HomeMy WebLinkAboutR94-211 acceptance of roads for maintenance in Eby Creek Mesa Phase ICommissioner moved adoption of the following Re olution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 94 - ; L 4-_ In Re EBY CREEK MESA SUBDIVISION, PHASE Acceptance of Roads for Maintenance WHEREAS, pursuant to C.R.S. 30- 28 -37, the Board of County Commissioners of the County of Eagle, State of Colorado ( "Board ") entered into a Subdivision Improvements Agreement dated July 6, 1993 ( "Agreement ") with Eby Creek Mesa Limited Partnership, a Colorado Limited Partnership, whose general partner is Eagle River Land Company, Inc., a Colorado corporation ( "Subdivider "), as a condition of final plat approval for Eby Creek Mesa Subdivision Phase I; and WHEREAS, pursuant to the Subdivision Improvements Agreement and any amendments thereto, the County would not accept responsi- bility for the maintenance of the roads dedicated to the public until such time as the roads were constructed and completed in accordance with Eagle County specifications; and WHEREAS, Subdivider has represented to the Board that the public improvements associated with EBY CREEK ROAD, from the intersection of Rule Road to the intersection of Mesa Drive, a total of 0.84 miles, located within Eby Creek Mesa Subdivision, Phase I have been completed, and has therefore requested that the County undertake maintenance of this road; and WHEREAS, Subdivider has represented to the Board that the public improvements associated with MESA DRIVE, from the intersec- tion of Eby Creek Road to the end of the Phase I boundary, a total of 1.26 miles, located within Eby Creek Mesa Subdivision, Phase I have been completed, and has therefore requested that the County undertake maintenance of this road; and WHEREAS, Subdivider has represented to the Board that the public improvements associated with PINION LANE, from the eastern intersection of Mesa Drive to the western intersection of Mesa Drive, a total of 0.18 miles, located within Eby Creek Mesa Subdivision, Phase I have been completed, and has therefore requested that the County undertake maintenance of this road; and h i y WHEREAS, Subdivider has represented to the Board that the public improvements associated with JUNIPER LANE, from the eastern intersection of Mesa Drive to the Western intersection of Mesa Drive, a total of 0.23 miles, located within Eby Creek Mesa Subdivision, Phase I have been completed, and has therefore requested that the County undertake maintenance of this road; and WHEREAS, winter conditions make it impossible to adequately determine all the conditions of the work done but the the Subdivid- er has indicated they have inadequate equipment to properly provide winter road maintenance; and WHEREAS, based upon the oral and written recommendations of the Department of Engineering, see Exhibit "A" attached hereto and incorporated herein by this reference, THE BOARD FINDS that the public improvements associated with Eby Creek Mesa Subdivision, Phase I have been substantially completed and in order to protect the residents, acceptance of the road for winter maintenance by the Board is warranted; and WHEREAS, based upon the oral and written recommendations of the Department of Engineering, see the attached Exhibit "A ", the Subdivider is responsible for completing the items as listed on Exhibit "B ", attached hereto and incorporated herein by this refer- ence, prior to June 1, 1995; and WHEREAS, based upon the oral and written recommendations of the Department of Engineering, the warranty period will not commence until such time as the Subdivider has complied with the conditions as set forth by the Department of Engineering, see Exhibit "A ". NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the County will accept winter maintenance of EBY CREEK ROAD, from the intersection of Rule Road to the intersection of Mesa Drive, for a total of 0.84 miles. THAT, the County will accept winter maintenance of MESA DRIVE, from the intersection of Eby Creek Road to the end of the Phase I boundary, for a total of 1.26 miles. THAT, the County will accept winter maintenance of PINION LANE, from the eastern intersection of Mesa Drive to the western intersection of Mesa Drive, for a total of 0.18 miles. THAT, the County will accept winter maintenance of JUNIPER LANE, from the eastern intersection of Mesa Drive to the Western intersection of Mesa Drive, a total of 0.23 mile. -2- THAT, the Subdivider is responsible for completing the items as listed on the attached Exhibit "B" prior to June 1, 1995 and assuring the County that all work has been done in accordance with County specifications. THAT, the warranty period will not commence until such time as the Subdivider has complied with the conditions as set forth by the Department of Engineering, see the attached Exhibit "A" and only by resolution of the Eagle County Board of County Commissioners. The roll having been called, the vote was as follows: Commissioner Phillips e Commissioner Johnson Commissioner Gates This Resolution passed by R -Q vote of the Board of County Commissioners of the County of Eagle, State of Colorado. 82 -248 mta \r \ebyroad.acp -3- , y MEMORANDUM EAGLE COUNTY ENGINEERING TO: Maureen Amundson, Attorney's Office FROM: Phill Scott, Engineering DATE: December 16, 1994 RE: Eby Creek Mesa Subdivision, Phase I Subdivision Improvements Agreement The Engineering Department has found the public improvements in the above referenced subdivision to be substantially complete, and in accordance with the terms and conditions of the Subdivision Improvements Agreement, except as noted in the attached Exhibit B. Therefore, we are recommending that the County take over the subject roads for maintenance purposes. The "punch list" items (Exhibit B) will be completed by June 1, 1995. Before the warranty period for the public improvements can commence, asphalt testing in accordance with the Subdivision Improvements Agreement must be submitted to the Engineering Department, and any remaining sight distance issues on Eby Creek Road at or near the intersection with Mesa Drive must be resolved. a EBY CREEK MESA SUBDIVISION, PHASE I SUBDIVISION IMPROVEMENTS AGREEMENT "Punch List" Items 1. Two 35 mph speed limit signs on Eby Creek Road. One at the beginning of Eby Creek Road and one facing the south bound traffic south of the Mesa Drive /Eby Creek Road intersection. 2. Five street signs - one at each of the street intersections. 3. Clean up some minor brush in the drainage on the south side of Pinion Lane approximately station 5 +00. 4. Two 5 steel bollard posts to protect the electric transformer on Pinion Lane approximately station 6 +50. One placed on each corner at a 45 angle 18" away from the electric vault. 5. The electric vault left station 17 +00 Mesa Drive needs dirt placed flush around the vault flush so a snow plow won't damage the vault. 6. The stop sign at Mesa Drive /Eby Creek Road intersection needs lowered. 7. The delineators at the culvert crossing on Eby Creek Road need to be placed 4' prior to the culvert and be set at a height of 4'. The delineators need to be a Type III (3- yellow). 8. The guardrail needs an OM -BT hazard marker placed at each end per 5 -612 -1 CDOT's standards, unless a delineator Type III is placed at the end of the guard rail. 9. The guard rail needs additional reflector tabs per CDOT's standards. 10. One delineator Type III (3- yellow) needs to be placed at the beginning of each guardrail, in front of the asphalt curb, approximately stations 20 +50 and 24 +50. 11. The asphalt cold joint in the left lane and approximately at station 7 +50 of Eby Creek Road needs smoothed out. 12. The driveway on the left side of Eby Creek Road approximately at station 7 +50 will need an 18" culvert. 13. The culvert at the Pinion Lane /Mesa Drive intersection needs to be extended by 5'. 14. Manhole H1 needs adjusted to grade. 15. The asphalt around the manholes in Eby Creek Road needs to be adjusted. The 6 by 6 stop sign post shall be provided with two 1%" diameter holes through the neutral axis at right angles to the roadway, one drilled at 4 and one at 18" above the ground level. 17. The west fill bank on the portion of Eby Creek Road north of Mesa Drive intersection needs to be regraded to a 2�4 to 1 slope.
