Board of Health Bylaws
The Colorado Public Health Act of 2008 (“the Act”), Colorado Revised Statutes (C.R.S.) §25-1-501, et
seq., was established by Colorado General Assembly to improve the performance of the public health
system statewide and establish duties and roles for local Boards of Health.
The Eagle County Board of County Commissioners (“BoCC”) serve as the Board of Health (“BoH” or “the
Board”) for Eagle County Public Health and Environment (“ECPHE” or “Department”), in compliance with
the Act. As such, the Board and the Department shall have jurisdiction over all areas within Eagle
County, including municipalities, as provided by law.
These bylaws shall act as guidance for the BoH with respect to the internal management, government,
and procedures of the Board. Nothing contained herein shall be construed to conflict with Colorado
State Statutes or any other applicable law or regulation.
BoH Membership
Boards of Health in Colorado will typically consist of five appointed community members. For Counties
with a population of less than 100,000, a three-member Board may be appointed or the BoCC may
designate itself as the county BoH if there was not a separate Board of Health prior to the effective date
of the Act.
Eagle County’s population in 2022 is estimated at 55,730 and the commissioners will serve ex officio as
members of the BoH unless or until it is determined by a majority vote that an independent Board
should serve in this capacity. The term for each BoH member will coincide with their term as a BoCC
member.
BoH Responsibilities
The Board will act in accordance with the full list of duties and responsibilities set forth in C.R.S. 25-1-
508. A short list of key responsibilities of the Board are provided below:
● Appoint a Public Health Director (“Director”).
● Ensure there is a properly qualified Medical Officer in the event the Public Health Director is not
a physician.
● Hold public hearings as necessary to adopt local rules or regulations that protect or promote
public health.
● Advise the Public Health Director as necessary.
● Approve a five-year local public health plan, and then submit to the State Board of Health for
review.
● In consultation with the Director, adopt or advocate for policies that guide the work of the
Department to best protect the health of the community and environment in Eagle County.
● Provide financial oversight and ensure resources are available to perform the necessary public
health activities for the community.

● Complete the required trainings annually provided by the Colorado Department of Public Health
and Environment (CDPHE) that outlines the responsibilities and expectations of Boards of
Health.
● Follow state guidelines on conflict of interest matters.
BoH Officers
The current chair for the BoCC will serve as the Chair for the BoH.
The BoH shall appoint a Director who shall also serve as Secretary to the Board. The Director shall
possess such qualifications as may be prescribed by the State of Colorado (“State”) and State Board of
Health. The Director shall not be a member of the BoH but may serve in the capacity of Secretary for the
Board.
Quorum
A majority of Board members (i.e. a minimum of two members) present at BoH meetings shall
constitute a quorum. For purposes of these bylaws, “present” shall mean a member is in attendance
physically or remotely.
Conduct of Meetings
All BoH meetings shall be conducted in accordance with C.R.S. §24-6-401, as amended (“Colorado Open
Meetings Law”). As required by the Colorado Open Meetings Law, all BoH meetings shall be open to the
public whenever there is a quorum of members present and at which any public business is discussed or
at which any action may be taken. This does not, however, apply if the meeting is a chance meeting or
social gathering of Board members at which discussion of public business is not the central purpose, or if
it is an executive session held in compliance with the Colorado Open Meetings Law.
Meeting Notices
The posting of BoH meeting notices shall be conducted in accordance with the Colorado Open
Meetings Law and all Eagle County meeting posting requirements.
Meeting Schedule
Regular BoH meetings will be held at least once every three months or as otherwise deemed
necessary by the Chair.
Special Meetings
Special BoH meetings may be called at the discretion of the Chair or the Director or a majority of
Board members, and notice to the public is provided in accordance with the Colorado Open
Meetings Law.
Record of Proceedings
The BoH shall electronically record the minutes of its meetings in accordance with the
requirements of C.R.S. § 24-6-402(2)(d.5)(II).
Finances
The BoH shall adopt an operating budget annually for ECPHE based upon available funds and Board-
approved program priorities for the Department.
Amendments
These bylaws may be amended at any regular BoH meeting by a majority vote of Board members.
Proposed amendments must be submitted to Board members no less than three days prior to the BoH
meeting at which the bylaw amendments shall be considered for approval.
