APPROVAL OF THE
COMBINED SKETCH AND PRELIMINARY PLAN OF THE
H &R CONTRACTING, INC. MINOR PLANNED UNIT DEVELOPMENT

WHEREAS, on or about April 1, 1994, the County of Eagle,
State of Colorado, accepted for filin an application submitted
by Richard N. Harney, President, H &R Contracting Inc.,
(hereinafter "Applicant ") for approval of the PUD Combined Sketch
and Preliminary Plan of the H &R Contracting, Inc. Subdivision,
Planned Unit Development, File No. PD- 323- 94 -S /P; and,
WHEREAS, approval of the Application would allow for the
development of office space, storage and a garage as more
specifically described in the approved PUD Guide and illustrated
on the PUD Overall Development Plan; and,
WHEREAS, pursuant to Section 2.06.13(9) (Minor Planned Unit
Development) of the Eagle County Land Use Regulations, Sketch
Plan and Preliminary Plan may be-combined.
WHEREAS, at its public hearing held May 18, 1994, the
Planning Commission, based on its findings, recommended approval
of the proposed Combined Sketch and Preliminary Plan of the H &R
Contracting, Inc. Minor Planned Unit Development, with certain
conditions; and,
WHEREAS, a public hearing was held by the Board of County
Commissioners of the County of Eagle, State of Colorado, on
May 31, 1994; and,

12. That the area in question possesses the geological,
physical and other environmental conditions compatible
with the characteristics of the use requested.
13. That the advantages of the use requested outweigh the
disadvantages.
14a. That the area for which the rezoning is requested has
changed or is changing to such a degree that it is in
the public interest to encourage a new use of density
in the area; and
14b. That the proposed rezoning is necessary in order to
provide land for a demonstrated community need.
15. That for the above stated reasons, the proposed
rezoning is in the best interest of the health, safety,
convenience, order, prosperity, and welfare of the
citizens of Eagle County, Colorado.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of the County of Eagle, State of Colorado:
THAT, subject to the conditions set forth below, the
application submitted by Richard N. Harney, President, H &R
Contracting Inc, for approval of a Zone District Amendment and of
the combined Sketch and Preliminary Plan for the H &R Contracting
Inc. Planned Unit Development be and is hereby approved for the
following described parcel of land:

THAT, the following conditions are hereby placed upon this
approval:
1. An approved CDOT Highway Access Permit must be approved and
submitted with the Final Plat application.
THAT, the Combined Sketch and Preliminary Plan submitted
under this application and hereby approved, does not constitute a
"Site Specific Development Plan" as that phrase is defined and
used in C.R.S. 24 -68 -101, et seq.

The purpose of this Planned Unit Development Guide is to
set forth the lard use restrictions and development standards
that will govern this Zone District Amendment.
1) ALLOWED USES:
The subject property may be used for offices. storage
and garage provided that all activity is conducted within the
structure in accordance with Section B.
No other uses are being approved under this application.
2) SIGN RESTRICTIONS:
A- business sign shall be allowed that
conforms to the Eagle County Sign Code.
3) FENCES:
Only the existing perimeter fence on the East. South and
West boundaries of the subject property shall be allowed. The
exis fence behind the existing structure shall be .,,moved.
4) LIGHTING:
All exterior lighting shall be building mounted. less
than 150 wattage (incandescent) each and shall not be operated
after 8:00 pm or before 6:00 am. No exterior lighting shall_
negatively affect any adjacent property or roadways.
5) . PARKING:
The parking (one.. and enclosed) shall be as show- on the
Overall Development Plan (ODP).
61 STORAGE and TRASH:
No contractor storage shall be allowed. Trash shall be
entirely stored within the structure except for scheduled pick
Up days by vendor. No additional sc eening will be required.
7) MECHANICAL EQUIPMENT:

12) OPEN SPACE:
The open space shall be as depicted on the Overall
Development Plan and shall be maintained by the owner.
13) LANDSCAPING:
The landscaping shown on the Overall Development Plan
shall be installed as depicted including the sizes and species
shown. The maintenance shall be performed in such a way as to
preserve the initial installations for proper growth as well
as performing normal and routine cutting, trimming and
disposal of residuals.
14) POLLUTION CONTROL:
Not applicable.
