In Re HOMESTEAD FILING 1, BLOCK 11
Acceptance of Roads for Maintenance
WHEREAS, on August 8, 1981 the Eagle County Board of County
Commissioners (hereinafter referred to as "Board ") entered into a
Subdivision Improvements Agreement with the Homestead Ranch
Development Corporation (hereinafter Subdivider) as a condition of
Final Plat approval for Homestead Subdivision, Filing 1; and
WHEREAS, on March 6, 1990 Warner Developments, Successor to
Homestead Ranch Development Corporation (hereinafter "Subdivider ")
entered into an amendment to the Subdivision Improvements Agreement
to extend Cassidy Place through Lots 29 and 30 of Block 11 to
Lariat Loop within the South Forty Subdivision; and
WHEREAS, pursuant to the Subdivision Improvements Agreement
and any amendments thereto the County would not accept responsi-
bility for the maintenance of the roads dedicated to the public
until such time as the roads were constructed and completed in
accordance with Eagle County specifications; and
WHEREAS, Subdivider has represented to the Board that the
public improvements associated with Homestead Drive from Cameron
Place to Gold Dust Drive, a total of 0.19 miles, located within
Homestead Subdivision, Filing 1, Block 11 have been completed, and
has therefore requested that the County undertake maintenance of
this road; and
WHEREAS, Subdivider has represented to the Board that the
public improvements associated with Gold Dust Drive from the
intersection with Homestead Drive to the cul -de -sac (N.W.) and Gold
Dust Drive from the intersection with Homestead Drive to South
Forty Subdivision (S.E.), a total of 0.26 miles, located within
Homestead Subdivision, Filing 1, Block 11 have been completed, and
has therefore requested that the County undertake maintenance of
this road; and
WHEREAS, Subdivider has represented to the Board that the
public improvements associated with Cassidy Place from Golddust
Drive to the cul -de -sac, a total of 0.08 miles, located within
Homestead Subdivision, Filing 1, Block 11 have been completed, and
has therefore requested that the County undertake maintenance of
this road; and
WHEREAS, Subdivider has represented to the Board that the
public improvements associated with Game Creek Place from Gold
Dust Drive to the cul -de -sac, a total of 0.03 miles, located within
Homestead Subdivision, Filing 1, Block 11 have been completed, and
has therefore requested that the County undertake maintenance of
this road; and
WHEREAS, the Eagle County Department of Engineering has
determined that the Board accept the roads if the Subdivider
complies with conditions as set forth in Exhibit "A ", attached
hereto and incorporated herein by this reference; and
WHEREAS, based upon the oral and written representations of
the Eagle County Department of Engineering which has confirmed
Subdivider's representations, as set forth in Exhibit "A ", THE
BOARD FINDS that the roads located within Homestead Subdivision,
Filing 1, Block 11 have been completed in accordance with Eagle
County specifications, and acceptance of the road for maintenance
by the Board is warranted if Subdivider complies with the condi-
tions as set forth by the Eagle County Department of Engineering;
and
WHEREAS, based upon the oral and written representations of
the Eagle County Department of Engineering, see the attached
Exhibit "A" THE BOARD FINDS that commencement of the two year
warranty period for those improvements associated with Homestead
Subdivision, Filing 1, Block 11 shall commence on June 1, 1995.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT the County will accept maintenance of Homestead Drive
from Cameron Place to Gold Dust Drive, for a total of 0.19 miles.
THAT, the County will accept maintenance of Gold Dust Drive,
from the intersection with Homestead drive to the cul -de -sac (N.W.)
and Gold Dust Drive from the intersection with Homestead Drive to
South Forty Subdivision (S.E.), for a total of 0.26 miles.
THAT, the County will accept maintenance of Cassidy Place from
Gold Dust Drive to cul -de -sac for a total of 0.08 miles.
THAT, the County will accept maintenance of Game Creek Place
from Gold Dust Drive to cul -de -sac for a total of 0.03 miles.

THAT, the two year warranty period for those improvements
associated with Homestead Subdivision Filing 1, Block 11 shall
commence on June 1, 1995.
THAT, the Subdivider has provided the County with Irrevocable
Letter of Credit No. 9116035 issued by the FirstBank of Avon in
the amount of $47,000.00 and Check No. 3203 on the Cash Management
Account of Robert Warner, Jr. in the amount of $500.00 for a total
collateral amount of $47,500.00 which represents ten percent (10 %)
of the total cost of public improvements associated with Homestead
Subdivision Filing 1, Block 11.
THAT, this resolution is necessary for the public health,
safety and welfare of the citizens of Eagle County.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County of Eagle, State of Colorado, at its regular meeting
held the S&L day of December, 1994.

MEMORANDUM
EAGLE COUNTY ENGINEERING
TO: Jim Fritze, County Attorney

DATE: December 2, 1994
RE: Homestead, Block 11
Visited the site on Monday, November 28, 1994 to check the last
items on the punch list for Block 11. Stop sign had been
installed, but not on an approved post. Could not see if
concrete stones in curb and gutter had been replaced because most
of the sidewalk was covered with 8 to 10" of snow. Several
stones were covered with plastic (which was covered with snow)
indicating recent construction activity. Also received as -built
plans. On November 7, 1994, Phill Scott wrote Gary Marner of
Warner Developments a brief memo (copy attached) regarding
concerns raised after the county's review of the initial
submittal of as -built check prints. Not all of the questions
raised in that memo have been addressed by the developer.
Additionally, the subsequent submittal of the as -built sewer and
water drawing has raised a few more questions of a technical
nature. We would like specific answers to the questions that
remain.
On Wednesday, November 30, 1994, I talked with Gary Marner on the
phone and suggested that stop sign be installed on an approved
post. On Friday, December 2, 1994, I drove by the subdivision
and the stop sign was installed on an approved post. The post
extended approximately 18" above the sign which looked to be the
correct height. Would ask that developer check sign post next
spring and drive post into ground so sign will be at top of post.
If the developer will commit to furnishing additional information
that satisfies the remaining outstanding concerns, and will
correct the stop sign post installation, the Engineering
Department can recommend that roads be accepted by the county.
Recommend warranty period not be commenced until developer
complies with the conditions as stated above.
