The development of the Resource Protection and Mitigation Plans pertaining to public and private landholdings where development or disturbance is to occur. The resource protection and mitigation plans relate to the following categories. 1. Air Quality 2. Cultural Resources 3. Geology and Soils 4. Noise Management 5. Transportation 6. Vegetation Management 7. Visual Resources S, Wetland Management 9. Wildlife and Fisheries Management 10. Water Resources The major purpose behind the development of the Resource Protection and Mitigation Plans was to document and coordinate the various mitigation actions required of and /or planned by ARRA. The plan was put together at the Corps' request for inclusion into the sdEIS. Previous conditions set forth by the County in the Adam's Rib sketch plan are provided for in this document. E. The development of many diverse technical studies, reports and papers related to the Army Corps of Engineers questions, issues and concerns on project development including: 1. Updated Development Expenses and Project Phasing for final project economic analysis evaluation and reports by the Corps of Engineers. 2. Final Wetland studies and field mapping. 3. Studies and reports: lynx and wolverine, songbirds, waterfowl, and raptor, black bear fall feeding habitat, deer and elk in East Brush Creek. 4. Peat soils evaluation and report in Vassar Meadow. 5.. Responses to various governmental studies. 6. Wetland delineation studies and reports. 7. Uncommon cottonwood trees evaluation and report. S. Feasibility of "Core" area development in the Woodrun area. 9. Site specific geologic analysis relating to the IIat Creek and East Brush Creek debris flows. . 10. Mountain wetland surveys on Adam and Eve Mountain. 11. Geologic review of glacial moraine material. 12. "Uniqueness" analysis of Vassar Meadow Wetlands. 1 Eagle County Board of County Commissioners June 1, 1994 Page Five 13: Wetland minimization issues and related engineering feasibility in Vassar Meadow. 14. Evaluation of wetlands created by artificial irrigation in Vassar Meadow. 15: Development of revised permit application and revised master development plan for Corps wetland minimization purposes. 16. Threatened, Endangered and Sensitive Plant Surveys -Adam and Eve Mountains and East Brush Creek continuing in May and June 1994, around Golf Course and areas of Brush Creek valley. 17. Summary of additional wetland minimization alternatives. 18. Amphibian - boreal toad, salamander and frog- study and report, project -wide to Eagle. 19. Summary of wetland reduction efforts by ARRA. 20. Resort synergism, critical mass and range of resort amenities. 21. Potential impact of Vassar Meadow development to side slope wetlands and Forest Service wetlands. 22. Water quality impacts for selected wetland minimization alternative. 23. Potential significance of uranium and chromium concentrations in wetland soils in Vassar Meadow. 24. Density analysis and comparisons for minimization alternative. 25. Quantitative impacts of withdrawing groundwater from Joe Goode Meadow on side slope wetlands in Vassar Meadow. II. NON -404 PERMIT RELATED A. Development of an updated water quality management plan, submitted to the Colorado Department of Health, Colorado Water Conservation Board in December 1993. B. Submission of the Mountain Master Development Plan for Adam and Eve Mountains to the USFS, including summer mountain usage and integration with the village area in East Drush Creek, in December of 1993. C. Development of a Market Data Review and Project Viability Report for the USFS as a part of the Mountain Master Development Plan in February 1994. D. Preparation and submission to Eagle County in September 1993 of the Adam's Rib Golf Course and Subdivision Revised Sketch Plan. E. Study and siting of one wastewater treatment facility to be located at the Salt Creek site which is located within the Revised Golf Course Sketch Plan PUD. The jurisdiction of the Eagle County Board of County Commissioners is established by C.R.S. § 30 -28 -101 et sea. and the Eagle County Land Use Regulations § 2.06.13 et sec 2. P.U.D. District rezoning is a four step process pursuant to the Land Use Regulations § 2.06.13 et se q. This process involves: (1) sketch plan approval; (2) preliminary subdivision plan approval; (3) preliminary plan approval; and (4) final plat approval. 3. The current Eagle County Land Use Regulations specify subdivision Sketch Plan shall be valid for two years from the date of approval. Eagle County Land Use Regulations §2.17.03. 4. Generally, where a local government has a particular power, the procedures for exercising that power are left to the reasonable discretion of the decision - making body. See Walker v. Jameson 37 N. E. 402 (1894) ; Webb v. City of Meridian 195 S. 2d 832 (Miss. 1967); City of Flordell Hills v. Hardekopf 271 S.W.2d 256 (Mo.App. 1954); Red River Constr. Co. v. City of Norman 624 P.2d 1064 (Okl. 1981). 5. It has been the practice and policy of this Board to extend this P.U.D. Sketch Plan for a period of three (3) years upon public hearing and Board review, and finding of due diligence. 6. Pursuant to the Board's policy and practice, extensions on development approvals are granted where the applicant has shown material progress and due diligence in pursuing the requirements of the development approval. 7. ARRA presented the Board with substantial and competent evidence of material progress and due diligence in pursuing the requirements of the development approval. concl.adm ILj D A EAGLE COUNTY COLORADO IN RE: The Matter of the Extension of the Adam's Rib Recreational Area 1982 P.U.D. Sketch Plan Approval FINDINGS OF FACT AND CONCLUSIONS OF LAMP Now on this 23rd day of August, 1994, the Eagle County POard of County Commissioners ('Board ") considers the Adam's Rib Recreational Area ( "ARRA ") request for extension of approval of its P.U.D. Sketch Plan, originally approved on August 25, 1982. The Board, having duly considered ARRA's request, heard testimony on two different days, and otherwise being fully advised by evidence and statements presented by interested parties and community members, does hereby approve the request for extension and extends approval of the 1982 P.U.D. Sketch Plan for three (3) more years, until August 23, 1997, and makes the following Findings of Pact and Conclusions of Law: IN t. . 1. Eagle County has adopted planning documents and zoning regulations pursuant to the provisions of C.R.S. §§ 30 -28 -101 et seq., and adopted the current Eagle County Land Use Regulations ( "Land Use Regulations") 2. The subject land is currently zoned "R" Resource District. Pursuant to the Land Use Regulations, rezoning from R to "PUD" Planned Unit Development District requires application according to the procedures outlined in Section 2.06.13. 7 3. The Land Use Regulations, Section 2.06.13(1) sets forth the purpose of planned unit development as: To permit application of new technology and greater freedom of design in land development than may be possible under strict interpretation of the provisions of these Regulations. The density of uses and magnitude of development, however, must be of such design and scale to be appropriate and consistent with the character of Eagle County. The use of the PUD provisions is dependent upon the submission of an acceptable plan, a proven favorable environmental impact study (if required), and satisfactory assurances that the plan will be carried out. Such Planned Unit Development plan must be in accord with the County Master Plan as may be currently adopted for the County. Section 2.06.13(1) further provides: The Planned Development is a separate Zone district and, only after specifically and properly applied for, may be approved by the County Commissioners in accordance with the provisions of (the Land Use) Regulations. 4. Pursuant to the Land Use Regulations, the initial submission for P.U.D. District approval is a P.U.D. Sketch Plan. Section 2.06.13(4) sets forth the requirements for an application for P.U.D. Sketch Plan approval. The Sketch Plan is reviewed by the Eagle County Planning Commission and the Eagle County Board of County Commissioners according to the criteria established in Section 2.06.13(5): 1. Resulting development will not be inconsistent with the Master Plan objectives; 2. The area around the development can be planned to be in substantial harmony with the proposed PUD; 3. The adjacent and nearby communities will not be detrimentally affected by the proposed PUD; 4. The PUD can be completed within a reasonable period of time, which shall be determined prior to final approval of the PUD; 5. Any proposed commercial or industrial development can be justified; 6. The streets are adequate to support the anticipated traffic and the development will not overload the streets outside the planned area; 7. Proposed utility and drainage facilities are adequate for population densities and type of development proposed; 8. The employee housing plan as provided is acceptable. 8 5. On August 25,1982, the Board found that the ARRA P.U.D. Sketch Plan met the p requirements of Section 106.13(5) and the Board accordingly approved the P.U.D. Sketch Plan with conditions. Eagle County Board of County Commissioners Resolution No. 82 -95 approving the P.U.D. Sketch Plan is attached hereto as Exhibit "A ". 6. 77te ARRA P.U.D. Sketch Plan approval, as evidenced by Resolution 82 -95 attached hereto as Exhibit "A ", contained 8 major conditions of approval. These conditions included: 1. creation of a P.U.D. development control document; 2. creation of a circulation system plan; 3. consideration of the establishment of a metropolitan water, sewer, fire protection and road maintenance district; 4. provision of employee housing; 5. detailed itemization of all wildlife and environmental mitigation measures; 6. joint planning with the Town of Eagle regarding water and wastewater treatment; 7. addressing the written considerations of the Eagle County Planning Commission and the Eagle County Department of Community Development; and 8. compliance with the preliminary plan requirements. 7. Pursuant to the Land Use Regulations, Section 2.06.13(6), following the submission and approval of the P.U.D. Sketch Plan, the applicant may submit a P.U.D. Preliminary Plan. The Preliminary Plan is approved by the Eagle County Planning Commission and Eagle County Board of County Commissioners according to the criteria established in Section 2.06.13(9): 1. Adequacy of Final Environmental Impact Statement (if required); 2. Any information requested or required by the County Commissioners upon approving the Sketch Plan; 3. Application for appropriate zone change; 4. The PUD control document. Based upon the requirement of criteria 2, an applicant may not proceed with the Preliminary Plan until all of the requirements of sketch plan approval have been met. 8. In June of 1988 and July of 1991, ARRA requested and the Eagle County Board of County Commissioners granted extensions of the P.U.D. Sketch Plan approval originally granted on August 25, 1982. These extensions were granted based upon findings that APRA had made material progress and diligent efforts toward developing the project and addressing the conditions identified at sketch plan review. 9. On June 1, 1994, ARRA requested an extension of the P.U.D. Sketch Plan approval based upon "material progress [shown] toward [ARRA's] goal of a four season destination resort project." (June 1, 1994 letter from ARRA to Eagle County Board of County Commissioners). 10. In consideration of this request, the Eagle County Board of County Commissioners held formal hearings on August 8, 1994 and August 23, 1994, at which interested parties and members of the public were allowed to present evidence and make statements regarding extension of the 1982 Sketch Plan approval. 11. Based upon the evidence and statements presented at these hearings and such other information as was already in front of the Board, the Board makes the following General Findings. 12. For the past three years, since the July 1991 extension approval, ARRA has undertaken to mat the conditions of the 1982 P.U.D. Sketch Plan approval. In furtherance of this project, ARRA has, among other things: A. Fully participated in the creation of a supplemental draft environmental impact statement ( "WM ") with the Army Corps of Engineers and the United States FWvst Service. B. Developed a Resource Protection and Mitigation Plan addressing public and private Iandholdings where development will affect the following: air 10 quality; cultural resources; geology and soils; noise management; transportation; vegetation management; visual resources; wetland management; wildlife and fisheries management; water resources. C. Completed and/or updated numerous technical studies, including but not limited to. Development Expenses and Project Phasing, Wetland Studies and Field Mapping; Studies and Reports for lynx and wolverines, songbirds, waterfowl and raptor, hlademar, and deer and elit: Vassar Meadow Peat Soils Evaluation and Report; Wetland Delineation Studies and Reports; Feasibility of Core Area Development in Woodrun Area; Site Specific Geologic Analysis Relating to the Fiat Creek and But Brush Creek Debris Flows; Mountain Wetland Surveys on Adam and Eve Mountain; Geologic Review of Glacial Moraine Material; "Uniqueness" Analysis of Vassar Meadow Wetlands; and Responses to Various Governmental Studies. D. Developed an updated Water Quality Management Plait that was submitted to the Department of health, Colorado Water Conservation Board in December 1993. E. Developed a Market Data Review and Project Viability Report for the United States Forest Service. F. Submitted to the United States Forest Service the Mountain Master Development Plan for Adam and Eve Mountains, in December of 1993. (included in Exhibit "C ", Exhibits presented to Board on August 8, 1994; cited in June 1, 1994 letter from ARRA to Board requesting extension). 13. Beginning at the time of the original sketch plan approval in 1982, ARRA has worked diligently and continuously toward the completion of the requirements set out in that approval. ARRA submitted as evidence to the Board a partial Chronology of its actions undertaken in completion of the 1982 Sketch Plan conditions. The Chronology reflects the diligent and continuous nature of ARRA's actions. This Chronology is attached Exhibit "B" and incorporated herein by reference. 11 S 14. In support of the Chronology, ARRA introduced at the August 23, 1994 hearing additional evidence of progress toward the completion of the Sketch Plan conditions, both prior to and following the 1991 extension, as further described in Exhibit "C ", i. ^.eluding but not limited to documents, mans and litigation materials. 15. No substantive or competent evidence was presented to the Board contravening ARRA's evidence of material progress and due diligence. 12 r \adams.12 CONCLUSIONS OF LAW 1.
