ZS- 340 -93 0 c� o x o WHEREAS, The Town of Avon, ( "Applicant ") did file an application with the Eagle County Department of Community Development on or about November 1, 1993, for a Special Use Permit for temporary transit and public works facility, within a Resource Zone District, in the unincorporated area of Eagle r County described.as follows: s o ro A parcel of land located in the east k of Section 12, o Township 5 South, Range 82 West of the 6th P.M., Eagle U County, Colorado, generally described as follows: x w Beginning at a common point on the boundary of the easterly w x town limits of the Town of Avon and the southerly right-of- way of Interstate 70 from whence the northeast corner of said Section 12 lies N 35 0 15 1 22" E, 1878.57 feet, thence S 1.8 59'40 °i W, y95.99 feet along the easterly Avon Town Boundary to a point on the northerly right -of -way line of lzj q the Denver & Rio Grande Western Railroad, thence easterly o along said Railroad right -of -way 900 feet, thence North o 0 18 0 59 1 40" E, to a point on the southerly right -of -way line N a of Interstate 70, thence westerly along said Interstate 70 o r' right -of -way to the point of beginning, said parcel m containing 20 acres, more or less. rnw and i w WHEREAS, based on the evidence, testimony, exhibits, study r of the Master Plan for the unincorporated areas of Eagle County, m 4 comments of the Eagle County Department of Community Development, comments of public officials and agencies, the recommendation of the Planning Commission, and comments from all interested parties, the Board of County Commissioners of the County of rn ~' Eagle, State of Colorado ( "the Board "), finds as follows: rn C � P N �t 1. That proper publication and public notice was provided "' as required by law for the hearings before the Planning Commission and the Board. 2. That the proposed special use conforms to the require- ments of Section 2.09 of the Eagle County Land Use Regulations, which are incorporated herein as if set forth with particularity. 1 3. That the ,bposed special use will b. •ompatible with existing uses in the area. 4. That the following have been considered: The potential effect of the use on the character of the neighborhood, adequacy of access to and from the area, appropriateness of the physical arrangement of the use on the proposed site, and consistency with the Master Plan. 5. That for the above - stated and other reasons, the proposed special use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Eagle County. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: That the application of the Town of Avon, File No. ZS -340- 93, for a Special Use Permit for temporary transit and public works facility within the Resource Zone District described herein, be approved, subject to the conditions as set forth herein. THAT, the following conditions shall be placed upon this approval and that violation of any condition shall be the basis for revocation of the Special Use Permit: 1. Conformance with Section 2.07.07(1)a -e, g) of the Eagle County Land Use Regulations, Industrial and Commercial Performance Standards, shall be required; 2. This permit shall automatically expire with the termination of the lease or in five (5) years, which ever is sooner; 3. The Bridge at McGrady Acres Subdivision shall not be used as secondary access without the permission of the County Engineer: 4. All material representations made by the Applicant in the application and public meeting shall be adhered to and considered conditions of approval, unless otherwise amended by other conditions. THAT, this permit shall be subject to periodic review by the Planning Department, and shall be heard by the Board of County Commissioners only if complaints are received and not satisfactorily resolved by the staff. THAT, the Board of County Commissioners directs the Department of Community Development to provide a copy of this Resolution to the Applicant.
