HomeMy WebLinkAboutR94-129 adopting motor pool policyCommissioner ( moved adoption of the following R olution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 94 - 10 0 1 ADOPTING THE EAGLE COUNTY MOTOR POOL POLICY, AS AMENDED WHEREAS, pursuant to Section 30- 11- 107(a), C.R.S., the Board of County Commissioners of the County of Eagle, State of Colorado (hereinafter the "Board "), is empowered to manage the business and concerns of the County in all cases where no other provisions are made by law; and WHEREAS, pursuant to Section 30- 11- 107(b), C.R.S., the Board is empowered to care for the property of the County in all cases where no other provisions are made by law; and WHEREAS, pursuant to the aforesaid statute, upon the adoption of the motor pool policy by the Board, said policy shall become binding upon the employees of the County; and WHEREAS, on March 28, 1994 by Resolution No. 94 -34 the Board adopted the Motor Pool Policy and hereby desires to amend it; the changes are incorporated into the previously existing Motor Pool Policy, see the attached Exhibit "A ". WHEREAS, the Board desires to adopt the amended policy to be referred to and cited as the "Eagle County Motor Pool Policy ", hereinafter referred to as the "Motor Pool Policy" and to make said Motor Pool Policy and the provisions contained therein available to all County employees; and NOW, THEREFORE, be it resolved by the Board of County Commissioners, County of Eagle, State of Colorado: THAT, the Board hereby adopts the "Eagle County Motor Pool Policy" as amended, as set forth in Exhibit "A ", attached hereto and incorporated by this reference. THAT, the Motor Pool Policy shall apply and shall be binding upon all County employees paid in whole or in part by the County. THAT, upon approval and adoption of this Resolution, any and all existing or previously adopted Motor Pool Policies not reflected in this Resolution shall be and are hereby superseded by this Resolution. THAT, to the extent that any of the Motor Pool policies address and pertain to personnel issues, those provisions shall be incorporated into the Personnel Policies. THAT, the provisions of this Resolution and the Eagle County Motor Pool Policy are severable. If any section, sentence, clause or phrase therein is adjudged by a court of competent jurisdiction to be invalid, the decision shall not affect the validity of the remaining portions of this Resolution and /or the Eagle County Motor Pool Policy. THAT, the board hereby finds, determines and declares that this Resolution is necessary for the public health, safety and welfare of the residents of the County of Eagle, State of Colorado. Employees who violate these policies are subject to disciplinary actions, up to and including termination. Employees must operate County vehicles in accordance with all local, state and federal laws. All County employees are to be aware that the County insurance and governmental immunity may apply only when County vehicles are used with permission, within the scope of duties. These policies and procedures may apply to County employees using their own vehicles for County business, unless otherwise stated. These policies and procedures attempt to anticipate as many as possible of the various situations which require rules and regulations. Other situations will arise which have not been previously experienced or could not have been anticipated, and are therefore not addressed herein. Contact the Fleet Supervisor any time you have a question. �. t f 2 Vehicle Assignment and Use A. General Use of County Vehicles nx3 1. The operation of a County vehicle is a privilege which may be withdrawn at any time by the Board of County Commissioners. Use of County vehicles is limited to County employees, who by the nature of their duties, have a need to use County vehicles to accomplish their job, as determined by their Elected Official or Department Director. 2. Eagle County classifies its positions with regard to the need to use a County vehicle for County business, as: Non - driving (never driving on County business); Marginal (occasional use, driving not essential to job functions); and Essential (vehicle use required to perform job functions). Annual Motor Vehicle Record (MVR) checks are run on all County employees in positions classified as Essential driving positions to assure that they have an acceptable driving record. Effective March 21, 1994 (and not intended to be retroactive), a driving record is considered unacceptable if: -it shows twelve (12) points or more of violations within the last three years; or -one alcohol- or drug - related driving conviction within the last three years Violations or convictions which occurred prior to the adoption of this policy will not be considered. The three years referred to above began as of March 28, 1994 . If an employee's MVR shows an unacceptable driving record, the situation will be reviewed by the employee's Department Director or Elected Official; they will determine what action will be taken, up to and including termination. If a Department Director's MRV shows an unacceptable driving record, the situation will be reviewed by the County Manager /Attorney. If the County Manager or County Attorney's MVR shows an unacceptable driving record, the situation will be reviewed by the Board of County Commissioners. An employee in a position where driving is an essential function of that job who has their driver's license suspended or revoked are subject to disciplinary action, up to and including suspension or termination. Q Any employee convicted of an alcohol or drug - related offense which occurred while driving a County vehicle, or while in any vehicle on County business, will be subject to disciplinary action, up to and including termination. An employee or an applicant for employment in positions where driving is essential will be subject to a drug test administered after an offer of employment is made but before employment begins and random drug testing while employed. (See Drug- Testing Policy.) Employees subject to federally mandated drug testing will be tested in accordance with those requirements. Eagle County will run a Motor Vehicle Record (MVR) check on applicants for employment for positions that require driving as an essential function of the job. If the applicant's driving record is unacceptable (see above), they will no longer be considered for employment in that position. For applicants, the three years referred to above date back to three years prior to their making application for this position. 3. In addition to #2 above, all County employees who operate County vehicles 11MIA a. Maintain a valid Colorado driver's license appropriate to the kind of vehicle being operated, and comply with all associated rules, regulations and standards associated with the privilege of operating a motor vehicle in Colorado. b. Be responsible for reporting all accidents and violations of these policies and procedures. c. Safeguard the vehicle and its passengers from accidents, damage, and abuse to the reasonable extent of their ability to do so. d. Wear seat belts at all times when operating a vehicle and insure that all passengers do so as well. e. Perform limited maintenance (i.e., observing damage, keeping the vehicle interior clean, etc.). f. Keep the Fleet Supervisor informed on a regular basis of the condition of vehicles and cooperate to ensure that the vehicles are delivered for preventive maintenance and inspection whenever repairs are scheduled or required. n B. County Vehicles Policy 1. Operating a vehicle while using or while under the influence of drugs or alcohol which are illegal or which impair the operator's ability is strictly prohibited. Please refer to Drug Free Workplace policy in the Employee Handbook. 2. County vehicles shall be used for County business only and cannot be used for personal use without the express written permission of the Board of County Commissioners, employees Department Director or Elected Official. 3. Persons not employed by the County are not permitted to drive or ride in a County vehicle, unless on official County business or as approved by the County Manager or the BOCC. 4. Pets are not to be carried in or on any County vehicle, except for the purpose of Animal Control, the Sheriff's canine unit, or with the written permission of the BOCC. 5. Smoking is not permitted in County vehicles. 6. A vehicle in the General Motor Pool must be refueled before being returned to the Motor Pool if the fuel tank is not more than three - quarters full. Vehicles must be refueled at one of the County fuel tanks, at the Eagle Yard or El Jebel Yard, unless refueling is necessary on an out -of- county trip or in the event of an emergency. A map of County refueling facilities is located in the check -out book for each vehicle. Refueling hours for the winter are 8:00 a.m. - 5:00 p.m.; summer hours are 7:00 a.m. to 5:30 p.m. If the vehicle cannot be refueled during the above hours, please refuel the next morning prior to returning book and keys to the Information Booth. The following are instructions for operating the County's fuel pumps: 1. Enter your employee number 2. Enter the vehicle number 3. Enter odometer (mileage) reading from vehicle 4. Enter department number 5. Enter pump number - 1 or 2 `Note: This means you will need all these numbers handy when you fuel a vehicle. 11 7. If an employee or a department has a County vehicle assigned to them for long -term use, it is the employee or department's responsibility to keep the vehicle fueled and to notify the Fleet office of any damage, breakdowns, or mechanical problems. C. Motor Pool Vehicle check -out and return procedure: 1. Vehicles will be checked out from the Information Booth in the County Administration building after 8:00 a.m. and should be returned prior to 4:30 p.m. each work day unless otherwise approved by the appropriate Department Director. 2. After use, all vehicles from the general motor pool must be returned to the designated motor pool parking lot, backed into the assigned space, locked and the keys and book returned to the Information Booth. D. Preventive Maintenance Procedures for County vehicles 1. Damage, breakdowns or mechanical problems shall be reported to the Fleet Supervisor as soon as possible. Instructions for after -hours vehicle problems can be found in the vehicle's check -out book. The last person to have checked out a vehicle may be held responsible for all unreported problems or damage not previously noted. 2. The interior of the vehicle should be kept clean at all times. It is the driver's responsibility to remove any trash from the vehicle before returning it to the parking lot. R Safety A. Vehicle Safety 1. Loss and accident prevention is the responsibility of all County employees. The BOCC expects the aggressive support of all County employees in accomplishing the goal of reduced losses. The personal safety of all employees is of primary importance. The County seeks to provide the safest possible working conditions, proper safety equipment, job instruction and proper supervision of safe work performance. To that end, the Motor Pool seeks to provide County employees with vehicles in good working condition so that they may carry out their duties in a safe and efficient manner. County employees are directed to comply with all safety regulations and procedures in the course of operations of County vehicles. No vehicle in the custody of any user should knowingly be returned to service in an unsafe condition. Any unsafe practices or conditions observed by County employees shall be immediately reported to the Fleet Supervisor. 2. County employees involved in an accident in a County vehicle may be required to attend a Defensive Driving training course. B. If the ability to drive is essential to your job, all traffic violations potentially resulting in suspension and /or revocation of your driver's license or any charges involving drugs or alcohol must be reported in writing to the appropriate elected official or department director immediately. 1. All other citations received for violations occurring while operating a County vehicle must be reported to the appropriate elected official or department director within five days of the date of conviction thereon. 2. The driver of a vehicle is responsible for all fines and related costs and expenses for parking and /or traffic tickets received while operating the vehicle, except for tickets resulting from faulty equipment which is the responsibility of the County. 7 What to do if you are involved in an accident: 1. If you are qualified and able to do so, render aid to the injured; first aid kits and fire extinguishers are located in the trunk of the vehicle. 2. Refer to the accident kit and the instructions that are in the glove compartment of every vehicle. 3. Do not leave the scene or move the vehicle until the law enforcement agency involved has completed their investigation or until they ask you to move it. If vehicles are creating a definite hazard, move them after noting their location. 4. Notify State Patrol or local policy authority, and then notify the Fleet Supervisor at 328 -8831 during office hours. For after hours emergencies, see attached call list. The Fleet Supervisor will determine if it is necessary to call for the Eagle County Car Carrier to have the vehicle towed. 5. Do not admit or deny liability to anyone. Do not discuss the accident with anyone other than police authorities or an authorized representative of Eagle County government. 6. Get the required information from the other driver: driver's license number, insurance carrier, etc., and give the other driver the required information. 7. Cooperate and comply with the instructions of any law enforcement, fire, or medical personnel. 8. Get the investigating officer's name, department, badge or identification number. 9. An accident report must be filed with the Motor Pool division on all accidents involving County owned vehicles within twenty -four hours. You will need to have the following information: exact location, hour, date of accident, road and weather conditions, names and addresses of all witnesses and passengers, and the extent of any vehicle damage. 10. A law enforcement official or the county may require you to have a drug or alcohol test following an accident or traffic violation. Results of such a test could be used to determine what, if any, disciplinary action is warranted. DEPARTMENT OR OFFICE POLICIES Because of the specialized needs or duties of individual offices they may need a specialized policy for assigned vehicles. As to vehicles assigned to individual departments those departments may adopt their own departmental or office motor pool policy which shall govern the operation of those assigned vehicles. A copy of this policy shall be provided to the Board of County Commissioners and the Fleet Supervisor. In case of any conflict between the Office or Departmental Vehicle Use Policy and the General Motor Pool Policy, the specific policy shall govern. All Department or Office specific policy shall, prior to the adoption, be provided to the County Attorney and the Human Resources Director for review and comment. All Departmental Policies shall at a minimum include the provisions of Section A of the General Use of County Vehicles, Section B, except paragraph 6, and Section D paragraphs 1 and 2. The entire section on safety shall be included in the departmental policy. Departments may adopt additional provisions and more restrictive provisions as required.
