COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 94 -
' ACCEPTING CERTAIN IMPROVEMENTS AS COMPLETE in re
THE ALPINE BANK BUILDING, EL JEBEL AND
AUTHORIZING RELEASE OF THE COLLATERAL
WHEREAS, on or about February 14, 1994 the Board of County
Commissioners of the County of Eagle, State of Colorado
(hereinafter "the Board "), entered into an Construction
Improvements Agreement ( "Agreement ") with Alpine Bank of Basalt
(hereinafter "Builder ") for landscaping improvements to be
installed at the temporary location of the Alpine Bank Building, E1
Jebel; and
WHEREAS, pursuant to the terms of said Agreement, Builder
provided collateral to the Board to guarantee faithful completion
of certain landscape improvements for the Alpine Bank Building, E1
Jebel, said collateral in the form of Letter of Credit No. 93,
Alpine Bank, Basalt in the amount of $1013.90; and
WHEREAS, the Builder has represented to the Board, and members
of the County staff have corroborated the Builder's
representations, that all the landscape improvements required under
the Agreement have been satisfactorily completed and the
requirements of the Construction Improvements Agreement dated
February 14, 1994 have been satisfied, see the attached Exhibit
"A"; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, based upon written recommendations of the Building
Department, the Board finds that the Builders's obligations under
the Agreement have been satisfied.
THAT, under the terms of the Agreement no provisions were made
for requiring a warranty period as the Alpine Bank Building, E1
Jebel is a temporary structure.

THAT, the County will release Letter of Credit No. 93 that is
in the amount of $1013.90.
THAT, this Resolution is necessary for the health, safety and
welfare of the County of Eagle, State of Colorado.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County of Eagle State of Colorado, this /�Vw- day of
July, 1994.
