HomeMy WebLinkAboutR94-112 second partial release for Codillera filing 3Commissioner 6;a& moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO �< RESOLUTION NO. 94- SECOND PARTIAL RELEASE OF COLLATERAL Filing 3 CORDILLERA SUBDIVISION WHEREAS, pursuant to C.R.S. 30 -28 -137, the Board of County Commissioners of the County of Eagle, State of Colorado ( "Board ") entered into a Subdivision Improvements Agreement dated August 10, 1993 ( "Agreement ") with Kensington Partners, a Colorado General Partnership ( "Subdivider "), as a condition of final plat approval for Filing 3, Cordillera Subdivision; and WHEREAS, the Subdivider provided collateral in the form of a plat restriction to guarantee the faithful completion of the public improvements in the project; and WHEREAS, by Resolution Number 93 -114 Subdivider substituted collateral by Irrevocable Letter of Credit No. 59180359 issued by the New York Branch of Berliner Handels -und Frankfurter Bank ("BHF- Bank") in favor of JLP Realty Corp. in the amount of $444,869.99; and WHEREAS, by Resolution Number 94 -06 the Board approved a reduction in collateral in the amount of $350,771.67 leaving a balance of $94,098.32 which was collateralized by Irrevocable Letter of Credit Number 59180359. WHEREAS, Subdivider has represented to the Board, and members of the County staff have corroborated the Subdivider's representations, that further improvements required under the Agreement have been partially completed in a satisfactory manner (Exhibit A) and therefore Subdivider has applied for a second release of collateral; and ea WHEREAS, the Subdivider has requested a reduction in the amount of $10,420.11, leaving a balance of $83,678.91 to be CD collateralized under a new Letter of Credit acceptable to the Board (Exhibit B). 543543 B -647 P -501 08/10/94 05:28P PG 1 OF 7 Sara J. DOC 0.00 r 3 Based upon the oral and written recommendations of the Department of Engineering, THE BOARD FINDS that the Subdivider's obligations under the Agreement have been partially satisfied, and a further reduction in the collateral held by the Board is warranted. THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Board hereby collateral in the amount of collateral to $83,678.21. authorize the partial release of $10,420.11, thereby reducing the THAT, the Board hereby accepts Letter of Credit No.S9180359 in the amount of $83,678.91. THAT, the partial release of collateral granted hereby shall not in any way abrogate the rights of the Board in enforcing the Subdivider's performance of his outstanding obligations under the Agreement.
