Dear Nathan,
As per our phone conversation last night, I have gone over
the as-builts for the sewer system I installed at your facility. I
recall you requesting me to install the best system possible and
to incorporate the latest and most technically advanced materials
possible.
Nathan, this request was fulfilled and therefore, I feel that
the large 1200 gallon (two compartment) tank and the double run
infiltrator leaching system over screened rock,. .gives you far in
excess the present needs you now have and it should also easily
handle most future add-ons.
Please find enclosed, the complete as-builts and information
on the leaching material used. All materials were purchased from
Kemp & Company, along with his personal input and recomendations.
This letter should stand as a conformation of the excellent
sewer system you now have. I will also be glad to meet with you or
talk to anyone at the county.

I'm writing in regard to your building permit applications which
you submitted for permission to hook up a mobile home, (#5425),
and to construct an apartment above your equestrian facility,
(#5596). These permits been brought to my attention as part of
the building permit routing process to evaluate the adequacy of
the individual sewage disposal system (ISDS #1077) which exists
on site.
I feel a brief history would help explain the dilemma with which
we are currently faced. The original design of the system was
engineered by Chris Williams, Johnson, Kunkel & Associates, Inc.
The system design assumed estimated wastewater flows of 488
gallons per day. This flow was determined by the number of
fixtures in the equestrian facility, the number of employees
expected to use these fixtures, then adding the flow from the
proposed apartment. The existing system was sized and installed
according to these specifications with the final inspection
performed on August 30, 1991.
On July 24, 1992, you submitted building permit application,
#5425, for a mobile home hook up. It was communicated to you in
a letter from Roger Boyd of my staff dated August 5, 1992, that
the existing system was not appropriately sized for the addition
of a three bedroom mobile home. The building permit application
was placed on hold, but the mobile home was hooked up and
connected to the septic system without permission. A description
of the system, including the mobile home connection was described
to you in a letter from L.S. Ruder, S. Ruder Excavating Company,
a copy of which was received by our office on December 2, 1992.
Failure to obtain a permit for this connection constitutes a
violation of the Eagle County Land Use Regulations, Chapter 4,
Section 4.03.29.

Furthermore, in Mr. Ruder's letter, he describes the system which
he installed as a 1200 gallon septic tank with a double run of
infiltrator leaching system over screened rock. The Infiltrator
technology is a chambered system which is granted a reduction in
size due to the absence of rock. Placing the chambers on rock
defeats the purpose for which a reduction in size is granted,
therefore, the system is technically undersized for the use which
currently exists.
On December 3, 1992, an application was submitted, #5596, to
construct the apartment in the equestrian building. Based on the
above information, we are not inclined to grant approval for the
construction of this dwelling unit without necessary corrections
made to the septic system. Due to the limited area for septic
improvements, it is unlikely that the septic system can be
brought into compliance with Eagle County Regulations.
It is my understanding that it is your desire to connect to the
sewer line which is being extended to serve the western parcel of
Cordillera's Planned Unit Development. Since there is currently
no evidence that your existing septic system has failed, we will
allow the continued use of the system until the public sewer line
is available. Should the system fail prior to the availability
of the sewer line, appropriate actions must be taken to resolve
the failure.
Another option is to remove the mobile home in order to allow for
the construction of the caretaker unit. The septic system cannot
accommodate the effluent from both units.
Once the sewer line is available, you
as originally proposed. If you have
decision, don't hesitate calling.

Building Permit #5425
On July 24, 1992 the Building Division accepted an application
for a mobile home hook up at the Ruby Ridge Ranch. During the
routing process, my Division placed a hold on the permit due to
the inability of the existing septic system to accommodate
additional flows from the three bedroom mobile home proposed (see
attached letter from Roger Boyd to Nathan Finkel, dated August 5,
1992).
Apparently, the mobile home has been connected to the existing
system without permission. This illegal hook-up constitutes a
violation of Chapter IV of our Land Use Regulations, Sections
4.03.03; 4.03.07; 4.03.28, 5); as well as 4.03.29, 1). The
latter violation constitutes a Class I Petty Offense as defined
in Section 18-1-107, C. R. S. 1973, as amended, and carries with
it a maximum fine of $500.00 and/or six months in jail.
This memorandum is being sent to you via

The Environmental Health Division has reviewed your building
permit application and determined that the septic system is not
currently sized for the addition of a three bedroom trailer.
Based on the engineer's design, a single bedroom dwelling could
be added to the existing system. Regulations require that we
permit the structure and not the intend use. If we permitted a
three bedroom trailer as a one bedroom, there is no way to ensure
this use would not change. One solution would be to modify the
trailer into a one bedroom dwelling. If you have any questions,
please do not hesitate to call this office.
