RESOLUTION GRANTING A SPECIAL PERMIT FOR
TEMPORARY HOUSING FOR
John Brooch 9405 Brush Creek Road

WHEREAS, the Board of County Commissioners of the County of Eagle,
State of Colorado (hereinafter the "Board"), is authorized to grant
temporary housing permits, pursuant to Chapter II, Section 2.07.09 of the
Eagle County Land Use Regulations; and
WHEREAS, John Brgoch (hereinafter the "Applicant") applied to the
Eagle County Department of Community Development for a Temporary Housing
Permit on May 17, 1996, within the Resource Zone District; and
WHEREAS, based on the evidence, testimony, exhibits, study of the
Master Plan for the unincorporated areas of Eagle County, comments of the
Eagle County Department of Community Development, comments of public
officials and agencies, and comments from all interested parties, the Board
of County Commissioners of the County of Eagle, State of Colorado ("the
Board"), finds as follows:
1. That proper publication and public notice was provided as
required by law for the hearings before the Planning Commission
and the Board.
2. That the proposed use of the temporary housing permit conforms to
the requirements of Section 2.07.09 of the Eagle County Land Use
Regulations. ~
3. That the proposed special use will be compatible with existing
uses in the area. ,~
4. That for the above-stated and other reasons, the proposed zoning
is in the best interest of the health, safety, morals,
convenience, order, prosperity and welfare of the citizens of
Eagle County.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board hereby approves a special permit for temporary housing
for Randy Cook, provided the following conditions are met: ~-
1. The Temporary Housing Permit shall expire six (6) months from the
date of this Resolution. Mr. Brgoch may request one extension
from Department of Community Development for an additional six
months.
2. Not more than one temporary housing unit shall be located on the
construction site and inhabitants on that site shall be owners of
--the lot or construction employees.
3. No final inspections will be performed for the construction
project until the temporary housing unit is removed or converted
to a non-residential use and the site is restored to the
satisfaction of the Eagle County Building, Health and Planning
Officials.
THAT, should Applicant not comply with any or all of the conditions,
the Temporary Housing Permit shall be revoked.
THAT, the Board of County Commissioners directs the Department of
Community Development to provide a copy of this Resolution to the
Applicant.
THAT, the Board hereby finds, determines and declares that this
Resolution is necessary for the health, safety and welfare of the citizens
of Eagle County.
MOVED, READ AND ADOPTED by the Board of County Commissioners of the
County of Eagle, State of Colorado, at its regular meeting held the 18th
day of June 19.4 nunc pro tunc to the 28th day of May.
