Sopris Tree NurseryCommissioner moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 94- /0/ AUTHORIZING EAGLE COUNTY TO OFFER MINING CLAIMS PROPERTIES TO THE UNITED STATES IN EXCHANGE FOR THE MOUNT SOPRIS TREE NURSERY AND AUTHORIZING THE CHAIRMAN TO EXECUTE ANY DOCUMENTATION NECESSARY TO EFFECT THE EXCHANGE WHEREAS, the United States is the owner of certain lands located in Eagle County known as the Mount Sopris Tree Nursery and Eagle County is the owner of approximately 49 acres of patented mining claims located in Eagle County, and attached hereto as Exhibit "A ". Pitkin County is the owner of numerous patented mining claims totaling approximately 1258 acres located in Pitkin County, Colorado. WHEREAS, the Mount Sopris Tree Nursery lands were slated for disposal by the United States. Both Eagle and Pitkin Counties desire to obtain these lands to provide public recreational facilities and preserve open space in the area. The mining claims lands owned by the Counties are valuable National Forest in- holdings some of which lie in designated Wilderness areas. WHEREAS, legislation to effect an exchange of lands between the United States and Eagle and Pitkin Counties was introduced in 1992. The Act to provide for a land exchange between the United States Secretary of Agriculture and Pitkin and Eagle Counties became Public Law 103 -225 on May 19, 1994. WHEREAS, pursuant to the Act, the Counties shall offer to transfer the subject mining claims to the United States within 90 days of enactment of Public Law 103 -225. The United States shall convey the Mount Sopris Tree Nursery lands to the counties within 90 days after receipt of a quitclaim deed by the Counties to the properties. 1 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Board of County Commissioners of Eagle County hereby offers the patented mining claim properties described on Exhibit "A" to the United States and authorizes the Chairman to execute any and all documents to effectuate the Land Exchange.
