HomeMy WebLinkAboutR94-108 director of DSS to execute small provider contracts� f t Commissioner J.4 ' gfi'% , IA moved adoption of the following he Iution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 94 - - /Ce AUTHORIZING THE DIRECTOR OF THE EAGLE COUNTY DEPARTMENT OF SOCIAL SERVICES TO EXECUTE SMALL PROVIDER CONTRACTS AND INDIVIDUAL MENTAL HEALTH PROVIDERS UNDER THE HUMAN SERVICE GRANT PROGRAM WHEREAS, the Eagle County Department of Social Services ( "ECDSS ") does from time to time have Small Provider Contracts submitted to them such as the Eagle County Family Preservation Program and the individual mental health providers under the Human Service Grant Program; and WHEREAS, the Director of the ECDSS would be the person most likely to execute these contracts on behalf of the ECDSS; and WHEREAS, the form of the contract to be signed by the Director is attached hereto as Exhibit A; and WHEREAS, the Director seeks authority from the Board of County Commissioners to execute these contracts; and WHEREAS, the Board is desirous to designate the Director of the ECDSS as its authorized representative to execute said contracts. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Board hereby adopts the form agreement for Small Provider Contracts as the same is set forth in Exhibit A attached hereto. Gates This Resolution passed by ,7 — O vote of the Board of County Commissioners of the County of Eagle, State of Colorado. r \ECDSS.spc PURCHASE OF SERVICE CONTRACT EAGLE COUNTY FAMILY PRESERVATION PROGRAM 1. THIS CONTRACT, made this day of , 1994, by and between the Eagle County Department of Social Services, hereinafter called "County" and , (address) (tax ID or Social Security number), hereinafter called "Contractor ". 2. This Contract will be effective from June 1, 1994 until May 31, 1995. 3. County agrees to purchase and Contractor agree to provide Intensive Family Therapy to children and families referred by the County in accordance with the service'described in Staff Manual Volume 7, Section 7.503 Family Preservation Program and summarized in the attachment to this contract. 4. County agrees to purchase and Contractor agrees to furnish hourly Units of Service at a cost of $40 /hour for Intensive Family Therapy for a maximum amount of this contract of $ 2000. 5. The parties agree that the Contractor's relationship to the county is that of an independent contractor. 6. The parties agree that payment pursuant to this Contract is subject to and contingent upon the continuing availability of fund for the purpose thereof. 7. County agrees: a. to determine child eligibility and as appropriate, to provide information regarding rights to fair hearings b. to provide contractor with written prior authorization on a child or family basis for services to be purchased. c. to provide Contractor with referral information including name and address of family, social medial and educational information as appropriate to the referral. d. to assess and collect fees as appropriate. e. to monitor the provision of contracted service. f. to pay Contractor after receipt of billing statements for services rendered satisfactorily and in accordance wit this Contract. 8. Contractor agrees: a. not to assign any provision of this Contract to a subcontractor. b. Not to charge clients any fees relation to services provided under this Contract. EXHIBIT c. to hold the necessary license(s) which permits the performance of the service to be purchased, and /or to meet applicable Sate Department of Human Services qualification requirements. d. to comply with the requirements of the Civil Rights Act of 1964 and Section 504, Rehabilitation Act of 1973 concerning discrimination on the basis of race, color, sex, age, religion, political beliefs, national origin, or handicap. e. to provide the service described herein at cost not greater than that charged to other persons in the same community. f. to submit -a billing statement in a timely manner, no later than 45 days after services. Failure to do so may result in nonpayment. g. to safeguard information and confidentiality of the child and the child's family in accordance with rules of the Colorado Department of Human Services and the Eagle County Department of Social Services. h. to provide County with reports on provision of service as follows: > Within 30 days of enrollment /participation, submission of a treatment plan for the child /child's family with specific objectives and target dates. The treatment plan is subject to county approval. > At monthly intervals from the time of enrollment/ participation, submit reports that include progress and barriers in achieving provisions of the treatment plan. i. to provide access for any duly authorized representative of the County or the Colorado Department of Human Service until the expiration of five (5) years after the final payment under this Contract, to examine any financial, program, and other records of the Contractor involving transactions related to this Contract. j. indemnify Eagle County, Colorado Department of Human Services and the State of Colorado against any liability and loss against all claims and actions based upon or arising out of damage or injury, including death, to persons or property caused or sustained in connection with the performance of this Contract or by conditions created thereby, or based upon any violation of any statute, regulation, and the defence of any such claims or actions. 9. Termination: Either part may terminate this Contract by thirty (30 days prior notification in writing. EAGLE COUNTY SOCIAL SERVICES DATE CONTRACTOR DATE - 9 EAGLE COUNTY DEPARTMENT OF SOCIAL SERVICES FAMILY PRESERVATION PROGRAM : STATEMENT OF ASSURANCES assures that the following will be adhered to in the provision of Family Preservation Services: 1. operation for each service provided will be in conformity with the State rules governing that service, including: • scope of service and method of service delivery • service objectives • frequency of service and workload standards • staff qualifications • supervisory standards 2. operation will not discriminate against any individual on the basis of race, sex, national origin, religion, age or handicap who is referred for Family Preservation Services. 3. Services will recognize and support cultural and religious background and customs of children and their families. 4. Services provided under the Family Preservation Program are not available to children and families through other publicly funded efforts. 5. Services provided under the Family Preservation Program will be documented in monthly reports of service progress; dates of service and service units provided. 6. Information regarding services purchased and compliance with operational standards will be made available for program and financial monitoring. Name Date Agency
