BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 90- 3
RESOLUTION RE THE FULFILLMENT OF HORNBAKER
SUBDIVISION IMPROVEMENTS AGREEMENT OBLIGATIONS
WHEREAS, the Board of County Commissioners of the County of
Eagle, State of Colorado (hereinafter referred to as the "County ") ,
• G and Marvin D. Hornbaker and Eva 0. Hornbaker (hereinafter referred
0 si to as "Subdivider") entered into a Subdivision Improvements Agreement,
which was recorded December 17, 1979, in Book No. 296 at Page 94,
as Reception No. 192487 affecting the Hornbaker Subdivision; and
WHEREAS, Subdivider provided collateral in the form of an
• ' irrevocable letter of credit from the First Bank of Eagle County
Cr G in the amount of $15,000. Said collateral was released on October
17, 1980; and
_ WHEREAS, Subdivider has met and fulfilled its obligations as
"u stated in said Agreement.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
' COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:

THAT, the obligations of the above - referenced Subdivision
Improvements Agreement are hereby deemed to be fulfilled and the
terms, conditions, reservations and restrictions contained therein
fl are hereby deemed to be of no further force and effect.

THAT, this document shall be recorded with the Clerk and Recorder
of the County of Eagle, and that by so recording, it terminates any
z„ p requirement to be further referenced in the chain of title of
m properties affected thereby.

THAT, the Board finds, determines and declares that this
s Resolution is necessary for the public health, safety and welfare
of the citizens of the County of Eagle, State of Colorado.
