SU- 325 -94 -5 WHEREAS, os: ;:..gout June 15, 1994, the County of Eagle, State of Colorado, - for filing an application submitted by Charles M. Palmer ;hereinafter "Applicant ") for approval of the Subdivision Sketch Plan for the Palmer Subdivision, File No. SU- 325 -94 -5; and, WHEREAS, the Applicant requested the approval of a Subdivision Sketch Plan which would allow for the development as follows: the subdivision of 44.93 acres into four 10+ acre single family parcel in accordance with the Agricultural Residential Zone District; and, WHEREAS, notice of the Sketch Plan was given to all proper agencies and departments as required by the Eagle County Land Use Regulations, Section 2.17.02(1); and, WHEREAS, at its public hearing /hearings held July 20, 1994, the Planning Commission, based upon its findings, recommended approval of the proposed Subdivision Sketch Plan, with certain conditions; and WHEREAS, at its regular hearing of August 2, 1994, the Eagle County Board of Commissioners (hereinafter "Board "), considered the Subdivision Sketch Plan, associated plans, and the statements and concerns of the Applicant, the Eagle County Community Development and Engineering staff, and other interested persons. BASED ON THE EVIDENCE BEFORE IT, and with the modifications imposed by the conditions hereinafter described, THE BOARD FINDS AS FOLLOWS: 1. The proposed Sketch Plan is in conformance with the Master Plan, policies, guidelines, zoning and other applicable regulations. 2. The land included in the proposed Sketch Plan is suitable for subdivision. SU- 325 -94 -S WHEREAS, on or about June 15, 1994, the County of Eagle, State of Colorado, accepted for filing an application submitted by Charles M. Comments and recommendations from the agencies listed in Eagle County Land Use Regulations, Section 2.17.02(1), have been considered. 4. The evidence shows that access which is capable of servicing the development from the state highway system to the parcel of land proposed for subdivision can be built by the Applicant. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the application for approval of the Subdivision Sketch Plan for the Palmer Subdivision be and is hereby granted, subject to compliance with the following conditions: Adequate evidence of a water supply that is sufficient in terms of quality, quantity and dependability will be available. An analysis of the cumulative impacts on existing and potential future users. Adequate evidence that the existing physical supply as well as the legal rights will not be harmed. Conformance with Section 30- 28- 133(3)d) and 30 -26 -136, C.R.S. 1973 and Section 2.18.01(4)m)l), Eagle County Land Use Regulations (E.C.L.U.R.). Approval from the Water Court regarding the application for water rights and approval of augmentation plan; 2. Adequate evidence that ISDS is or can be made suitable for each lot and that the additional loading will not have any affects off -site. This may mean soil profile investigations, percolation tests and /or systems specifically designed for each lot. 3. An adequate fire mitigation plan, both "in home" and wildfire; 4. Adequate restriction details concerning but not necessarily limited to bear -proof trash containers, dog and fence restrictions, building envelopes and livestock. A raptor survey should be performed and it is requested that the applicant partake in the wildlife mitigation trust fund as part of a wildlife mitigation plan. This plan should be incorporated into the covenants. 5. School land dedication fees based upon the relevant Precinct at final plat. Appropriate off -site road impacts at final plat. 0 r_ � 7. County Engineer concerns as outlined in a memo dated July 14, 1994 from Engineering to planning. THAT, the Sketch Plan submitted under this application and hereby approved, does not constitute a "site specific development plan" as that phrase is defined and used in C.R.S. Section 24 -68 -101, et seq. Sketch Plan approval is expressly conditioned on the County's authority to impose further restrictions or limitations on the Subdivision which are necessitated by impacts which are not yet recognized or which are more severe than realized under the review given at the hearings on the Sketch Plan. THE BOARD further finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado.
