Home My WebLink AboutR90-016 Anderson Dental Clinic Special Use Permit Approval RESOLUTION OF THE COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 90- A APPROVAL OF SPECIAL USE PERMIT - Anderson Dental Clinic FILE NO: - ZS- 288 -89 WHEREAS, Robert Anderson did file an application with the Eagle County Department of Community Development on or about November 1, 1989, within the Commercial General Zone District; and WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County Department of Community Development, comments of public officials and agencies, the recommendation of the Eagle County Planning Commission, and comments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado, finds as follows: 1. That proper publication and public notice was provided as required by law for the hearing before the Planning Commission and the Board of County Commissioners. 2. That the proposed special use conforms to the requirements of Section 2.09 of the Eagle County Land Use Regulations. 3. That the proposed land use will be compatible with existing uses in the area. 4. That for the above - stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Eagle County. • NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Eagle, State of Colorado: THAT the application of Robert Anderson, File No: ZS- 288 -89, for approval of a special use of a Dental Clinic within the Commercial General Zone District in the following described unincorporated area of Eagle County be approved: LEGAL DESCRIPTION A parcel of land located in Tract 39 of Section 3, Township 8 South, Range 87 West of the Sixth Principal Meridian, Eagle County, Colorado according to the Independent Resurvey of said Township and Range as approved on October 7, 1927; said parcel being more particularly described as follows: Beginning at a point on the Westerly Right -of -Way Boundary of Eagle County Road S -13 from which a brass cap monument, found in place and properly marked, for the Southeast Corner of Section 34, Township 7 South, Range 87 West of the Sixth Principal Meridian bears N.87 35'58" E. 1221.46 feet distant; thence departing said Westerly Right -of -Way S.00 54'01 "W. 150.00 feet; thence departing said Westerly Right -of -Way S.89 05'59 "E. 170.00 feet; thence N.00 54'01 "E 150.00 feet; thence S.89 05'59 "E. 170.00 feet to the point of beginning. Said parcel contains 0.585 of an acre, more or less. Excepting therefrom, however, easements and rights -of -way for highways, roads, ditches, and utilities of record or as same exist. THAT the following conditions shall be placed upon this approval and that violation of any condition shall be the basis for revocation of the permit: 1. The applicant /owner enter into an improvements agreement with Eagle County to pave the access and parking area. The actual improvements shall be completed within a three year period. • • 2. Landscaping shall be further developed and existing vegetation maintained along the ditch and front property line. THAT the Board of County Commissioners directs the Department of Community Development to provide a copy of this resolution to the applicant.
