This being a scheduled Public Hearing,the following items were presented to the Board of County
Commissioners for their consideration:
t Constituen Input
Joanne Rock,Eagle resident, shared some election information provided to her by the Clerk and Recorder,
Regina O'Brien regarding ballot certification,residency requirements,changing party affiliation, and maintenance
of voting records. She encouraged folks to read the 2022 State Ballot Information Booklet(Blue Book).
John Staight of Eagle expressed concerns about the direction that the behavioral health initiative was taking
in the valley. There were adults and adolescents in the community in distress who needed support. His concern
was the response and emphasis being placed on psychiatric medications which can cause physical dependence and
withdrawal. He provided the board with some of his research and hoped the information would be shared. He
believed that the information he was providing was critical to the direction that the behavior health initiative was
headed.
Angela Peacock, Retired Army Sergeant spoke. Her story of over medication after trauma was in the film
"Medicating Normal." Her job now was consulting with individuals who had been harmed by the system or who
were seeking alternatives. She shared what she saw currently happening to patients being treated in distress. She
believed that if Eagle Valley truly wanted to help people,they must consider the new hospital to be a healing place
with outdoor time,nutritious food, and not taking people off medications too quickly. The commissioners must no
longer hand over money without demanding data showing positive outcomes not just during a short term stay.
Commissioner Updates
Commissioner Scherr mentioned that the Home Store was doing a Home Buyer Class tonight via Google
meet. Folks could visit valleyhomestore.org to register for the class and get additional information.
Commissioner Chandler-Henry spoke about the event that took place last Saturday,making Camp Hale and
the 10-Mile range a National Monument. This was the first step in making this happen and hopefully would lead to
passage of the CORE Act.
Chairman McQueeney expressed appreciation to the community who came out in force to participate in the
Alzheimers walk last Saturday. She also appreciated the organizations that helped support those who were
struggling with Alzheimers and those who were helping to support those who were living with it. It was a great
show of the community at its best.

Chairman McQueeney asked about the changes to Item 4.
Lane Sheldon,Assistant County Attorney stated that the changes to the Eagle County Cigarette, Tobacco
Product, and Nicotine Product and Tax License Regulations were primarily in Article 8 and Article 12.
Commissioner Scherr moved to approve the Consent Agenda for September 27,2022 as presented.
Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous.

1. Colorado Senate Bill 22-065 Concerning the Fixed Salaries of County Coroners Whose Term Begin on or after
January 1, 2023

Executive Summary:
Senate Bill 22-065 modified the provisions of C.R.S. 30-2-102 concerning the fixed salaries of county coroners
whose terms begin on or after January 1, 2023, in all Category II, III and IV counties. SB22-65 presumes coroners
in Category II counties are full time. Eagle County is categorized as a Category II-A county. SB 22-65authorizeds
the Board of County Commissioners of any Category II county to decline the full-time status of a Category II
coroner for cause,but only after the coroner is given notice and an opportunity to be heard by in a public hearing.
Mr. Treu stated that Kara Bettis,the current Coroner,would be running unopposed. Ms. Bettis was
part-time and had 1.5 FTEs which gave better coverage to the citizens. Ms. Bettis preferred to remain part-time
beginning 2023 and authorized the Board of County Commissioners to decline the full-time status and fix her salary
at 75%of the fixed statutory amount. The next coroner could decide in 2027 whether they wished to be full-time or
not. He drafted a letter to Ms. Bettis dated September 8,2022 explaining this, she signed and acknowledged her
agreement. There would simply be a motion to approve his letter of September 8th and authorize the chair to sign.
Commissioner Chandler-Henry moved to approve the letter drafted by County Attorney Bryan Treu
dated September 8, 2022.
Commissioner Scherr seconded the motion. The vote was unanimous.
2. Resolution 2022-081 Ratification of Contract To Buy and Sell Real Estate for Eagle County to Purchase 106-4
Quail Circle in Gypsum for ECO Transit Employee Housing Needs

Executive Summary: Eagle County, Colorado is under contract to purchase 106-4 Quail Circle townhome in
Gypsum, Colorado for$515,000, and the contract needs to be ratified by the Board. This 3 bedroom, 3 bath unit
will be used for ECO Transit employees, and property management services may be provided by the Eagle
County Housing and Development Authority.
Patti Liermann, Real Estate Broker Associate II, with the Valley Home Store,provided the details of the
purchase. This property was within walking/biking distance to the ECO Transit office. This was the second unit
to be purchased at this location. The property was purchased by Eagle County on behalf of ECO Transit using
ECO Transit funds. The unit would house potentially three employees.
Commissioner Scherr moved to approve the Resolution Ratifying the Contract To Buy and Sell Real
Estate for Eagle County to Purchase 106-4 Quail Circle in Gypsum for ECO Transit Employee Housing Needs.
Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous.
Commissioner Chandler-Henry moved to adjourn as the Eagle County Board of County Commissioners
and reconvene as the Eagle County Housing and Development Authority.
Commissioner Scherr seconded the motion. The vote was unanimous.

1. Agreement for Procurement and Installation Services between Golden Eagle Elderly Housing Corporation and
Cooper Construction, Roofing and Exteriors, LLC

Executive Summary: Each month, Golden Eagle Senior Apartments deposits funds into a Reserve for
Replacement account to put aside funds for upkeep to the property over time. After our 2020 and 2021 audit,the
account was over-funded. In early 2022,per our auditors request,we have discontinued these deposits since we
are over the threshold and need to spend the money on the property. After serious consideration and inspection
with the on-site team, it was determined the best way to utilize the funds is to begin replacing the asphalt roofs on
certain buildings. In 2022, our plan is to replace 4 of the 9 roofs with our reserve funds and then continue the
replacement over the next two to three years on the remaining five roofs. This will revitalize their life for
approximately another 30 years and allow management to explore solar options in the immediate future. The use
of the reserve funds has already been approved by USDA.
Mr. Murray stated that the contract was with Cooper Roofing and Golden Eagle Elderly Apartments. The
goal was to replace four of the nine roofs at the complex. The replacement reserves were over funded so it was
required by the auditors to spend some of those funds to improve the property.
Commissioner Scherr moved to approve the Agreement for Procurement and Installation Services
between Golden Eagle Elderly Housing Corporation and Cooper Construction, Roofing and Exteriors,LLC.
Commissioner Chandler-Henry seconded the motion. The vote was unanimous.
Commissioner Chandler-Henry moved to adjourn as the Eagle County Housing and Development
Authority and reconvene as the Eagle County Board of County Commissioners.
Commissioner Scherr seconded the motion. The vote was unanimous.

1. Warner Professional Building#2 Special Use Permit Extension
Executive Summary: The Applicant is requesting a two (2)year extension of the Special Use Permit(File No.
ZS-7559), initially approved on August 13,2019 by Resolution 2019-070. This request is the first request for an
extension of the Warner Professional Building#2 Special Use Permit,which allows the conversion of an office
building to a boarding house on a .48 acre parcel in the EagleVail Planned Unit Development.
Janet Aluise, Eagle County staff planner, stated that there had been a technical defect in the posting of the
public notice on the property, so staff was requesting a tabling of the application unit November 9,2022.
Robert Warner, the applicant, stated that they were disappointed but would accept the tabling.
Commissioner Scherr moved to table file no. PR-9276,Warner Professional Building#2 Special Use
Permit Extension until November 9, 2022.
Commissioner Chandler-Henry seconded the motion. Of the two voting commissioners,the vote was
unanimous.
