You were granted permission, over the telephone, to proceed with the -replace- ment of the malfunctioning septic tank because of the obvious need to act quickly. However, the permit requirements were not waived. Section 4.03.03(3) of the Eagle County Land Use Code requires, "A permit fee of $150.00 shall be charged for alteration, enlargement, or any repair involving alteration of an existing sewage disposal system". We have not received a completed application and our records show that the system was installed and inspection on May 15, 1987. Therefore, your action to replace the malfunctioning septic tank without a permit is in violation of Section 4.03.03, Permit Application Requirements. A completed application, site plan and $150.00 permit fee must be sub- mitted to the Eagle County Environmental Health Department within 14 days of receipt of this notice.
