southerly along Section line approximately three
(3) miles to a point in unsurveyed TWP 7 S•, R. 85 Ws of
the 6th P. 11.; thence due East approximately fifteen (15)
miles; thence due South approximately five and one - fourth
(54) miles to a point on the Eagle County- Pitkin County
line; thence West on the Eagle County- Pitkin County line
to its intersection with the Garfield County line; thence
North on the Eagle County - Garfield County line to the line •
between Sections 9 and 16, 'JWP 7 S:, R. 87 W. of the 6th
P. M.; thence East on the Section line to the South quarter
corner (S,'-,) of Section 10, TWP 7 S., R. 87 1'J. of the 6th
P. Iii. ; thence North to the South quarter corner (S,-,) of
Section 34, TWP 6 S., R. 87 W. of the 6th P. 11., the place
of beginning;
• All that portion of Eagle County, Colorado described as follows:
Beginning on the county line between Eagle and Garfield
Counties about the middle point of Section 3y, TWP 6 S.,
R. 87 W., and running South about two and one -half .(2Z)
miles to Section line between Sections 9 and 16, TWP 7 S.,
R. 87 W. of the 6th P. 14.; thence East about one (1) mile;
thence North about two and one -half (22) miles to middle
of Section 34, TUP 6 S., R. 87 W. of the 6th P. 14.; thence
West about one (1) mile to the place of beginning;
Geographic Area under the Roaring Fork Valley Planning Commission,
Eagle County, Colorado.
