The above items are in violation of Section 25, Article 10, of the Colorado Revised Statutes, 1973, as amended, and in violation of Eagle County Individual Sewage Disposal Regulations adopted February 11, 1980, and effective March 27, 1980, in particular, the following sections: "3.1 General Sanitation Requirements: The owners of any structure where people live, work, or congregate shall insure that the structure contains adequate, convenient, sanitary toilet and sewage disposal systems in good working order. Under no condition shall sewage effluent be permitted to be discharged upon the surface of the ground... 3.3 a) Prior to commencement of installation, alteration or repair of a system, a written application therefor to the Environmental Health Department shall be made providing, as a minimum, the information called for on the application form, and a permit shall have been issued by the Environmental Health Department. b) A permit fee of $75.00 shall be required of applicants for new individual sewage disposal systems, payable to Eagle County, at the Environmental Health Department... 3.5 The property owner shall be responsible for proper maintenance of the system and for abatement of any nuisance arising from its failure. 3.8 Upon failure or need of repair or alteration, pre- existing, non -conforming systems must be brought up to current regula- tions of a two -compartment septic tank and the required square footage of absorption area. 3.27 General Prohibitions: ... (6) No person shall construct or maintain any dwelling or other occupied structure which is not equipped with adequate facilities for the sanitary disposal of sewage without endangering the public health. 6.6 Watertight Requirement: Watertight tanks, vaults or other units shall not allow infiltration of groundwater or surface water and shall not permit the release of wastewater or liquids therefrom through other than designed openings. 6.7 Accessibility for Inspection and Maintenance: Each treat- ment.unit shall be equipped with an access manhole located to permit periodic physical inspection...and maintenance of all components and compartments..." The before -mentioned items (1) through (6) are also in violation of SECTION VII: Component Design Criteria (First Stage Treatment) and SECTION VIII: Component Design Criteria (Second or Later Stage Treatment Units) of the Eagle County Individual Sewage Disposal System Regulations. If the dwelling is to remain occupied, an application for a permit to install an individual sewage disposal system shall be made by such owner/occupant to the Environmental Health Department within TWO (2) BUSINESS DAYS after receipt of this Notice. Enclosed please find an Individual Sewage Disposal System Permit Application #907 and applicable information. Please bring or mail the completed application with site plan and fees to the Environmental Health Department, P.O. Box 850, 550 Broadway - Room 202, Eagle, Colorado 81631. After receiving a permit from this Department, installation must be completed WITHIN 30 DAYS. This NOTICE OF VIOLATION is authorized by Section 3.23 of the Eagle County Individual Sewage Disposal System Regulations which states: "3.23 Notice of Violation: Whenever the Health Officer determines that there has been a violation of any provision of these Regulations, he shall give notice of such violation to.the responsible person or persons.
