APPROVAL OF THE SUBDIVISION SKETCH PLAN
FILE NO. SU- 320 -94 -S

WHEREAS, on or about March 15, 1994, the County of Eagle,
State of Colorado, accepted for filing an application submitted
by Heidi Palmer (hereinafter "Applicant ") for approval of the
Subdivision Sketch Plan for Bear Gulch Subdivision, File No. SU-
320-94-S; and,

WHEREAS, the Applicant requested the approval of a
Subdivision Sketch Plan which would allow for the development as
follows: five (5) ten -acre single family parcels; and, j
WHEREAS, notice of the Sketch Plan was given to all proper
agencies and departments as required by the Eagle County Land Use
Regulations, Section 2.17.02(1); and,
WHEREAS, at its public hearing /hearings held May 4, 1994,
the Planning Commission, based upon its findings, recommended
approval of the proposed'Subdivision Sketch Plan, with certain
conditions; and
WHEREAS, at its regular hearing /hearings of May 17, 1994,
the Eagle County Board of Commissioners (hereinafter "Board "),
considered the Subdivision Sketch Plan, associated plans, and the
statements and concerns of the Applicant, the Eagle County
Community Development and Engineering staff, and other interested
persons.
BASED ON THE EVIDENCE BEFORE IT, and with the modifications
imposed by the conditions hereinafter described, THE BOARD FINDS
AS FOLLOWS:
1. The proposed Sketch Plan is in conformance with the
Master Plan, policies, guidelines, zoning and other
applicable regulations.
2. The land included in the proposed Sketch Plan is
suitable for subdivision.
3. Comments and recommendations from the agencies listed
in Eagle County Land Use Regulations, Section
2.17.02(1), have been considered.
The evidence shows that access which is capable of
servicing the development from the state highway system
to the parcel of land proposed for subdivision can be
built by the Applicant.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the application for approval of the Subdivision Sketch
Plan for Bear Gulch Subdivision be and is hereby .granted, subject
to compliance with the following conditions:
Adequate evidence of a water supply that is sufficient
in terms of quality, quantity and dependability will be
available. Adequate evidence that the existing
physical supply as well as the legal rights will not be
harmed. Conformance with Section 30- 28- 133(3)d) and
30 -28 -136, C.R.S. 1973 and Section 2.18.01(4)m)l),
Eagle County Land Use Regulations (E.C.L.U.R.);

restrictions, a raptor survey, smaller building
envelopes, wildlife movement corridors. It is further
requested that the applicant work with the neighboring
property owners and the DOW to develop a fair,
consistent and equitable method for examining and
mitigating all potential future wildlife impacts.
5. Adequate demonstration of County Engineer's concerns:
a. Individual lot access easements and grades;
b. Shade 30% or greater slopes;
C. Building Envelopes to minimize visual and site
impacts;
d. Investigate conservation easement on steep east
facing slope;
6. The County reserves the right, based upon the required
additional information, to impose further lot size,
geometry and /or number restrictions.
7. School land dedication fees based upon the relevant
Precinct at final plat.
8. Appropriate off -site road impacts at final plat.
9. The Preliminary Plan should show that the possibility
of "ridgelining" dwelling units has been severely
curtailed.
THAT, the Sketch Plan submitted under this application and
hereby approved, does not constitute a "site specific development
plan" as that phrase is defined and used in C.R.S. Section
24 -68 -101, et seq. Sketch Plan approval is expressly conditioned
on the County's authority to impose further restrictions or .
limitations on the Subdivision which are necessitated by impacts
which are not yet recognized or which are more severe than
realized under the review given at the hearings on the Sketch
Plan.
THE BOARD further finds, determines and declares that this
Resolution is necessary for the health, safety and welfare of the
inhabitants of the County of Eagle, State of Colorado.
