FULL RELEASE OF COLLATERAL
GIL LYND WAREHOUSE
CONSTRUCTION IMPROVEMENTS AGREEMENT
WHEREAS, the Board of County Commissioners of the County of
Eagle, State of Colorado ( "Board ") entered into a Construction
Improvements Agreement dated December 4, 1992 ( "Agreement ") with
CAL Development Company ( "Builder ") , as a condition of Eagle
County's approval of a Temporary Certificate of Occupancy for the
Gil Lynd Warehouse.
WHEREAS, the Builder provided collateral in the form of cash
in the amount of $3,690.00.
WHEREAS, Builder has represented to the Board, and members of
the County staff have corroborated the Builder's representations,
that landscaping required under the Agreement has been completed in
a satisfactory manner (Exhibit A);
WHEREAS, the Builder has requested a full release of the
collateral in the amount of $3,690.00.
Based upon the oral and written recommendations of the County
staff, THE BOARD FINDS that the Builder's obligations under the
Agreement have been fully satisfied.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, a full release of the collateral in the amount of
$3,690.00 is granted.

THAT, the Eagle County Treasurer is hereby requested and
directed to issue a warrant in the amount of $3,690.00 to the
Builder.
THAT, all other provisions of the Agreement shall remain in
full force and effect.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County of Eagle, State of Colorado, this c7c2iv CP day of
Februarv. 1994.

RE: Gil Lynd Warehouse C.I.A.
Bob Johnson looked at the site to verify that all the trees,
junipers, earthwork, and seeding was done as of January 26, 1994.
Bob said that all of the trees and junipers were planted and the
dirt work completed, but, because of the snow on the ground, he was
unable to determine if the area had been seeded. I called Clay
Crossland on Thursday, January 27, 1994 and said we were unable to
determine if the area was seeded. I asked to have the contractor
that did the seeding, or the owner, write a letter to verify that
the seeding has been completed. Received a letter on February 1,
1994 (copy enclosed) that the seeding is complete.
I recommend that the collateral be reduced to -0 -. Enclosed is a
collateral release summary showing work completed to date.
