CONDITIONS:
1. All installation must comply with all requirements of the County Individual Sewage Disposal Regulations,
adopted pursuant to authority granted in 25-10-104, CRS 1973 amended 25-1-614, CRS 1973
2. This permit is valid only for connection to structures which have fully complied with County Zoning and
building requirements. Connection to or use with any dwelling or structures not approved by the building
and Zoning office shall automatically be a violation of a requirement of the permit and cause for both
legal action and revocation of the permit.
3. Section 111, 3.24 requires any person who constructs, alters, or installs an individual sewage disposal
system in a manner which involves a knowing and material variation from the terms or specifications con-
tained in the application of permit commits a Class I, Petty Offense ($500.00 fine - 6 months in jail or

Dear.Cynthia,
All loan inspections are completed under the authority of the
Eagle County Building Resolution, Section 3.09.03-A-(7), adopted
by the Eagle County Commissioners on October 3, 1985.
An onsite inspection of the sewage disposal system on January 29,
1987 revealed that the system appears to be functioning properly
with no apparent problems. This septic system was finalized on
September 29, 1978 under Permit #302.
Potable water is supplied by a private well.

1. All installation must comply with all requirements of the County Individual Sewage Disposal Regulations,
adopted pursuant to authority granted in 25-10-104, CRS 1973 amended 25-1-614, CRS 1973
2. This permit is valid only for connection to structures which have fully complied with County Zoning and
building requirements. Connection to or use with any dwel ' ling or structures not approved by the building
and Zoning office shall automatically be a violation of a requirement of the permit and cause for both
legal action and revocation of the permit.
3. Section 111, 3.24 requires any person who constructs, alters, or installs an individual sewage disposal
system in a manner which involves a knowing and material variation from the terms or specifications con-

will not be issued a building permit until you have your ISDS permit.

II) The following must'be completed to obtain an ISDS permit:
1. Applicable fees (see fee schedule)
.2 Complete ISDS application (including legal description, tax
parcel number, and physical address). Incomplete applications
will not be processed.
3. Indication of the licensed septic system contractor you have
chosen. Contact the county for a list of licensed installers.
4. Satisfactory site plan (see attached "Site Plan Requirements").
5. Satisfactory percolation test & soil profile results from a
county technician or a Registered Professional Engineer. An
Eagle County Environmental Health technician must view the
profile hole before back filling has occurred to verify the
soil type.
6. Eagle County's approval of Engineer's design (if applicable).

. Specifications For Percolation.And Soil Profile Test Holes
These specifications are authorized by the Eagle County individual
sewage disposal system regulations adopted and effective March 27,
1980.
Location:
Percolation test holes - Soil percolation tests shall consist of at
least three (3) test.holes spaced uniformly over the proposed site in
a triangular shape with approximately 25-35 feet between each hole.
Soil profile hole - The soil profile examination should be located in
an area directly adjacent to the proposed absorption area. It cannot
be located in the absorption area. If your absorption area is located
on a slope, dig your soil profile hole down slope of the proposed
area.
Dimensions:
Percolation test holes - The percolation test holes should be dug with
a post hole digger or spade. The dimensions of the holes should be
approximately six (6) inches in diameter and three.(3) feet deep. The
holes cannot be more than twelve (12) inches in diameter. Do not use
a Backhoe to dig these holes.
Soil -profile hole - The soil profile test hole must be dug at least
eight (8) feet deep or until bedrock or groundwater is reached. This
hole should be dug with a backhoe.
Preparation:
Percolation test holes - Roughen the sides of the three (3) holes and
remove loose dirt from the bottom. Presoak the test holes at least
eight (8) hours (and not more than twenty-four (24) hours) prior to
the scheduled percolation test. NOTE: If hot, dry conditions exist,
the presoaking should occur no more than 12-14 hours before the test.
Percolation Test - Remember to leave enough water onsite to fill the
holes for the test (approximately 15 gallons).
Soil profile hole - There is no preparation need.
These instructions must be followed to ensure accurate percolation
test results. if the above procedures are not followed, the
percolation test will not be completed until the holes meet
specifications. Additional fees may be assessed for unnecessary
trips.

III) PERCOLATION TESTS: (See specifications on pg. 3) N I
1. Percolation test shall be conducted for all new construction
and for all new leach fields or repair permits.
2. Colorado Registered Professional Engineers are required to
conduct the percolation tests on systems designed by them.
3. Can be conducted by the Environmental Health Division only on a
conventional systems after adequate site preparation. Please
call and schedule an appointment at least 48 hours in advance.
4. If the percolation test is done by Eagle County & the results
show that the soil is unsuitable for a conventional system, a
Registered Professional Engineer.will be required to design the
system. Your percolation test fee paid to the county will not
be refunded.
IV) SOIL PROFILE: (See specifications on pg. 3)
1. One soil profile test hole at least eight feet deep or to
bedrock, must be completed to give an indication of -the soil
condition of the area. If a Registered Professional Engineer
performs the percolation test, soil profile data must be
submitted as well.
2. An Eagle County Environmental Health technician must perform a
site evaluation for each installation. Please call and
schedule an appointment at least 48 hours in advance.
SPECIAL NOTES:
A) All individual sewage disposal systems permits are issued to
the licensed systems contractor indicated on the application.
A licensed contractor must be selected before the ISDS permit
will be issued.
B) The State of Colorado requires that the ISDS permit be issued
before the building permit is issued. If your application is
incomplete this will delay the issuance of your ISDS permit,
and the issuance of the building permit, as well. However,
building permit review will still be conducted concurrently by
the building, planning, and engineering divisions, while the
ISDS review is being done.
C) The County of Eagle, Colorado requires a permit for the
installation, alteration, or renovation of any ISDS. Only
Systems Contractors licensed by Eagle County are authorized to
perform this work. A list of current Systems Contractors is
available upon request.
D) Eagle County Board of Health declares that its general policy
is to require the use of public sewer systems where and
whenever feasible and to limit the installation of ISDS only to
areas that are not feasible for public sewers. Eagle County
will not issue an ISDS permit where the applicants dwelling is
within 400, of a public sewer and where the Sanitation District
is willing to serve.

1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of -the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.

will require disposal and 70 percent will be reclaimed. The remainder of the water used at the
CarBarn building will be for shower, toilet and laundry.

Dear Ray:
Robert Levine would like to proceed with the construction of his car barn this winter. I understand,
from Kyle Webb, that he needs a county building permit before he can proceed with any additional
construction.
We understand that the main issue holding up the county building permit is the ISDS permit. The
key issue for the ISDS permit is the water right for the car -washing feature in the car barn.
It is the intent of Mr. Levine to go to water court and obtain a decree for a water augmentation plan
that would cover any water right issues associated with the car washing facility.
I suggest that the county issue a building permit with the understanding that the car wash may not
be used until an appropriate water augmentation plan is decreed by the water court and a copy is
delivered to the county. I believe this will protect the interest of all party's involved and will allow
Mr. Levine to proceed in a timely manner.

FYI, I spoke with Louiza today (11/14/00) and told her that it's not a water quantity issue but a type of use
of the well water that is being questioned. She will talk to Bart and let him know and probably stop trying
to do revisions to the septic based on water use as it really doesn't matter. She could reduce the flow
down to a gallon and it wouldn't matter. Hopefully Mr. Levine's water engineer or water attorney can
advise him on how to proceed.

2. The septic tank shall be installed level. R-,e tank shall have removable covers or manholes to within 8
inches of the finished grade, for inspection ard cleaning.
J. Excavate three (J) feet wide trenches. Th,? horizontal distance from sidewall to sidewall between the
trenches shall be a minimum of six (6) feet.
4. The bottom and the sidewalls of the trenches shall be raked to eliminate smearing.
5. Assemble and install the Infiltrator Chomb6rs in the trenches according to the manufacturers
recommendations.
6. Backfill the sidewaH area with native on-s,*te soil for proper support.
7 Backfill the trenches with a minimum of 12 inches of tamped soil cover.
8. Avoid vehicle traffic over the system.
9. All instollctions shall meet the rules and tegulations of the Eagle County Environmental Health Division,
Chapter 4, Individual Sewage Disposal Systems.
10. The Septic System Installation shall be inspected by the Design Engineer prior to backfilling.
