COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 94-
IN RE THE MATTER OF TEMPORARY AMENDMENT
OF EMERGENCY MEDICAL SERVICES
AMBULANCE CERTIFICATION STANDARDS
WHEREAS, the Board of County Commissioners of the County of
Eagle, State of Colorado (hereinafter "Board "), has authority to
establish the qualifications for emergency medical personnel
employed or utilized in connection with an ambulance service,
pursuant to C.R.S. X25 -3.5 -202; and
WHEREAS, pursuant to that authority, the Board adopted
Resolution 90 -111 on November 19, 1990 adopting Emergency Medical
Services Ambulance Certification Standards for Eagle County
providers of ambulance services; and
WHEREAS, the standards require that a Basic Life Support
Ambulance be operated by a minimum of two persons, of whom one may
be the driver, currently certified as Emergency Medical Technicians
pursuant to the laws of Colorado; and
WHEREAS, the standards require that an Advanced Life Support
Ambulance be operated by a driver currently certified as an
Emergency Medical Technician pursuant to the laws of Colorado and
by manned by at least one person having specified advanced training
and holding current certification as an Emergency Medical Techni-
cian, registered nurse, or physician; and
WHEREAS, requiring the drivers of an Advanced Life Support
Ambulance or of a Basic Life Support Ambulance to hold certifica-
tion as an Emergency Medical Technician has impaired the ability of
the County ambulance services to hire an adequate supply of persons
to drive their ambulances; and

WHEREAS, the Eagle County Emergency Medical Services Council
has recommended the temporary reduction in the requirements imposed
on persons hired to drive ambulances; and
WHEREAS, the Board finds that an amendment to the Emergency
Medical Services Ambulance Certification Standards for a one year
period would benefit the health and safety of the citizens of Eagle
County.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board determines that the Emergency Medical Services
Ambulance Certification Standards shall be amended in the following
particulars only:
Article I.
C. "Advanced Life Support Personnel" means a minimum of
one state certified Emergency Medical Technician -Pa-
ramedic /EMT -P, or an Emergency Medical Technician -
Intermediate /EMT -I, or a registered nurse with Advanced
Cardiac Life Support certification, or a physician with
Advanced Cardiac Life Support certification, or a
Paramedic or EMT -I serving as a trainee or graduate prior
to state certification; and a driver with a valid
Colorado driver's license and current certification
pursuant to a First Responder Program designed to train
emergency response personnel to deal with an emergency
incident upon first arrival at the scene, pursuant to
C.R.S. Part 12 of Article 33.5 of Title 24.
J. "Basic Life Support Ambulance" means an Ambulance
that meets the requirements for Equipment as established
by the Board and is manned by at least one Emergency
Medical Technician - Basic /EMT -B currently certified by the
State of Colorado; and a driver with a valid Colorado
driver's license and current certification pursuant to a
First Responder Program designed to train emergency
response personnel to deal with an emergency incident
upon first arrival at the scene, pursuant to C.R.S. Part
12 of Article 33.5 of Title 24.
THAT, the foregoing amendments shall be in effect beginning
the date hereof and continuing through November 30, 1995, at the
end of which date these amendments shall automatically be void and
cease to have any further force or effect without further action by
the Board, unless the amendments are earlier terminated
or extended by resolution of the Board.

APPROVAL OF SPECIAL USE PERMIT
Alpine Christian Academy /Basalt Bible Church
Private Educational Institution
FILE NO: ZS- 352 -94
WHEREAS, Alpine Christian Academy /Basalt Bible Church
( "Applicant ") did file an application with the Eagle County
e Department of Community Development on or about May 5, 1994, for
a private educational facility (school) within the Resource zone
district, in the unincorporated area of Eagle County described as
follows:
A parcel of land located in Tract 52, Section 11, T.8 S., R.
87 W., Sixth P.M., County of Eagle, State of Colorado,
approximately 1.5 miles south of E1 Jebel on the east side of
Highway 82.
WHEREAS, the special use permit request was considered at a
public meeting by the Roaring Fork Valley Planning Commission
on July 7, 1994 and by the Eagle County Board of County
Commissioners on August 2, 1994; and
WHEREAS, based on the evidence, testimony, exhibits, study of
the Master Plan for the unincorporated areas of Eagle County,
comments of the Eagle County Department of Community Development,
comments of public officials and agencies, the recommendation of
the Eagle and Colorado Valley Planning Commission, and comments''
from all interested parties, the Board of County Commissioners of
the County of Eagle, State of Colorado, finds as follows:
1. That proper publication and public notice was provided as
required by law for the hearings before the Planning
Commission and the Board of County Commissioners;
2. That the proposed special use conforms to the
requirements of Section 2.09, Special Uses of the Eagle
County Land Use Regulations;

That the proposed special use will be compatible with the
existing uses in the area;
4. That the following have been considered: The potential
effect of the use on the character of the neighborhood,
adequacy of access to and from the area, appropriateness
of the physical arrangement of the use on the proposed
site, and consistency with the Master Plan;
5. That for the above - stated and other reasons, the proposed
special use is in the best interest of the health,
safety, morals, convenience, order, prosperity and
welfare of the citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of the County of Eagle, State of Colorado:
THAT the application of Alpine Christian Academy /Basalt Bible
Church, File No. ZS- 352 -94, for a Special Use Permit for a
private educational facility (school) within the Resource Zone
District and as described herein, be approved, subject to the
conditions as set forth herein.
THAT the following conditions shall be placed upon this
approval and that violation of any condition shall be the basis
for revocation of the Special Use Permit:
1. A State Highway Access Permit is required prior to
issuance of building permit.
2. The new highway and frontage road should be in place and
functional prior to the opening of the school or a temporary
traffic control plan approved by CDOT.
3. The source (i.e. bulb) of any lighting installed on the
outside of the building must be shielded to shine downward
and away from any adjacent residential structures.
4. Proposed signs require a sign permit. off -site signs are
not permitted.
5. If this specific special use is discontinued, any
replacement use must either be a use -by -right in the Resource
zone or receive special use approval for a special use in the
Resource zone.
6. The proposed, detached multi - purpose room shall not
exceed the square footage footprint of the existing Sunday
School building, shall be one story only, shall not provide
additional classroom space so as to increase enrollment above
150 students, and shall match the architectural theme of the

main school building. Classrooms shall be limited in number
to those shown on the floor plans for the main school
building.
7. The existing driveway must be upgraded to a 16' minimum
width to accommodate two -way traffic and the increased
volume. If a second driveway is installed, it must include a
culvert for drainage.
S. The site plan must be revised prior to building permit
issuance to define the play area with fencing or additional
landscaping.
9. The parking lot will be kept in a compacted, dust free
condition and dust controlling agents applied as often as
necessary. Magnesium chloride is acceptable. Paving of the
lot may be required if the traffic level increases because
the majority of students are not riding the bus but are being
dropped off by private vehicle. This condition shall be
monitored by staff.
10. Handicap ramp surfacing and construction subject to
approval by the Chief Building official.
11. Side setbacks must be revised to reflect 1/2 the height
of the building on the site plan submitted with the building
permit application.
12. Submit evidence (letter or signed lease) that the
parking for this use that is on a separate, adjacent lot will
remain available for use by the school in the event the owner
of the separate, adjacent lot (Basalt Bible Church) sells or
alters the use of said lot prior to issuance of a building
permit.
THAT this permit shall be subject to periodic review by the
Planning Department, and shall be heard by the Board of County
Commissioners only if complaints are received and not
satisfactorily resolved by the staff.
THAT the Board of County Commissioners directs the Director
of the Department of Community Development to provide a copy of
this Resolution to the applicant.
THAT the Board of County Commissioners finds, determines and
declares that this Resolution is necessary for the health, safety
and welfare of the citizens of Eagle County.

NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of the County of Eagle, State of Colorado:
THAT the application of Mountain Top Management, Inc., File
No. ZS- 348 -94, for a Special Use Permit for a multi -user
communications facility within the Resource Zone District and as
described herein, be approved, subject to the conditions as set
forth herein.
THAT the following conditions shall be placed upon this
approval and that violation of any condition shall be the basis
for revocation of the Special Use Permit:
1. Compliance with all BLM conditions of Right -of -Way permit
approval.
2. A permanent height limitation of 20 feet, length of 40
feet and width limitation of 16 feet for the total
facility.
3. Antennae (whip, panel, etc.), satellite dishes and other
apparatus attached to the building tower shall be limited
to 4 feet in diameter.
4. Building and apparatus color shall be of a type that will
not cause glare or reflectivity and blends with natural
surroundings. If glare, reflectivity or obtrusiveness
because of color type occurs, the applicant will amend
the surface treatment to correct the problem.
5. Building location shall be as far back from the ridgeline
as possible while still achieving the communications
coverage necessary and keeping removal of existing
vegetation to a minimum.
6. Additional communications users shall be permitted on the
Mountain Top Management facility without additional
County approval if the additions comply with the above
stipulated height and width limitations, visual impacts
are not increased and necessary approvals are obtained
from the BLM.
7. Acquisition of the appropriate permits (building,
electrical, etc.) from Eagle County.
8. Compliance with Section 2.07.07:
a) All storage of materials shall be within a
building.
b) No dust, noise, odor, glare and vibration shall be
projected beyond the site.
9. All construction materials will be removed from the site.
10. Fire extinguishing devices will be installed in or on the
building.

4. The connection between the existing residence and
the proposed addition must be connected by a
common foundation, must be walled, heated and
considered habitable space as per Sec. 2.05.51 of
the E.C.L.U.R.
THAT, should Applicant not comply with any or all of the
conditions, the Temporary Housing Permit shall be revoked.
THAT, the Board of County Commissioners directs the Department of
Community Development to provide a copy of this Resolution to the
Applicant.
THAT, the Board hereby finds, determines and declares that this
Resolution is necessary for the health, safety and welfare of the
citizens of Eagle County.
