SU- 316 -93 -5 WHEREAS, on or about December 1, 1993, the County of.Eagle, State of Colorado, accepted for filing an application submitted by B.B. Andersen (hereinafter "Applicant ") for approval of the Subdivision Sketch Plan for Travis Creek, Filing II, File No. \ SU- 316 -93 -5; and, WHEREAS, the Applicant requested the approval of a Subdivision Sketch Plan which would allow for the development as follows: sixteen single family lots on 163 acres; and, WHEREAS, notice of the Sketch Plan was given to all proper agencies and departments as required by the Eagle County Land Use Regulations, Section 2.17.02(1); and, WHEREAS, at its public hearing /hearings held January 19 and February 16, 1994, the Planning Commission, based upon its findings, recommended approval of the proposed Subdivision Sketch Plan, with the following: 1. Wildfire hazard mitigation must be adequately addressed; 2. Conformance with the requirements of the State Engineer, Division of Water Resources; 3. Demonstrate the adequacy of individual sewage disposal systems on each lot; 4. Designate wildlife habitat and open space. and ; WHEREAS, at its regular hearing /hearings of March 1, 1994, the Eagle County Board of Commissioners (hereinafter "Board "), considered the Subdivision Sketch Plan, associated plans, and the statements and concerns of the Applicant, the Eagle County 1 Community Development and Engineering staff, and other interested persons. BASED ON THE EVIDENCE BEFORE IT, and with the modifications imposed by the conditions hereinafter described, THE BOARD FINDS AS FOLLOWS: 1. The proposed Sketch Plan is in conformance with the Master Plan, policies, guidelines, zoning and other applicable regulations. 2. The land included in the proposed Sketch Plan is suitable for subdivision. 3. Comments and recommendations from the agencies listed in Eagle County Land Use Regulations, Section 2.17.02(1), have been considered. 4. The evidence shows that access which is capable of servicing the development from the state highway system to the parcel of land proposed for subdivision can be built by the Applicant. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the application for approval of the Subdivision Sketch Plan for Travis Creek, Filing II be and is hereby granted, subject to compliance with the following conditions: 1. Adequate evidence that water supply that is sufficient in terms of quality, quantity and dependability will be available. Adequate evidence that the existing physical supply as well as the legal rights will not be harmed. Conformance with Section 30- 28- 133(3)d) and 30 -26 -136, C.R.S. 1973 and Section 2.18.01(4)m)1), Eagle County Land Use Regulations (E.C.L.U.R.); 2. Adequate evidence that ISDS is or can be made suitable for each lot and that the additional loading will not have any affects off -site. 3. An adequate fire mitigation plan, both "in home" and wildfire; E 4. Adequate restriction details concerning but not necessarily limited to bear - proofing, dog and fence restrictions, raptor survey, smaller building envelopes, wildlife movement corridors. It is further requested that the applicant develop and prepare a fair and consistent method for examining and mitigating all potential future wildlife impacts. 5. Adequate demonstration of County Engineer's concerns: a. Individual lot access; b. Proposed road names; C. Adequate "squaring up" of intersections with Bellyache Ridge Road; d. Existing and proposed power lines; e. Natural gas service feasibility study; f. Proposed road surface standards; g. Impacts to the structural capacity of the Bellyache Ridge Road. 6. The County reserves the right, based upon the required additional information, to impose further lot size, geometry and /or number restrictions. 7. Evidence that the Colorado State Forest Service review fee has been paid ($75). 8. Deep basements shall be prohibited. 9. A mechanism shall be found to keep open space as open space. THAT, the Sketch Plan submitted under this application and hereby approved, does not constitute a "site specific development plan" as that phrase is defined and used in C.R.S. Section 24 -68 -101, et seq. Sketch Plan approval is expressly conditioned on the County's authority to impose further restrictions or limitations on the Subdivision which are necessitated by impacts which are not yet recognized or which are more severe than realized under the review given at the hearings on the Sketch Plan.
