WHEREAS, on or about February 1, 1994, the County of Eagle,
State of Colorado, accepted for filing an application submitted
by Robert and Gloria Arnold and Don Byers (hereinafter
"Applicant ") for approval of the Subdivision Sketch Plan for
Arnold Meadows, File No. SU- 318 -94 -S; and,
WHEREAS, the Applicant requested the approval of a
Subdivision Sketch Plan which would allow for the development of
nine (9) Single Family lots and open space; and,
WHEREAS, notice of the Sketch Plan was given to all proper
agencies and departments as required by the Eagle County Land Use
Regulations, Section 2.17.02(1); and,
WHEREAS, at its public hearing /hearings held March 17, 1994
the Planning Commission, based upon its findings, recommended
approval of the proposed Subdivision Sketch Plan, with certain
conditions; and
WHEREAS, at its regular hearing /hearings of March 29, 1994,
the Eagle County Board of Commissioners (hereinafter "Board "),
considered the Subdivision Sketch Plan, associated plans, and'the
statements and concerns of the Applicant, the Eagle County
Community Development and Engineering staff, and other interested
persons.
BASED ON THE EVIDENCE BEFORE IT, and with the modifications
imposed by the conditions hereinafter described, THE BOARD FINDS
AS FOLLOWS:
1. The proposed Sketch Plan is in conformance with the
Master Plan, policies, guidelines, zoning and other
applicable regulations.
2. The land included in the proposed Sketch Plan is
suitable for subdivision.
3: Comments and recommendations from the agencies listed
in Eagle County Land Use Regulations, Section
2.17.02(1), have been considered.
4. The evidence shows that access which is capable of
servicing the development from the state highway system
to the parcel of land proposed for subdivision can be
built by the Applicant.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the application for approval of the Subdivision Sketch
Plan for Arnold Meadows be and is hereby granted, subject to
compliance with the following conditions:
1. The proposal shall proceed to the Preliminary Stage as
a Planned Unit Development for 9 single family units;
2. A "1041" application shall be submitted with the
Preliminary Plan for concurrent review if it is
determined to be required;
3. Language similar to the pre- inclusion agreement between
the developer and Mid Valley shall be included in'the
covenants and final plats concerning the close
proximity to the sewage treatment ponds. Either the
amount of platted private open space should be
increased or building envelopes should be platted
towards the north end of lots 7, 8 and 9 in order to
increase the buffer from the treatment ponds;
4. The applicant shall investigate with the Blue Lake
Homeowners Association the possibility of connecting
their respective open spaces;
5. If any infrastructure maintenance is required that
would ordinarily be provided by the County, an
Intergovernmental Agreement (IGA) should be facilitated

by the applicant and between the two counties for such
maintenance to be provided by Garfield County;
6. An extensive and detailed geologic and engineering
investigation should be performed particularly on the
lots immediately adjacent to the steeper slopes on the
north side of the development. Drainage on these lots
should also be .evaluated;
7. The Colorado State Forest Service and the Mt. Sopris
Soil Conservation District concerns should be addressed
in the covenants and /or the PUD Control Document;
8. The lots should be reconfigured or the ditch realigned
so that no lot is being bisected by the ditch. A ditch
easement agreement should be arrived'at between the
applicant and the ditch owners. If the ditch is piped
underground, then every effort should be made to
position the pipe so that a minimum of public
infrastructure is disturbed should the pipe need
repair.
9. The school district and RFTA should be consulted
concerning internal circulation and bus stops.
THAT, the Sketch Plan submitted under this application and
hereby approved, does not constitute a "site specific development
plan" as that phrase is defined and used in C.R.S. Section
24 -68 -101, et seq. Sketch Plan approval is expressly conditioned
on the County's authority to impose further restrictions or
limitations on the Subdivision which are necessitated by impacts
which are not yet recognized or which are more severe than
realized under the review given at the hearings on the Sketch
Plan.
THE BOARD further finds, determines and declares that this
Resolution is necessary for the health, safety and welfare of the
inhabitants of the County of Eagle, State of Colorado.
