AD-10065 In compliance with Colorado Revised Statutes 1973, 37-92-602, Mike Wolter, (hereinafter "applicant") submitted an application for a permit to construct a well. The application was received by the State Engineer on March 14, 1983. On the basis of the information submitted by the applicant and records in the State Engineer's Office, the State Engineer makes the following findings: 1. The applicant proposes to construct a well as the only well on a 31 acre tract of land in the SE 1/4 of the SW 1/4, Section 3, Township 4 South, Range 86 West, of the 6th Principal Meridian, Eagle County, Colorado. 2. The location of the proposed well is outside the boundaries of a designated ground water basin. 3. The applicant proposes to apply the water diverted from the well to the following beneficial uses: (domestic) household use for a home and the irrigation of a garden. 4. The proposed maximum pumping rate of the well is 15 gallons per minute. 5. The proposed average annual amount of ground water to be appropriated is 1 acre foot. 6. At the proposed depth of 20 feet, using perforated casing in the interval between 16 feet and 20 feet, the ground water diverted would be hydraulically connected to the Colorado River. 7. The Colorado River is overappropriated. At some times of the year, the water supply of said river is insufficient to satisfy all of the decreed water rights senior to an appropriation by the applicant. 8. The proposed well will be on a tract of land less than 35 acres. The presumptions of Colorado Revised Statutes 1973, 37-92-602(3)(b)(II) do not apply. ---1 MR. MIKE WOLTER FILE NO. AD-10065 PAGE 2 9. The proposed subject well will be located in a proposed subdivision development whose water supply plan has not been submitted nor recommended for approval by the State Engineer pursuant to Colorado Revised Statutes 1973, subsection (1)(11) of Section 30-28-136.
