HomeMy WebLinkAboutMinutes 09/13/2022 PUBLIC HEARING September 13, 2022 Present: Jeanne McQueeney Chairman Kathy Chandler-Henry Commissioner Matt Scherr Commissioner Mike Nugent Chief Strategy Officer Kathy Scriver Deputy Clerk to the Board This being a scheduled Public Hearing,the following items were presented to the Board of County Commissioners for their consideration: Constituent Input Joanne Rock,resident of the Town of Eagle spoke. She spoke about the water crisis and expressed support for more severe measures to address the issue. William Bourne-Taylor,resident of Eagle spoke. He believed that Philip Qualman, Superintendent of Eagle County Schools deserved the board's full support in calling for a review with regards to COVID mandates. Commissioner Updates Commissioner Chandler-Henry stated that there was an annual State of the River conference being held in Grand Junction at Mesa State University as well as online this Friday;the issue was resources available in the Colorado Rivers. Commissioner Scherr spoke about the importance of the energy assessments that were available in Eagle County through Aspen Core.org and Walking Mountains.org„ depending on your residence. The assessments were cheap to free,typically no more than$50. Chairman McQueeney gave a shout out to the Human Service Department because this was Child Welfare Appreciation Week. County Manager Updates Mike Nugent, Chief Strategy Officer, stated that he had no updates. Business Item(s) 1. Resolution 2022-075 Approval of the 6th Supplemental Budget 2021 Jill Klosterman,Finance Anna Earl,Deputy Finance Director presented. The request was mainly for administrative purposes as in 2021 the Airport transferred$1,840,450 to ECAT and they planned to use the funds to make payments on their bonds. At the end of 2021 they had not made those payments so the transaction was recorded as a liability on the 1 09/13/2022 Airport balance sheet. During the 2021 audit, the auditors recommended that the transaction be recorded as an expense. Commissioner Chandler-Henry moved to approve the 6th Supplemental Budget 2021 Commissioner Scherr seconded the motion. The vote was declared unanimous. 2. Resolution 2022-076 Approval of the 4th Supplemental Budget 2022 Jill Klosterman,Finance Ms. Earl provided an overview snapshot. The total supplemental request was $108,055 and total expenditures $1,395,819. She presented a spreadsheet that broke down the request by department. This report can be accessed in Boarddocs or by reaching out to the Eagle County Finance Department. Commissioner Scherr moved to approve the 4th supplemental Budget 2022 Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous. Commissioner Chandler-Henry moved to adjourn as the Eagle County Board of County Commissioners and reconvene as the Eagle County Liquor Licensing Authority. Commissioner Scherr seconded the motion. The vote was unanimous. Eagle County Liquor Licensing Authority 1. Transfer of a Hotel&Restaurant License- Sage Outdoor Adventures LLC DBA Sage Outdoor Adventures Kathy Scriver, Clerk&Recorders Office Executive Summary: Sage Outdoor Adventures,LLC DBA Sage Outdoor Adventures submitted an application to transfer ownership of a Hotel&Restaurant Liquor License at 3 Cotton Lane Gypsum CO(Dotsero) Description: Sage Outdoor Adventures, LLC submitted an application to transfer ownership of a Hotel& Restaurant liquor license. The location has been licensed by Dotsero River Center LLC since May of 2019. The applicant has been issued a temporary permit, allowing them to operate during the time the application is pending. Ms. Scriver introduced applicants Joe Tomasic,Jim Howey,and Jason Holt. She presented the Local Licensing Authority's considerations and staff findings and stated that the applicant had met all the necessary requirements for the transfer of a Hotel&Restaurant liquor license. Commissioner Scherr moved that the Local Liquor Licensing Authority approve the Transfer of the Hotel &Restaurant liquor license from Dotsero River Center, LLC to Sage Outdoor Adventures,LLC DBA Sage Outdoor Adventures. Commissioner Chandler-Henry seconded the motion. The vote was unanimous. 2. Transfer of a Beer&Wine License-Ogdoad LLC DBA Noni's Hair Bar Kathy Scriver, Clerk&Recorders Office 2 09/13/2022 Executive Summary: Ogdoad LLC DBA Noni's Hair Bar submitted an application to transfer ownership of a Beer&Wine License 97 Main Street#E-104 Edwards CO (Riverwalk). Description: Ogdoad LLC submitted an application to transfer ownership of a Beer&Wine license. Noni's Hair Bar located in Riverwalk behind Peak Performance Footwear. The location has been licensed under Noni's Hair Bar LLC since April 2012. The applicant has been issued a temporary permit, allowing them to operate during the time the application is pending. Ms. Scriver introduced applicant Austin O'Gorman. She presented the Local Licensing Authority's considerations and staff findings and stated that the applicant had met all the necessary requirements for the transfer of a Beer and Wine liquor license. Commissioner Chandler-Henry moved that the Local Liquor Licensing Authority approve the Transfer of the Beer&Wine liquor license from Noni's Hair Bar LLC to Ogdoad LLC DBA Noni's Hair Bar. Commissioner Scherr seconded the motion. The vote was unanimous. 3.Application for New Hotel&Restaurant Liquor License- Southside Eddie's LLC DBA Ed's Kathy Scriver,Clerk&Recorders Office Executive Summary: Southside Eddie's LLC DBA Ed's submitted an application for a new Hotel&Restaurant liquor license at 69 Edwards Access Road Unit#6 Edwards CO (Edwards Plaza II) Description: The applicant submitted an application for a new Hotel&Restaurant liquor license for a location in Edwards not licensed since 2011 by Asian Spice Bistro. The applicants currently hold other liquor licenses in Eagle County;Northside Kitchen, Southside Benderz and Fattoria in Avon, and Northside Kitchen Grab and Go in Vail, the Town of Avon and the Town of Vail report that the applicants have been responsible license holders and the licenses are all in good standing. The proposed location is currently undergoing significant renovations and the applicant hopes to open soon,possibly in November. Ms. Scriver introduced applicants Noah Bender and Steve Shelman. She presented the Local Licensing Authority's considerations and staff findings and stated that the applicant had met all the necessary requirements for the issuance of a new Hotel&Restaurant liquor license. Commissioner Chandler-Henry moved that the Local Liquor Licensing Authority find that there is a reasonable requirement and desire for the issuance of this license and therefore approve the application for a Hotel & Restaurant liquor license for Southside Eddie's LLC DBA Ed's based on the testimony,petitions, and incorporating staff's findings. Commissioner Scherr seconded the motion. The vote was unanimous. Commissioner Scherr moved to adjourn as the Eagle County Local Liquor Licensing Authority and reconvene as the Eagle County Board of County Commissioners. Commissioner Chandler-Henry seconded the motion. The vote was unanimous. Planning File - Eagle County Room 1. VIS-009227-2022 Tabling to October 25th,2022 Julie Pranger, Engineering 3 09/13/2022 Executive Summary: The Board of County Commissioner meeting on September 13,2022 to hear file number VIS-009227-2022 will be tabled to October 25, 2022 per request of the Representative. Ms. Pranger stated that the applicant submitted a tabling request form. Ray Nielsen,the applicant's representative was present. She noted that prior to the hearing there would be a site visit at 2:00 p.m. and the hearing would follow at approximately 3:30 p.m. in the Eagle County Building. Commissioner Chandler-Henry moved to table file the Variance from Improvement Standards for Hells Gate Ranch, File No. VIS 009227-2022 to Oct 25,2022 per the representatives request. Chairman McQueeney seconded the motion. The vote was unanimous.
