HomeMy WebLinkAboutC22-298 Eagle Valley Behavioral Health MEMORANDUM OF UNDERSTANDING Between Eagle County and Eagle Valley Behavioral Health For Permanent Supportive Housing Case Management THIS MEMORANDUM OF UNDERSTANDING ("MOU") is entered into effective as of _______________ by and between Eagle County, Colorado (“County”) and Eagle Valley Behavioral Health, (“EVBH”) collectively referred to herein as “the Parties” establishing a cooperating agency relationship, providing a framework for cooperation, coordination and documenting procedures, roles and responsibilities associated with Permanent Supportive Housing between Eagle County Department of Human Services (DHS) and EVBH. PURPOSE The purpose of this MOU is to coordinate duties and responsibilities of agencies involved in receiving and vetting applications for tenants, attending briefing meetings, providing case management services to tenants and assisting with annual recertifications for tenants for Permanent Supportive Housing. RECITALS WHEREAS, DHS and EVBH identified the need for ongoing case management services to support tenants that participate in the Permanent Supportive Housing Program; and WHEREAS, County wants to provide the Eagle County community a permanent supportive housing, and WHEREAS, EVBH has the skills and experience to ensure a warm handoff of clients and to provide monthly case management services, and WHEREAS, DHS and EVBH intend to provide coordination to ensure that tenants are receiving ongoing direct services to provide a continuum of care and eliminate barriers and gaps in services by this MOU and shall further provide that each agency shall maintain the confidentiality of the information exchanged in the operation of case management services. NOW, THEREFORE, in consideration of the foregoing premises, EVBH and County memorialize their understanding as follows: UNDERSTANDING: DocuSign Envelope ID: 3DA98307-FB37-4524-80BB-D5911644C907 9/1/2022 1. ADMINISTRATION OF MOU: a. This MOU becomes effective upon signature by the authorized officials of the Eagle County and EVBH. b. This MOU may be amended through written consent of the Parties. c. Any Party may end its participation in this MOU by providing written notice to the other party. d. Nothing in this Agreement shall substitute or represent a change in either Parties legally mandated responsibilities. e. The Parties to this MOU do not intend to benefit any person not a party to this MOU. Nothing in this MOU is intended to create or grant to any third party or person any right or claim for damages, or the right to bring or maintain any action at law. f. The Parties acknowledges that they will not receive compensation or funding from any other Parties for the services set forth herein. g. Nothing contained herein shall be construed as a waiver by Eagle County of any immunity at law including immunity granted under the Colorado Governmental Immunities Act. h. This MOU is not intended to create any agency or employment relationships between the Parties hereto nor is it intended to create any third party rights or beneficiaries. i. This MOU shall be subject to the laws of the State of Colorado, and to the rules and regulations promulgated thereunder, whether now in force or hereafter enacted or promulgated; and nothing herein shall be construed as in any way affecting or waiving the jurisdiction, responsibility, or existing rights of any signatory party to this MOU. 2. RESPONSIBILITIES: a. The parties’ designee is responsible for informing internal and external partners that a vacancy exists. b. The parties’ designee is responsible for reviewing the applications for completeness and meeting criteria for tenancy. DHS will work with the referring agency to ensure all necessary documentation is provided. c. The parties’ designee is responsible for submitting the completed application to the Garfield Housing Authority staff for review and approval. d. The parties’ designee is responsible for communicating with the referring agency, Garfield Housing Authority, and EVBH (EVBH@vailhealth.org) to schedule the briefing. e. EVBH will communicate with the referring agency to ensure a warm handoff takes place between the referring agency and EVBH case managers at the time of the briefing or before. f. EVBH will attend the briefing with the tenant and ensure the briefing packet is completed by or with the tenant and submitted to Garfield Housing Authority in a timely manner. DocuSign Envelope ID: 3DA98307-FB37-4524-80BB-D5911644C907 g. EVBH will primarily conduct monthly contacts with the tenants. Contact with clients can be completed quarterly based on client needs. These contacts can be by phone, virtual, or in person. h. EVBH will assist tenants with the annual recertification process when needed. i. DHS and EVBH will attend the Permanent Supportive Housing Agency Check- ins, which may occur monthly. 3. CONFIDENTIALITY a. ECDHS and EVBH may share tenant information between the two parties with the appropriate Releases of Information signed to include, but is not limited to the name and address tenant, members living in the unit, and any other information that is pertinent to conduct community-based case management services to assist the tenant remain compliant with the Permanent Supportive Service Program requirements.
